Decree of the Ministry of Economic Policy and Development of the Czech Republic on certification of professional competence to design, implement and evaluate geological work

on the certificate of competence to design, perform and evaluate geological work
The Ministry of Economic Policy and Development of the Czech Republic provides pursuant to § 26 paragraph 1 of the Act of the Czech National Council No. 62 / 1988 Coll., on Geological Works and on the Czech Geological Office, as amended by the Act of the Czech National Council No. 543 / 1991 Coll., in agreement with the Ministry of the Environment of the Czech Republic:
Preliminary provisions
§ 1
This decree sets out in more detail the assumptions to be met by the natural person requesting a certificate of competence of the responsible geology solver (1) to design, carry out and evaluate geological work in the overall solution of the geology task (hereinafter referred to as the certificate) and the procedure for verifying competence.
§ 2
For the purposes of this decree, technical, laboratory and other partial work carried out under a geological task shall not be regarded as activities referred to in Paragraph 1 unless they are independently geologically designed and evaluated.
§ 3
Presumption of competence
The natural person applying for the certificate (hereinafter referred to as "the tenderer ') shall fulfil the following conditions:
(a) university or full vocational secondary education in the field or, where appropriate, university education in the related field; a related branch is considered to be, for example, the discharge of the Mining Faculty of the University of Mining, the engineering geologists of the Faculty of Engineering, the University of Technical Education and the University of Chemistry,
(b) the specialisation practice for which the certificate is requested; for applicants with higher education in the field of at least 3 years, for applicants with full vocational secondary education in the field of at least 8 years, for applicants with higher education in the related field of at least 8 years,
(c) the ability to design, sell and evaluate separately the geological tasks in the specialisation for which the certificate is requested; be demonstrated by the copyright or copyright of the overall solution of geological tasks in the specialisation for which certification is requested, or by the copyright of equally specialised publications,
(d) knowledge of the generally binding legislation necessary for the performance of the function of the responsible investigator of the geological task, in particular of the upper and geological regulations.
§ 4
Request
(1) Professional competence is certified at the written request of the candidate submitted to the Ministry of Economic Policy and Development of the Czech Republic (hereinafter "Ministry").
(2) The application contains:
(a) the name, surname, date of birth, place of permanent residence and applicant's birth number;
(b) data on professional training achieved;
(c) data on the length and orientation of the practice, supported by a brief overview of the current professional activity, expert references;
(d) a list of works (publications) containing the overall solution of geological tasks in the specialisation for which a certificate is requested, to which the applicant is the author or to whose overall solution the author was involved; for unpublished work with an indication of the signature under which the work is stored in the Geofund in the Czech Republic or in the Geofund in the Slovak Republic. Where the tenderer has carried out a practice or part thereof abroad, he shall indicate where the results of his work are stored. In the case of a larger number of works, the list of those considered representative by the tenderer shall be sufficient,
(e) selected works (publications) by which the applicant illustrates the way in which the overall geology of the geology task is to be solved, in the bearing geology of one work (publications), in other specialties two to three works (publications) at the choice of the candidate.
§ 5
Verification of competence
(1) Professional competence shall be verified by examination. The test shall verify the documents referred to in Article 4 (2) (a), (b) (c) submitted by the tenderer, assess the professional level of selected works (publications) referred to in Article 4 (2) (e) and verify the legal knowledge.
(2) The professional level of selected works is evaluated by the professional guarantee, 2) which is appointed and withdrawn by the Ministry in agreement with the Ministry of the Environment of the Czech Republic from the experts of geological professions on the recommendation of universities, state geological services and state geologists organisations. 3)
(3) Publications which have been lectured before publication are not subject to the assessment of professional guarantees.
§ 6
Test panel and test security
(1) The examination committee shall be composed of the President, the Vice-President, the Secretary and the members of the Commission. The Chairman of the Commission and a member of the Commission shall be appointed and dismissed by the Ministry to verify the knowledge of generally binding legislation. The Vice-President is appointed and dismissed by the Ministry of the Environment of the Czech Republic. The Secretary shall be a member of the Ministry's professional service. The other members of the Commission are permanent experts (Section 5 (2)).
(2) The Chairman of the Commission shall, as appropriate, entrust individual specialists from a group of permanent professional guarantees with an assessment of the selected work according to the professional focus of the work.
(3) In assessing the selected works of the tenderer, where there is doubt as to the accuracy of the factual or methodological solution, the chairman of the examination committee shall ensure the presence of the members of the panel who have been entrusted with the assessment of the selected works in accordance with paragraph 2.
(4) In verifying the legal knowledge, the examination committee shall take into account the professional orientation of the candidate. In addition to generally binding legislation in the field of geology and mining, the candidate's ability to focus in the Commercial Code, in the Civil Code, in the Commercial Act and in the generally binding legislation on environmental protection is verified as regards the provisions applicable to geological work. The examination committee shall communicate the questions to the candidate in the summons.
(5) The examination committee shall be capable of a quorum in the presence of the President, Vice-President, Secretary and at least two members of the committee.
(6) A record of the test shall be made by the Secretary of the Examination Committee, indicating the questions, the evaluation of the answers and the outcome of the evaluation of the selected works. In addition, the test result "passed 'or" failed' shall be reported. If the tenderer fails to comply, the justification shall be given. The minutes shall be signed by the Chairman and the Vice-President of the Examination Committee.
§ 7
Certification
(1) The Ministry shall issue a certificate on the basis of the test result in accordance with Section 6. The certificate shall define the geological work for which the certificate pays .4)
(2) The certificate is valid for 5 years. The Ministry may, at the request of the holder, extend the validity of the certificate for an additional period of 5 years. The extension of the certificate may be conditional upon the examination of the tenderer, which is necessary, if the tenderer has not carried out geological work during the past five years under the certificate issued or if the legislation under examination has substantially changed. Only knowledge of the legislation shall be re-checked by the Examination Board.
(3) A candidate who has not been granted a certificate may reapply at the earliest one year after the decision has become final.
(4) To whom the certificate has been withdrawn, 5) may submit a new application for a certificate after 2 years.
§ 8
Registration
(1) The records of certificates kept by the Ministry shall include a list of the holders of certificates issued, the definition of the geological works for which the certificates are valid and the date of issue of the certificates.
(2) The records of certificates issued may be consulted and extracts and copies may be taken from the records.
§ 9
Efficacy
This decree shall take effect on the day of its publication.
