GOVERNMENT REGULATION
of 15 November 2000
amending Government Decree No. 365 / 1999 Coll., on the amount and conditions of remuneration of sentenced persons in employment in the execution of prison sentences
The Government hereby orders pursuant to § 33 (1) of Act No. 169 / 1999 Coll., on the execution of the prison sentence and on the amendment of certain related laws:
Government Decree No. 365 / 1999 Coll., on the amount and conditions of remuneration of sentenced persons in employment in the execution of prison sentences, is hereby amended as follows:
1. Paragraph 1 (2) reads as follows:
"(2) The amount of remuneration shall be determined by the sentenced prison depending on the quantity and quality of the work done."
2. in Article 2 (2) (a):
"(a) in the I. group amount 4,500 CZK,."
footnote 1 is deleted;
3. In Paragraph 2 (3), "42,5 hours' is replaced by" 40 hours';
4. In the second sentence of Article 2 (5), the words "the basic component of remuneration thus granted may not be less than the amount of the basic component of remuneration which would otherwise be payable to the sentenced under paragraph 2 'shall be replaced by the words" the standard must be fixed in such a way that the amount of the basic component of remuneration thus awarded is not less than the amount of the basic component of remuneration which would otherwise be payable to the sentenced under paragraph 2'.
5. The following paragraph 7 is added to Section 2, including footnote 1:
"(7) If the sentenced person fails to carry out the duties assigned to him, the prison shall reduce the basic component of the remuneration for that period proportionately; If the sentenced is employed by another entity, (1) the prison may thus reduce the basic component of the remuneration on the basis of a proposal from that entity.

6. footnote 3 shall read:
"3) Article 5 of Government Decree No 333 / 1993 Coll., on the determination of minimum wage rates and wage advantages for work in a difficult and healthy working environment and for work at night, as amended by Government Decree No. 308 / 1995 Coll., Government Decree No. 356 / 1997 Coll., Government Decree No. 318 / 1998 Coll., Government Decree No. 132 / 1999 Coll., Government Decree No. 312 / 1999 Coll. and Government Decree No. 163 / 2000 Coll."
7. Article 6, including the title and footnotes 4) and 5) shall read as follows:
Extra charge for work in a difficult and healthy working environment
For work in a difficult and healthy working environment, the sentenced fee shall be subject to conditions and amounts
(a) provided for in specific legislation4) as a minimum wage advantage for work in a difficult and healthy working environment where the sentenced is assigned to work in the course of the prison's business activity or under a contract between the prison and another body;
(b) provided for in special legislation5) as a special surcharge for carrying out activities in difficult and healthy working conditions where the sentenced is assigned to work in the context of the operation, production or other non-business activities of the prison.
4) Article 4 of Decree No 333 / 1993 Coll.
5) Government Decree No. 252 / 1992 Coll., on the conditions for granting and the amount of the special allowance for carrying out activities in difficult and healthy working conditions, as amended by Government Decree No. 77 / 1994 Coll. '
This Regulation shall enter into force on 1 December 2000, with the exception of Article I (3), which shall take effect on 1 January 2001.
