DECLARATION
of 5 December 2022
on the rules for the calculation of the minimum premium payment limit for liability insurance caused by the management of a qualified electronic identification system
The Ministry of Interior provides pursuant to § 9 paragraph 1 of Act No. 250 / 2017 Coll., on Electronic Identification, as amended by Act No. 12 / 2020 Coll.:
Rules for the calculation of the minimum premium payment limit
(1) The minimum premium payment limit per calendar year for liability insurance for damage caused by the management of a qualified electronic identification system (hereinafter referred to as the "minimum premium payment limit") is calculated on the basis for calculating the minimum premium payment limit of CZK 25 000 000 (hereinafter referred to as the "calculation basis").
(2) Minimum insurance performance limit for issuing electronic identification devices with a guarantee level low for the number of holders up to
(a) 100 000 is equal to the basis for calculation;
b) 500,000 is equal to twice the basis for the calculation.
(3) Minimum insurance performance limit when issuing an electronic identification device with a guarantee level significant for the number of holders to:
(a) 100 000 is equal to twice the basis for calculation;
b) 500,000 is equal to three times the basis for calculation.
(4) Minimum insurance performance limit for issuing electronic identification devices with a guarantee level high for the number of holders up to
a) 100,000 is equal to three times the basis for calculating;
b) 500,000 is equal to four times the basis for the calculation.
(5) For each additional increase in the number of holders by a maximum of 500 000 compared to the maximum number of holders referred to in paragraph 2 (b), paragraph 3 (b) or paragraph 4 (b), the minimum premium rate shall be increased by the basis for calculation.
(6) When issuing funds for the electronic identification of different levels of guarantee, the minimum insurance performance limit shall be equal to the maximum amount calculated in accordance with paragraphs 2 to 5.
Transitional provision
The accredited person shall indicate the level of the premium payment limit for his / her liability insurance caused by the management of the qualifying electronic identification system in accordance with the minimum premium performance limit within 6 months of the date of entry into force of this Decree.
Efficacy
This Decree shall take effect on 1 January 2023.
