DECLARATION
of 24 June 2004
on the declaration of sites with a historical environment in selected municipalities and parts thereof for conservation zones and determining the conditions for their protection
The Ministry of Culture, after consulting the competent regional authorities, provides pursuant to § 6 paragraph 1 of Act No. 20 / 1987 Coll., on State Heritage Care, as amended by Act No. 132 / 2000 Coll. and Act No. 320 / 2002 Coll.:

(1) The boundaries of the territory of the zones are defined in the Annex to this decree and will be graphically marked on copies of the cadastral maps, which will be stored within 90 days of the date of entry into force of this decree by the Ministry of Culture, the professional organisation of state conservation, the competent regional authorities and the municipal authorities of the enlarged municipalities and the municipalities in whose territory the zones are located.
(2) The boundaries of the territory of the zones shall be marked when the territorial planning documents are drawn up and changes thereto.
In order to ensure the conservation of the zone and its historical environment, which have significant cultural values with architectural files, individual real estate monuments, land arrangements, roads, water areas, water flows, permanent crops and realised composite projects, the following conditions of protection are laid down:
(a) the spatial and functional layout of the territory and its preserved urban composition must be respected when the planning documents and changes thereto are being drawn up, as well as in the preparation of further measures;
(b) the use of outdoor spaces and areas and individual buildings must be consistent with their historical nature and capacity and technical possibilities;
(c) any modification of the outdoor areas and areas and individual structures and objects shall be directed towards an aesthetic, functional and technical evaluation of the zone and the preservation of its cultural values; and
(d) in the case of new construction, reconstruction and modernisation of buildings, the character and scale of the preserved installation and its spatial layout must be respected.
This Decree shall take effect on 1 January 2005.
