GOVERNMENT REGULATION
of 14 December 2010
on the adjustment of compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease and the adjustment of the cost of maintenance of survivors
The Government orders the implementation of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended by Act No. 186 / 2004 Coll., Act No. 436 / 2004 Coll., Act No. 586 / 2004 Coll., Act No. 626 / 2004 Coll., Act No. 169 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 530 / 2005 Coll., Act No. 189 / 2006 Coll., Act No. 531 / 2006 Coll., Act No. 261 / 2007 Coll., Act No. 305 / 2008 Coll., Act No. 306 / 2008 Coll., Act No. 326 / 2009 Coll.:
§ 1
The compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease (hereinafter referred to as "compensation for loss of service income ') and the reimbursement of the maintenance costs of survivors due to members or survivors under Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended, or under previous legislation1), shall be adjusted by increasing by 3,9% the average service income applicable to the calculation of compensation for loss of service income and to the reimbursement of maintenance costs of survivors, possibly increased by previous legislation2.
§ 2
In the event of entitlement to compensation for loss of service income and the cost of maintenance of survivors after 31 December 2010, the average service allowance applicable to the calculation of compensation under Paragraph 1 shall not be increased.
§ 3
The adjustment provided for in Article 1 shall be made without the request of the member or survivors; at the request of the member, where the compensation for loss of service income was not due to an increase in disability pension under social security legislation or pension insurance.
§ 4
Efficacy
This Regulation shall enter into force on 1 January 2011.
