Ministry of the Environment of the Czech Republic
of 23 December 1991
defining areas requiring specific air protection and laying down the principles for the creation and operation of smog control systems and certain other measures for air protection
The Ministry of the Environment of the Czech Republic provides pursuant to § 12 (b) and (f) of the Act of the Czech National Council No. 389 / 1991 Coll., on the State Administration of Air Protection and Charges for Pollution (hereinafter "the Act"):
Areas requiring specific air protection
The areas requiring specific air protection shall be:
(a) national parks, 1)
(b) protected landscape areas, 1)
(c) spa places, 2)
(d) urban pollution control zones [Paragraph 5 (2) (a) of the Act];
(e) the territory of the cities and districts listed in Annex 1.
Specific measures to limit air pollution
In areas requiring specific air protection, the air protection authorities shall implement specific measures to limit air pollution by tightening the conditions of air protection in the agreements issued pursuant to Article 3 (2) (a) of the Act, in particular as regards the provision of technical conditions for the regulation of sources of pollution, depending on the IMIC concentration of pollutants in the territory.
Smog control systems
Smog control system is a phased set of time-limited regulation measures
(a) the sources of pollution selected by their operators [§ 2 (c) of the Act] listed in Annex 2;
(b) other sources of pollution which contribute decisively to air pollution; This regulation shall be decided by the authorities of the municipalities or district authorities.
Principles for the creation of smog control systems and special imitation limits
(1) The smog regulatory system is based on:
(a) information files
1. the location and parameters of sources of pollution,
2. on air pollution derived from automated measuring network data;
3. on a state of dispersion conditions,
(b) forecasts of the dispersion conditions;
(c) warning and regulation signals.
(2) The management centre of the smog regulatory system is an organisation entrusted with the Ministry of the Environment of the Czech Republic (hereinafter referred to as "the entrusted organisation '). The organisation shall ensure the central acquisition, processing and issuance of the information, forecasts and signals referred to in paragraph 1.
(3) The mandated organisation shall declare the signals referred to in paragraph 1 (c) if, as a result of the adverse dispersion conditions, the specific imhis limits (4) set out for the notification of the relevant warning signal, the first regulatory stage and the second regulatory stage referred to in Annex 3 have been exceeded and this situation has been predicted for at least eight hours.
(4) The designated organisation shall withdraw the signals referred to in paragraph 1 (c) if, for a period of at least 12 hours, the specific limit of imitation is no longer exceeded and if, on the basis of a meteorological forecast, the deterioration of the dispersion conditions is not expected within 48 hours of a decrease in concentrations not exceeding the values of the specific limit of imitation. In the case of detected and predicted favourable dispersion conditions, that period may be reduced to up to 3 hours.
(5) Binding texts for the announcement and withdrawal of the signals referred to in paragraph 1 (b) (c) are listed in Annex 4.
(1) In the areas referred to in Article 1 (e), in the territory of the cities and in the territory of the districts listed in Part B of Annex 1, an authorised organisation shall establish and operate an automated measuring network for the continuous measurement of the particulate concentrations of pollutants in the air. It shall also use the results of the measurements carried out by the sanitary service or other organisations, as appropriate.
(2) The location of the measuring stations, instrumentation and measurement and control procedures shall be carried out in the public interest and in accordance with specific rules in order to ensure the representativeness and reliability of the measured data, including at the places of accommodation. The location of the measuring stations shall be discussed by the designated organisation with the competent authorities of the sanitary service.
(3) The reliability of the data referred to in paragraphs 1 and 2 shall be verified by the designated organisation.
Meteorological data
For the areas referred to in Article 1 (e), the designated organisation shall provide the state and forecast of the diffusion situation on the basis of meteorological elements that are conducive to the diffusion of pollutants in the air.
Principles of operation of smog control systems
Operating Regulations for smog control systems
(1) The operating rules of the smog control system for the regulation of selected sources of pollution are issued by the designated organisation and the operating rules of the smog control system for the regulation of other sources of pollution are issued by the authorities of the municipality and, where appropriate, by the district authorities. 3) The operating rules of the smog regulatory system shall be issued by the public air protection authorities after consultation with the health service authorities.
(2) Operating Regulations always contain:
(a) definition of smog control system signals;
(b) criteria for assessing the excess of the special imitation limit, taking into account the meteorological situation;
(c) the phasing out of alert and regulatory measures, the criteria for their notification and termination;
(d) arrangements for the transmission of information on the announcement and withdrawal of alert regulatory measures, including approved texts and the definition of a timetable;
(e) a list of resources to be regulated under the smog regulatory system.
(3) The authorities of the State Air Protection Administration shall inform the operating rules after they have been issued by the source operator listed in paragraph 2 (e).
Control Regulations for Pollution Sources
Operators of large and medium-sized pollution sources shall draw up regulatory regulations, 5) governing the regulation of emissions after the publication of alert and regulatory measures. Regulations shall contain:
(a) a list of measures to limit emissions from the source of pollution;
(b) the timetable for the application of the measures referred to in point (a) in relation to the start of validity of each stage of alert and regulatory action;
(c) the number of persons responsible for implementing the measures provided for in (a) and (b);
(d) the range of emission control.
Operation of smog control systems
(1) The entrusted organisation shall draw up a forecast of the dispersion conditions, evaluate the imitation situation and process the data found and provide free of charge to source operators, municipal authorities, district authorities, sanitary services and Czech environmental inspection.
(2) If the designated organisation finds that the conditions for the notification or withdrawal of signals of warning or regulation have occurred in the areas referred to in § 1 (e), it shall immediately give the relevant signal in accordance with § 4 (1) (c) for:
(a) operators of selected sources of pollution;
(b) district authorities and through them for the authorities of the municipalities;
(c) health services bodies;
d) Czech environmental inspection,
e) Czechoslovak Energy Dispatch.
(3) By type of signal declared in accordance with paragraph 2
(a) operators of selected sources of pollution in the areas referred to in Section 1 (e) of this Decree are required to implement emission reduction measures in accordance with the regulatory rules;
(b) the authorities of the municipalities and the district authorities shall inform the source operators referred to in Article 3 (b) and the population of the deterioration of air quality, the announcement and withdrawal of warning and regulation signals and the related measures.
Final provision
This decree shall take effect on the day of its publication.
