Directive of the Ministry of Education and Culture and of the Ministry of Agriculture and Forestry on the assistance of pupils in the second cycle (including apprentices) in top agricultural work

on the assistance of school pupils in the second cycle (including apprentices) in top agricultural work
An integral part of the ideal educational work of schools is the combination of the educational work of the school with the life of society. Adequate participation of school pupils in socially useful work is one of the important forms of this connection, an effective means of getting young people directly acquainted with the production process and of teaching it to appreciate the physical work correctly. This activity, in particular participation in top agricultural work, also has a significant social mission, as it contributes to the fulfilment of serious economic challenges. However, it will only benefit the company if its content and scope are fully in line with the educational objectives of schools and the assumptions of individual pupils and apprentices, and when it is properly organised and professionally managed.
The Ministry of Education and Culture, together with the Ministry of Agriculture and Forestry, with the agreement of the Central Council of Trade Unions and in agreement with the Ministry of Health and with the other central authorities involved, issue the following directives for the organisation of school assistance in top agricultural work (including apprentices):
Čl. 1
Teachers of the second cycle - including apprenticeships - (hereinafter referred to as "pupils') help in top agricultural work on a voluntary basis at a time outside the teaching period and at a teaching period (also at the training period).
Voluntary assistance in non-teaching periods
Čl. 2
(1) Voluntary assistance for pupils outside the teaching period or outside the working period, in particular during the main holidays or leave for recovery, is organised by schools, vocational training centres and apprenticeship centres (hereinafter referred to as "schools and apprenticeships") in cooperation with the basic organisation of the Czechoslovak Youth Union and the association of parents and friends of the school.
(2) In the same way, schools and apprenticeships organise the assistance of pupils in the hops harvest. Such assistance may continue after the beginning of the teaching period until the end of the harvest; In this case, the absence of pupils in teaching or training shall be excused. In the same school year, pupils who participated in hop harvesting assistance will no longer participate in any further assistance organised at the time of teaching.
Aid at the time of teaching
Čl. 3
(1) At the time of teaching, pupils shall assist in top agricultural work for a maximum of 6 teaching days (apprentices including training days) in one school year. This assistance is not attended by pupils who, according to the medical certificate, are prevented from participating in the assistance of their medical condition and by those who are preparing for the final or final apprenticeship examinations.
(2) School heads and heads of apprenticeships shall, by 30 April at the latest, notify the Department of Labour of the District National Committee, in the district of which the school or apprenticeship is situated, the number of pupils who may attend assistance in the next school year at the time of teaching to the extent specified by these Directives.
(3) The Department of Labour of the District National Committee, after consulting the production farm administration, will communicate to the agricultural organisations with which schools and apprenticeships may negotiate a framework contract on assistance.
(4) The assistance at the time of teaching will normally be attended by all classes at the same time.
(5) In very rare cases where the consent of the competent authorities is given to exceptional measures involving all the population and when all measures to ensure the work of the other population have been exhausted, the Department of Education and Culture of the Regional National Committee may, after prior approval by the Ministry of Education and Culture, authorise the extension of assistance over 6 teaching days.
(6) The chairmen of the relevant regional national committees shall agree on any assistance of pupils in the territory of another region.
Common provisions
Čl. 4
A framework contract shall be concluded between the agricultural organisation and the school or apprenticeship establishment on the assistance referred to in Articles 2 and 3, containing in particular the following information:
(a) the work to be carried out by pupils and the place of work;
(b) the time span of the assistance;
(c) working conditions (length of daily working hours, ensuring safety and hygiene conditions, catering, accommodation, equipment hire, tool hire, etc.),
(d) the security of the transport of pupils to and from the agricultural establishment in accordance with the applicable public transport rules and the method of reimbursement of transport costs;
(e) the manner and maturity of remuneration for work and other costs associated with assistance;
(f) the obligation of the farm plant to instruct both the head of the assistance and the pupils and to ensure professional management;
(g) the authority of the school director or the head of the apprenticeship establishment to withdraw assistance if the agricultural organisation fails to comply with the agreed conditions (Article 6 (3)).
Čl. 5
(1) Before taking up the assistance provided for in Articles 2 and 3, pupils shall undergo a medical examination.
(2) The working hours of pupils under 16 years of age shall not be more than 6 hours per day and 36 hours per week. Pupils under 16 years of age cannot be assigned to work in the task or used in the remuneration of their task wages. Teachers who have not reached the age of 18 are not allowed to work overtime.
(3) Pupils participating in assistance, if over 16 years of age, are remunerated according to the wage rules applicable to public goods workers, including in the case of assistance in single agricultural cooperatives. Pupils under the age of 16 are entitled to a remuneration equal to the time wage laid down in the guidelines of the Ministry of Agriculture and Forestry for the remuneration of pupils, apprentices and youth workers in top agricultural work. A premium may be awarded for the quality and timely performance of seasonal work or exceptional remuneration. *) The agricultural organisation shall send the total amount of remuneration to the school or apprenticeship. The apprentice shall be paid only if he is higher than his average earnings in the organisation which carries out his education; otherwise he shall have compensation equivalent to this average earnings. *)
(4) The agricultural organisation provides pupils and teachers free of charge accommodation in hygienically compliant hostels and full-time meals of CZK 13,40 according to retail food prices. The participants will pay 4, - Kčs daily for the entire diet provided.
(5) The agricultural organisation will pay the school or apprenticeship fees for pedagogical supervision and the costs of transporting pupils and pedagogical heads to and from the farm, except for interregional and interregional assistance, where transport costs are paid under the separate directives. * *)
Čl. 6
(1) For the duration of the assistance provided for in Article 2 and Article 3, the school director or the head of the apprenticeship establishment shall establish educational supervision in such a way that for each of the 25 pupils 1 educator (teacher, educator or master of vocational training) is responsible and shall instruct the authorised staff on their duties. As a rule, they don't approve teachers of graduating years.
(2) Teaching staff shall, prior to taking up assistance, inform pupils of their rights, responsibilities and hygiene rules and of the rules to ensure safety and health at work; in the course of the assistance, they shall take care of work morale, monitor compliance with health and safety regulations and, in particular, ensure that pupils do not carry out the work prohibited by them. If this is not detrimental to the performance of these duties, they help pupils in their work. If they detect defects in working conditions, they shall request the removal of the worker responsible for the agricultural organisation. If the defects are not remedied immediately, they shall inform the school director or the head of the apprenticeship and the district hygienist responsible for the place of work.
(3) The head of the school or the head of the apprenticeship establishment shall give his consent to the admission of pupils to the relief provided for in Article 2 and 3 only if, together with the representative of the basic organisation of the Czechoslovak Youth Union and the representative of the parents' and friends' associations of the school, he has previously convinced himself that all the provisions of the framework employment agreement on assistance are met and that the district hygienist responsible for the establishment of the agricultural plant has no objections. The head of the school, or the head of the apprenticeship, shall withdraw assistance in the event that the agricultural organisation does not comply with the provisions of the contract and does not remedy the defects, although it has been called upon by a staff member responsible for pedagogical supervision.
