providing for the granting of aid and compensation for the control of diseases and other animal diseases, determining free professional veterinary activities and laying down other territorial scope of the district veterinary administrations
The Ministry of Agriculture of the Czech Republic provides pursuant to § 35 paragraph 4 of Act No. 87 / 1987 Coll., on Veterinary Care, as amended by Act No. 239 / 1991 Coll. (full version No. 215 / 1992 Coll.), and § 2 paragraph 2 and § 8 paragraph 2 of the Act No. 108 / 1987 Coll., on the Jurisdiction of the Veterinary Care Bodies of the Czech Republic, as amended by the Act No. 437 / 1991 Coll. of the Czech National Council Bureau Act No. 25 / 1991 Coll. (full version No. 475 / 1991 Coll.):
AID AND REFUNDS
Provision of aid
Aid may be granted to farmers for the payment or reduction of damage or the costs of carrying out the prescribed protection and control measures against diseases and other animal diseases, (1) as well as the damage caused by the death of animals as a result of the disease or other animal diseases,
(a) livestock farmers, 2)
(b) game hunting users in target breeding facilities, 3)
(c) the breeder of another animal, if it is an animal with special training or otherwise of value and has been ordered to be killed.
Amount of aid
(1) When determining the damage, it shall be based on the purchase prices of the animals and, if the purchase price is not determined in accordance with the price regulation, on the prices of the animals determined by the expert opinion.
(2) The amount of the damage shall be deducted from the amount of the damage provided to the breeder for the necessarily slaughtered animal and for reasons of insurance.
Circumstances excluding aid
The aid may not be granted if the breeder has infringed an important obligation imposed on him by veterinary legislation to prevent the development, to prevent the spread and to control diseases and other animal mass diseases. 4)
Granting of compensation
(1) Persons staying in the municipality or, where appropriate, in the premises in which, under veterinary legislation, a closure has been ordered, (5) for which they have not been able to carry out normal work on a temporary basis, or have been able to carry out it only to a limited extent, are entitled to compensation for lost earnings, provided that such compensation is not due to their employer, or to compensation for demonstrable loss of earnings, but a maximum of 6000 CZK.
(2) Persons who have been forced to stay outside their residence for the reason referred to in paragraph 1 shall be entitled to compensation for the increased costs of temporary accommodation and meals.
(3) The refund referred to in paragraph 2 shall be granted in accordance with the same procedure as during a work trip or transfer to a place of work outside the municipality of regular residence for a period determined in accordance with the rules on travel refunds. 6)
Procedure for granting aid or compensation
(1) An application for aid or refund shall be submitted no later than three months after the date of expiry of the emergency veterinary measures. 7) It shall be administered to the district office in whose district protection and control measures against diseases and other animal diseases have been ordered or, where appropriate, in whose district an event is justified.
(2) Applications for aid or refunds under paragraph 1 shall be accompanied by:
(a) the opinion of the competent district (urban) veterinary administration;
(b) if it is a disease communicable from animal to human, also the opinion of the county hygienist.
SPECIFIC VETERINARY ACTIVITIES
Professional veterinary activities shall be carried out free of charge if:
(a) professional veterinary activities carried out by veterinary authorities for the purpose of the exercise of public administration;
(b) the investigation of animals suspected of being infected with animals or other animal diseases and the professional veterinary activities necessary to combat the disease or other animal diseases;
(c) investigation, vaccination and treatment of blind dogs.
ADJUSTMENT OF THE TERRITORIAL SCOPE OF CERTAIN SECRESE VETERINARY GOVERNMENTS
The district veterinary administration in Liberec also exercises its competence for the district district of Jablonec nad Nisou. The Regional Veterinary Administration in Cheb shall also exercise its competence for the territorial district of Sokolov.
COMMON, TRANSITIONAL AND FINAL PROVISIONS
The examination of an application for aid or compensation submitted before the date of application of this Order shall be carried out in accordance with the rules in force at the time of the event of damage.
The Order of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic No. 114 / 1987 Coll., which provides for the granting of aid and refunds for the control of diseases and other animal diseases and specifies free professional veterinary activities.
This Decree shall take effect on 1 September 1992.
