Government Regulation No. 361 / 2007 Coll., laying down conditions for the protection of health at work, as amended by Government Regulation No. 68 / 2010 Coll., Government Regulation No. 93 / 2012 Coll., Government Regulation No. 9 / 2013 Coll., Government Regulation No. 32 / 2016 Coll. and Government Regulation No. 246 / 2018 Coll., are amended as follows:
1. At the end of footnote 1, the sentences are added on a separate line:
"Directive (EU) 2017 / 2398 of the European Parliament and of the Council of 12 December 2017 amending Directive 2004 / 37 / EC on the protection of workers from the risks associated with exposure to carcinogens or mutagens at work.
Directive (EU) 2019 / 130 of the European Parliament and of the Council of 16 January 2019 amending Directive 2004 / 37 / EC on the protection of workers from the risks associated with exposure to carcinogens or mutagens at work. ';
2. Paragraph 18 (2), including footnote 28, reads:
"(2) If the results of the evaluation indicate that the use of the chemicals referred to in Article 16 (1) (a) cannot be replaced for technical reasons by a chemical or in accordance with the procedure referred to in paragraph 1, the employer shall ensure that their use or production is carried out, where technically feasible, in a technologically closed system. If the introduction of a closed system is not technically feasible, the staff member's exposure must be reduced to the lowest technically achievable level and the work carried out only in a controlled way28). The establishment of a controlled zone is not required for works that are carried out in the short term, that is less than 4 hours per shift. Furthermore, the establishment of a controlled zone is not required for outdoor work in the case of exposure to emission exhaust gases from diesel engines or the use of petroleum hydrocarbons when petroleum hydrocarbons are used to power combustion engines.

3. In Article 21 (6) (j), the words "the scope of preventive care racing 'are replaced by the words" occupational medical services provided to the extent provided by the occupational health service provider'.
4. Paragraph 25 (9) reads as follows:
"(9) For risk factors, which are physical loads or working positions, the employer may include work in the second category on the basis of an expert evaluation carried out by the holder of the authorisation to investigate in the field of labour physiology under Section 83a (1) (i) of the Act on Public Health Protection (9). The professional evaluation shall include data on the nature of the work, the place of work, the time of work, the exchange rate, information on the handled material, the mode of work and rest during the work, the tools used, the sex of the employees and their rotation at individual posts and the photo documentation relating to the work environment, if any. The first sentence shall not apply if the exclusion of work from risk work for risk factors is a physical burden or a working position. If there is an occupational disease or a threat to occupational diseases in the workplace for a risk factor, the employer shall, within a period of 6 months from the date of recognition of an occupational disease or an occupational disease threat, measure that risk factor under the Public Health Protection Act (9). The measurement and evaluation of the local muscle load shall be as set out in Annex 5, Part B, to this Regulation. ';

Explanatory notes to the table:
PEL - permissible exposure limit.
NPK-P - maximum permissible concentration.
CAS number - Registration number used in Chemical Abstracts Service.
(1) - When selecting an appropriate exposure control method, account should be taken of possible restrictions and interferences that may occur in the presence of other sulphur compounds.
(2) - The fog is defined as the thoracal fraction.
(3) - Consideration is given to physicochemical properties (e.g. explosive).
(4) - For the evaluation of exposure to lead, the result of the examination of plumbemia is decisive.
(5) - The control of exposure to mercury and inorganic compounds of bivalent mercury shall take into account relevant biological exposure tests which complement the indicative occupational exposure limit values.
(6) - Short-term exposure limit in relation to the reference period.
Explanatory notes to the column "Remarks' in the table:
B - a BET is introduced in urine or blood.
D - Skin penetration is significantly applied to exposure.
I - irritates the mucous membranes (eyes, airways) or skin.
K - carcinogen category 1A and 1B (with H350, H350i).
M - germ cell mutagen of categories 1A and 1B (H340).
P - Serious late effects (with H372, H373) cannot be excluded for a substance.
R - respiratory fraction of aerosol.
S-substance has a sensitising effect (with H317, H334).
T - toxic for reproduction categories 1A and 1B (with H360 including relevant codes).
V - inhalable fraction of aerosol.
Explanatory note to the column "Conversion to ppm 'in the table:
The conversion from mass concentration data in mg.m-3 to volume concentration in ppm (parts per million - number of volume units of gas per million volume units of air) shall be subject to a temperature of 20 ° C and a pressure of 101,3 kPa.
Operating processes at risk of chemical carcinogenicity:
1. production of auramine;
2. works associated with exposure to polycyclic aromatic hydrocarbons present in coal soot, tar or pitch;
3. works related to exposure to dust, smoke or liquid aerosols resulting from roasting or electrolytic refining of cuprokol ores;
4. strong acid processes in the production of isopropanol;
5. work associated with exposure to hard wood dust, where the permitted limits are exceeded;
6. work involving exposure to respiratory dust of crystalline silica arising during the working process,
7. working or processing of articles or mixtures containing asbestos, provided that in such works exposure to asbestos exceeds 0,1 respirable fibre / cm3;
8. works involving exposure to mineral oils previously used in combustion engines to lubricate and cool moving parts in the engine by means of skin absorption,
9. Work involving exposure to exhaust gas emissions from diesel engines;
10. work with cytostatics, production and some work in particular with immunosuppressants, antibiotics or hormones, if they are classified as third or fourth, assessed as hazardous in terms of possible late health effects under the Public Health Protection Act,
11. coke oven or coke-chemical treatment of coal or coal tar or pitch, high pressure or low pressure coal gasification, including intermediate products, processing of primary intermediate products or by-products, such as cooling or cleaning of raw gas, processing of phenolic waters, brown coal tar or by-products. ';
6. In Annex 2 to this Regulation, Part A, row 290 of the table reads:

7. In Annex No 2 to this Regulation Part A, the following row 531 of the table is added:

8. In Annex No 2 to this Regulation, Part A, the following explanatory note 7 is added to the table:
"(7) - Measured as an elementary carbon. '
10. In Annex 3 to this Regulation, Part A, including the title, reads as follows:

„ČÁST A

Dust lists and their permissible exposure limits
1. The permissible exposure limit for total dust concentration (inhalable fraction) is known as PELc and for the respirable dust fraction PELr. Inflatable dust fraction means a set of particles of floating dust that can be inhaled by the nose or mouth. Respiratory fraction means the mass fractions of inhaled particles which penetrate into the part of the airway where there is no mascara epithelium and into the larvae according to Czech technical standard ČSN EN 1540 Exposure to the workplace - Terminology.
2. The permissible exposure limit of the dust mixture (PELs) with the different permitted exposure limits shall be determined by calculating the permissible exposure limit of each dust according to the formula:
PELs =% x1100 × PEL1 +% x2100 × PEL2 +....... +% xn100 × PELn-1
where
PELs is a PEL mixture,
PEL1 to PELn is the exposure limit of the individual substances 1 to n,
% x1 to% xn is the weight of each substance from 1 to n as a percentage.
3. If the weight of the individual components in flydust cannot be reliably determined, the permissible exposure limit shall be determined according to the value applicable to the substance with the lowest permissible exposure limit.
In the event that the weight of the individual components in flydust cannot be reliably determined, PELs shall be determined according to the value applicable to the substance with the lowest permissible exposure limit.
4. If the powder contains a fibrogenic component, its respirable fraction and the concentration of the fibrogenic component shall always be determined. If the respiratory fraction contains more than 1% of the fibrogenic component, its PELr must not exceed the values given in Table 1. The permissible exposure limit shall be considered as complying with both PELr for the fibrogenic component and PELc for the dust type.
5. If dust contains less than 1% crystalline SiO2 and does not contain asbestos, it shall be considered as dust having a predominantly non-specific effect.
6. For dust having a predominantly non-specific effect PELc = 10 mg.m-3
7. The permissible exposure limit shall not take into account the potential sensitising effects and potential content of micro-organisms in dust.

Explanatory notes to Table 1:
(a) dust containing more than 1% of the fibrogenic component shall be regarded as fibrogenic.
b) Fr is the content of the fibrogenic component in the respiratory fraction as a percentage. The fibrogenic component is quartz, Kristobalite, tridymite or gamma-aluminium oxide.
(c) The lower permissible exposure limit shall be determined in accordance with specific legislation.
(d) In the presence of a numerical concentration of respiratory fibres (so-called WHO fibres with a length of more than 5 μm, a diameter of less than 3 μm and a ratio of length to diameter of more than 3: 1) in the working air, the permissible exposure limit for asbestos must be complied with.
(e) For a chemical, carcinogenic effects cannot be excluded.

Explanatory note to Table 3
(a) Where iron alloys contain a higher proportion of metals for which they are set by the permissible exposure limit, dust shall be assessed even according to the permissible exposure limit of these metals. A condition whereby both the PELc for iron alloy and the permissible exposure limit for individual metals are respected shall be considered to comply with the permissible exposure limit, the lowest exposure limit being the limit. Alloys of non-ferrous metals shall be assessed in terms of dust according to the permissible exposure limit of the individual metals present in the alloy, the component of which is the lowest exposure limit being decisive.

Explanatory note to Table 5:

Čl. II
Efficacy
This Regulation shall enter into force on the first day of the calendar month following its publication, with the exception of:
(a) Article I (6), which shall take effect on 18 January 2025;
(b) Article I (7) and (8), which shall take effect on 21 February 2023;
(c) Article I (9), which shall take effect on 21 February 2026;
(d) Article I (11), which shall take effect on 17 January 2025; and
(e) Article I (12), which shall take effect on 18 January 2023.
