DECLARATION
of 6 December 2013
amending Decree No 61 / 2011 Coll., on the sampling requirements, procedures and methods for testing seed and seed
The Ministry of Agriculture provides pursuant to § 3a (11), § 4 (15) (a) and (b), § 5 (8) (h), § 6 (8) (c) to (f), § 19 (15) (l) and § 22 (8) (b) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and on the amendment of certain laws (Act on the circulation of seeds and seed), as amended by Act No. 178 / 2006 Coll., Act No. 299 / 2007 Coll., Act No. 96 / 2009 Coll., Act No. 300 / 2009 Coll., Act No. 54 / 2012 Coll. and Act No. 279 / 2013 Coll.:
Decree No 61 / 2011 Coll., on the sampling requirements, procedures and methods of testing for seed and seed shall be amended as follows:
1. At the end of footnote 1, the sentences "Commission Implementing Directive 2012 / 37 / EU of 22 November 2012 amending certain Annexes to Council Directives 66 / 401 / EEC and 66 / 402 / EEC as regards the conditions to be fulfilled by Galega orientalis Lam seed, the maximum weight of seed lots of certain fodder plant species and the size of the Sorghum spp. Commission Implementing Directive 2013 / 45 / EU amending Council Directive 2002 / 55 / EC, Directive 2008 / 72 / EC and Directive 2009 / 145 / EC as regards the botanical name for tomato. ';
2. In Article 3 (1), the words "and reserve sample 'shall be inserted after the words" sample'.
3. In Article 5, the following paragraph 7 is added:
"(7) 3 samples, one of which is intended for laboratory testing, the other being kept as a reserve sample, and the third being stored with the Institute in case of repeated testing, shall be taken to check the ingredient of the genetically modified variety in seed. The minimum sample weight corresponds to the sample size set out in Annex 5, Table 1, column 4. The seed potatoes shall be treated in a similar manner and the samples shall be stored in such a way that they cannot be degraded. The weight of the sample is 25 kg. '
4. In Paragraph 11 (4), "registration 'is replaced by" protocol' and "registration 'is replaced by" protocol'.
5. In Annex No 1, Part 2, paragraph 1, the words "a sufficient quantity of seed collected for the creation of reserve samples, if required 'are replaced by the words" the creation of a reserve sample'.
6. In Annex No 2 (2) (a), "Minutes' is replaced by" Protocol '.
7. In Annex 2, the model of the Protocol from the evaluation of the growing test reads:

8. In Annex 3, Part 3, point 3.5, paragraph 2, the words "and the finding shall be notified to the State Plant Health Administration 'shall be deleted.

Rules on the setting up and evaluation of vegetation tests
1. Purpose and principle of vegetation test
(1) The vegetative test makes it possible to assess the characteristics of propagating material in characters which are difficult to determine by other methods, or their determination by other methods is not conclusive or too costly.
(2) The vegetative test shall check the species and variety purity and authenticity, the percentage of hybrid and, where appropriate, health status. It shall also be monitored whether there are changes in the characteristics of varieties during the seed propagation process.
(3) The authenticity of the variety shall be assessed on the basis of a visual comparison of plants produced on the control parcel with a representative sample of the tested lot and plants produced on the parcel planted by a standard sample of the variety. This shall determine whether the plants of the sample concerned correspond to the official description of the variety concerned.
(4) The purity level of the variety shall be assessed by establishing the number of such plants produced on the control parcel which do not correspond exactly to the description of the variety. This will determine whether the sample under consideration complies with the specified purity standards.
2. Types of vegetation tests
2.1 Vegetation tests according to the Organisation for Economic Cooperation and Development schemes
(1) The Institute certifies seed according to the schemes of the Organisation for Economic Cooperation and Development for varietal certification of seeds moving on the international market. Certificates certifying the varietal identity and purity of the seed shall be issued provided that the result of the initial vegetation test is satisfactory, that the sample is taken for the exit vegetation test and that the field inspection or inspection results are satisfactory.
(a) the initial vegetation test:
1. the test shall take place during the same, or previous, growing season in which the propagation crop is evaluated,
2. the assessment of the initial growing test of the input propagating material may be used in the evaluation of the propagation crop;
3. the evaluation of the vegetation test should be consistent with the evaluation of the crop;
4. if defects are detected, the cause shall be determined and the severity assessed. In the absence of external influences, these defects are grounds for not issuing a certificate,
(b) exit vegetation test:
1. the test is carried out during the growing season where the lot is already recognised and put into circulation and, where appropriate, sown on areas of normal cultivation, so that any measure may be taken if defects are detected only for those lots or parts thereof which have not yet been put into circulation,
2. the plants grown from a recognised seed lot shall be compared with plants produced from a standard sample; therefore, the results of the exit vegetation test shall be used to check that there are no undesirable changes in varietal purity during seed propagation;
3. the exit vegetation test may be an initial vegetation test for seed of the next generation,
4. the exit vegetation test must be established for hybrid varieties, since in such cases it is not possible to assess the identity or purity of the variety in the seed crop.
2.2. Field vegetation test as a follow-up and control of seed put into circulation
It shall be carried out in the following cases:
(a) breeding propagating material put into circulation;
(b) pre-stage propagating material and basic propagating material of such varieties, which, in the previous recognition procedure, appeared to be problematic or for which the supplier first submitted an application for recognition,
(c) for checking the production and putting into circulation of propagating material;
(d) checking standard seed and vegetable seedlings;
(e) when checking selected seed and seed lots imported from third countries;
(f) in the case of checks by authorised persons,
(g) for the inspection of the varieties not officially registered;
(h) a claim for seed supply;
(i) for seed lots where there is doubt as to the authenticity or purity of the variety,
(j) a follow-up check on the hybrid;
(k) for the control of seed of conservation varieties;
(l) for the control of seed of varieties grown for cultivation under special conditions;
(m) when checking the automatic sampling device.
2.3 Control of the percentage of hybrid
The test shall be carried out in the form of a follow-up check on seed of hybrid varieties. The method of conducting the tests for each species is given in Table 1.

2.4 Subsequent inspection of seed potatoes
The check shall be subject to the certification procedure in category SE1 (possibly SE2), to new varieties classified in national varietal tests, where a certification procedure is applied for, varieties having an ELISA test result higher than the average health status of all varieties in a given year, revision samples and samples of the seed of imported and exported lots.
2.5 Determination of the percentage of the presence of weeds in sugar beet seed and fodder beet
When determining the presence of seeds of weed beet in sugar beet seed and fodder beet, the vegetation test is based on two repetitions of a total area of 45 m2, where about 2 000 plants are grown without unification.
3. Technological Procedure
(1) The vegetation test shall determine whether plants grown on the control parcel from the test sample conform to their characteristics
(a) an official description of the variety;
(b) plants of the standard sample;
(c) the values laid down for the assessment of seed crops.
(2) For most plant species, growing tests are based on selected varietal characteristics listed in the UPOV Directives (Union for the Protection of New Varieties of Plants) for tests of diversity, uniformity and stability according to which varieties have been registered.
3.1 Test samples
The minimum weight of samples for growing tests is given in Annex 5. The final dates for the supply of samples for growing tests for test stations are given in Table 2. The sample to be delivered to the test station after the deadline set out in Table 2 shall not be included in the tests during the growing season; the sample may be included in the tests during the following growing season.

3.2. Standard sample
(1) The standard sample is a sample of seed of the variety to which the test sample is compared for the purpose of verifying varietal identity and purity. It is always sown in the immediate vicinity of the test sample.
(2) The standard sample is used
(a) a sample delivered by the breeder to the Institute for the Registration of the Variety;
(b) a sample requested by the Institute from the breeder or breeder of the variety in question;
(c) for a variety registered abroad, a sample delivered at the request of the Institute by the official authority of the country concerned.
(3) As a standard sample it is possible to use
(a) an official sample of seed of propagating material of pre-stages and basic propagating material,
(b) certified propagating material of the first generation for synthetic varieties, allogeneic species and all hybrid varieties;
(c) inbred lines and parental components in the categories of pre-stage propagating material or basic propagating material used for the production of hybrid varieties.
These samples may be used provided that the seed has been compared with the uniformity and stability of the sample delivered by the breeder to the breeder when registering the variety.
(4) In case of loss of germination or consumption of seed stocks, the Institute shall require a new standard sample in advance of at least one growing season.
3.3 Parts for growing tests
(1) Vegetation tests are based on the Institute's test stations under the conditions of field maloparty tests or in protected areas of greenhouses or foils.
(2) The vegetative test is established in a more climate-warming area, with the possibility of irrigation for a faster uptake, which will guarantee the possibility of earlier plant evaluation than in the crop area.
(3) The land on which parcels with vegetation tests are situated must not be covered by wild plants of the same or closely related species, and the sequence of crops must ensure that soil stock seed does not affect the assessment of the test.
(4) The test species shall be grown on control parcels in accordance with the agrotechnical principles for the plant species.
(5) The control areas are restricted to the use of herbicides, fertilisers and growth regulators in order not to affect plant morphology and to avoid growing.
(6) The test parcels shall be placed on the parcel by plant species, variety and type of vegetation test according to the following criteria:
(a) the test plot is placed as close as possible to that of the standard sample of the variety concerned;
(b) samples of related lots, the same varieties and similar varieties shall be planted together;
(c) where the sample is sown in several variants, the repetition shall be placed on another part of the parcel, in particular for the species where the measurements are made.
(7) Minimum areas of control parcels and, where appropriate, the lowest number of plants per species are given in Table 3

4. Procedure for evaluation of vegetative tests
Continuous evaluation of varietal purity may be carried out throughout the period of growth and development of plants where the characteristics of the variety are apparent. The varietal characteristics are divided into primary and secondary characteristics. In the evaluation it is necessary to focus mainly on plants different and atypical. These shall be described in detail and marked visibly so that they are not re-evaluated. An estimate of the number of individuals on the parcel shall be made and different types shall be calculated. The values obtained shall be compared with the tables. If the number of variances is equal to or exceeds the values in the table, the evaluation shall be repeated.
4.1 Evaluation of varietal identity and purity of agricultural species excluding maize in vegetative tests
The assessment of varietal purity shall be carried out for each species in accordance with Table 4.

4.2 Evaluation of varietal identity and purity for maize
The assessment of varietal purity for maize shall be carried out in accordance with Tables 8 to 10. The evaluation varies depending on the type of variety.

4.3 Evaluation of the control of the percentage of hybrid
The percentage of hybrid shall be calculated as the ratio of the number of non-compliant plants to the total number of plants evaluated. In assessing the pollen-sterile hybrid component, in addition to the determination of the level of hybrid, it shall be established whether plants of that component produce viable pollen.
4.4 Evaluation of post-control of seed potatoes
During the test 100 tubers (4 x 25 pieces) on the test plot shall be dropped. During vegetation, each test plot is checked twice by a comic show. The vegetative tests shall be evaluated according to the requirements for propagation crops.
4.5 Evaluation of post-control of standard vegetable seed
According to the species, the specified number of plants or the quantity of plants on the crop on the area of area listed in Table 3 shall be evaluated.
In addition, a different colour of roots is evaluated for carrots, and in the case of beetroot, a white-ring salad eyeballs and a bright-ring eyeballs. For fruit vegetables, the selected fruits are usually left fully ripe to check the varietal characteristics.
4.6 Evaluation of seedling control
The test and its assessment are similar to those of point 4.5.
4.7 Evaluation of the percentage prevalence of weeds in sugar beet seed and fodder beet
(1) The evaluation shall be carried out by the staff of the Institute in the presence of suppliers. For each flowering plant, the following characteristics of weeds are checked:
(a) vegetative rainfall;
(b) the presence of anthocyane on the stem;
(c) the number of flowers;
(d) the number of vascular bundles on the root;
(e) root strength.
5. Keeping records of vegetation tests
(1) The Institute shall issue a report on the result of the growing test, a model of which is set out in Annex 2.
(2) For agricultural species which satisfy the requirements for the evaluation of varietal identity and purity, suppliers are informed of the results of the growing tests by extract from the Institute's electronic database. In other cases, the Institute shall issue a protocol. ';
