of 10 November 2009
on the formalities and breakdown of regulatory reports, including their models and rules for drawing up regulatory reports
Pursuant to Section 98a (2) (e) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of Government Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll.:
Breakdown and formalities of regulatory reports
(1) Regulatory reports are broken down into reports
(a) assets and changes in assets;
(b) a summary of investment actions;
(c) assets and liabilities;
(d) the results of the management,
(e) costs,
(f) investment expenditure;
(g) balance sheet;
(h) technical;
(i) tariff statistics;
(j) operationally technical;
(k) technical and calculation patterns for the price of heat energy;
(l) auxiliary.
(2) The list of regulatory reports is set out in Annex 1 to this Decree.
(3) The regulatory statements for each licensed activity are indicated by the following number:
(a) number 12 - electricity distribution; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 2 to this Decree,
(b) No 13 - electricity transmission; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 3 to this Decree,
(c) number 22 - gas distribution; the details and breakdowns of the regulatory reports, including their models and rules of compilation, are set out in Annex 4 to this Decree,
(d) number 23 - transport of gas; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 5 to this Decree,
(e) number 25 - gas storage; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 6 to this Decree,
(f) number 31 - heat generation; the details and breakdowns of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 7 to this Decree,
(g) number 32 - thermal energy distribution; the details and breakdown of the regulatory reports, including their models and the rules for drawing up them, are set out in Annex 7 to this Decree.
(4) The licence holder submits an annex to the regulatory reports within the scope of Annex 8 to this Regulation.
(5) Regulatory reports are to be processed for the previous calendar year "i - 2" or, where appropriate, for the part of the calendar year. Regulatory reports shall also be processed as a plan for regulated years "i - 1" to "i + 3" with the exception of licence holders of numbers 25, 31 and 32.
Rules for drawing up regulatory reports
(1) The presentation of the regulatory reports shall be carried out by the licence holder on:
(a) electricity transmission for electricity transmission, trade in system and support services, auctions on cross-border profiles (hereinafter referred to as "auctions"), participation in the compensation mechanism between transmission system operators and, where appropriate, other activities under the licence and other activities not carried out under the electricity transfer licence under the Energy Act;
(b) distribution of electricity for distribution of electricity and other activities which are not carried out on the basis of a power distribution licence under the Energy Act;
(c) the transport of gas for the transport of gas under the transit system, the transport of gas under the national system and other activities not carried out under a gas licence under the Energy Act;
(d) the distribution of gas for gas distribution and other activities which are not carried out under a gas distribution licence under the Energy Act;
(e) storage of gas for gas storage and other activities which are not carried out under a gas storage licence under the Energy Act;
(f) the production of heat energy or the distribution of heat energy for the activity of the production and distribution of heat energy.
(2) The licence holder shall draw up the regulatory reports separately for each of the licensed activities, except for licence holders of numbers 31 and 32.
Assets and changes in assets
(1) The accounts of assets and changes in assets shall show the property of the licence holder, the actual assets activated, the actual depreciation and the disposal of the assets, the plans of the assets activated, the depreciation, the disposals and the outstanding amounts of the assets. The property of the licence holder number 12 shall be reported according to the voltage levels and the property of the licence holder number 22 by type of network in such a way as to objectively express the actual use of the property for the voltage level or type of network.
(2) Assets and changes in assets are identified as A.
(3) Operating assets for the purposes of this Order are the long-term assets necessary to ensure the relevant licensed activity, reduced by:
(a) outstanding fixed assets;
(b) goodwill under the Income Tax Act (1),
(c) advances granted on long-term intangible assets;
(d) outstanding fixed assets;
(e) advances granted on fixed assets;
(f) asset items;
(g) the valuation difference for the assets acquired;
(h) long-term financial assets.
(4) In addition, operating assets are increased by the value of articles purchased in the form of financial leasing. The classification of the value of an article acquired in the form of financial leasing must be carried out in accordance with International Accounting Standards according to the directly applicable European Communities2).
(5) Assets and changes in assets are reported
(a) at the carrying amount of the asset and the asset,
(b) at the carrying amount of the asset and the asset disposed of;
(c) accounting depreciation.
Statement of total investment actions
(1) The total of investment actions shall be reported in the reporting year.
(2) The total of investment actions is identified by letters IA.
Assets and liabilities accounts
(1) Statements of assets and liabilities include data on assets and other assets, liabilities and other liabilities under the Accounting Act. The holder of a licence number 31 or 32 shall draw up a declaration separately for the licensed activities of the production of heat energy or the distribution of heat energy and the activity of the production and distribution of heat energy, which is not carried out on the basis of a licence under the Energy Act (hereinafter referred to as "the unlicensed activity of the production and distribution of heat energy ') and, in aggregate, for all the activities of the licence holder.
(2) Assets and liabilities statements are identified by the letters AP.
(3) Assets and liabilities statements contain the operational assets necessary to hedge the activities referred to in paragraph 1, which are reported mutatis mutandis as operating assets pursuant to Article 3 (3) and (5).
Economic results reports
(1) The results of the management report shall include the proceeds and costs of the licence holder for each activity referred to in Article 1 (3).
(2) Indirectly attributable revenues and costs for the exercise of the activity of the parallel licence holder for the distribution of electricity and gas licences shall be broken down on the basis of the ratio of directly attributable costs of the licensed activities of the distribution of electricity and gas from the year preceding the reporting period.
(3) The farm results are identified by the letters HV.
(4) For the purposes of this decree, the proceeds of the licence holder shall be the proceeds of the licensed activity and the other proceeds of the licensed activity under the Accounting Act.
(5) The authorised costs of holders of licences of numbers 12, 13, 22, 23 and 25 are, for the purposes of this Decree, the costs of securing the licensed activity charged under another legislature3) after deduction of the unauthorised costs.
(6) Unauthorised costs for holders of licences of numbers 12, 13, 22, 23 and 25 are, for the purposes of this Decree, costs which cannot be recognised as expenses (costs) to achieve, secure and maintain income under the Income Tax Act, financial costs, extraordinary costs, differentiated instalments of financial leasing, income tax, reserve creation and consumption costs, residual value of fixed assets and material disposed of as a result of sale, donation, mank and damage.
Cost statements
(1) The cost statements contain the permitted costs of carrying out the licensed activities, broken down by type of activities and types of technology for electricity transmission, by voltage levels and types of technology for electricity distribution, by type of transport for gas transport, by type of network and technology for gas distribution.
(2) Indirectly attributable costs for the exercise of the activity of the parallel licence holder for the distribution of electricity and gas licences shall be broken down on the basis of the ratio of the directly attributable costs of the licensed activities of the distribution of electricity and gas from the year preceding the reporting period.
(3) The cost statements are identified as N.
Statement of investment expenditure
(1) Expenditure relating to the acquisition of operating assets to cover the licensed activity shall be considered as investment expenditure.
(2) Actual investment expenditure and related technical data as well as planned investment expenditure of the licence holder shall be reported in the investment expenditure statements. Investment expenditure shall be broken down into recovery and development in the reporting year and in the following 2 years.
(3) The statement of investment expenditure shall be indicated in point I.
Balance sheet reports
(1) The balance sheets shall show the energy balance, broken down into part of the resources and part of the consumption for the part of the electricity system for which a decision to grant a licence number 12 or 13 has been issued. In addition, balance sheets shall include maximum power at the interface of different parts of the electricity system operated by different licence holders.
(2) In the balance sheets, the licence holder number 22 shows the balance of the quantity of gas entering the distribution system broken down by type of network.
(3) The balance sheets are marked with the letter B.
Technical reports
(1) In the technical statements, the holder of a licence No 12 or 13 shall report:
(a) data related to resource supportunder other legislation3);
(b) data on support and system services related to ensuring the stability of the operation of the electricity system.
(2) In the technical statements, the licence holder of headings 22 and 23 shall report:
(a) the number of individual types of measuring equipment by sampling zone and the cost of measuring by type of measuring equipment;
(b) the cost of subtracting measuring equipment according to periodicity and the number of subtracted measuring equipment in each sampling band according to periodicity of reading;
(c) data on daily reserved fixed capacity at transmission system entry and exit points;
(d) data on the use of the flexibility service for balancing the transmission system;
(e) data for the determination of the price for the transport and distribution of gas.
(3) The technical statements are indicated under D.
Tariff statistics reports
(1) In the tariff statistics reports, the licence holder No 12 shall report:
(a) for the collection of voltage levels of very high voltage and high voltage, data on the reservation of customer capacity and consumption of electricity, including the sales of the licence holder for the licensed activity;
(b) for low voltage voltage voltage voltage consumption data on the reserved power consumption and consumption of customers' electricity, including the licensee's sales for the licensed activity.
(2) In the tariff statistics reports, the holder of licence number 22 shall report data on:
(a) the quantity of gas distributed by sampling zones;
(b) the daily maximum and the number of sampling points per sampling zone;
(c) the level of sales at a fixed and variable component of the distribution price, including the price of domestic transport by sampling zone;
(d) the level of revenues for services provided by the market operator;
(e) purchase of distribution by regional distribution companies from other regional distribution companies;
(f) the quantity of gas entering the distribution system from gas production and abroad by cross-border pipelines, including daily maximum.
(3) The statements of tariff statistics are marked T.
Operational technical reports
(1) In the technical records, the licence holder of numbers 12 and 13 shall report data on the operation of individual parts of the electricity system.
(2) The following data categories shall be reported in the operational technical statements:
(a) data on individual installations, operational events and evaluation of the operation of the electricity system;
(b) data for the compilation of the electricity balance of the electricity system;
(c) data for the compilation of the performance balance.
(3) The operationally technical statements are identified by ERO letters.
Technical statement and calculation formula of heat energy price
(1) The technical report and the calculation formula for the heat energy price are completed by the licence holder number 31 or 32. The data for the relevant licensed activity and for the unlicensed activity shall be provided by the licence holder separately for each price location.
(2) The following data categories shall be reported in the technical statement and calculation formula of the heat energy price:
(a) the production balance;
(b) the balance of the divorce;
(c) an overview of the sources at the price location;
(d) details of the home boilers;
(e) the resulting calculation of the heat energy price;
(f) fuel consumption;
(g) the number of customers and the sampling points;
(h) the purchase of heat energy from other suppliers.
(3) Economically justified costs, intra-company revenues and revenues, the holder of the licence shall, cumulatively for the licensed activity, conduct the production of heat energy and the distribution of heat energy and for the unlicensed activity, the production and distribution of heat energy.
(4) The technical statement and the calculation formula for the heat energy price are referred to as DK.
Method of submission of regulatory reports
(1) The licence holder shall submit the regulatory statements at the dates set out in Annex 1 to this Regulation.
(2) The form and presentation of the regulatory reports are set out in Annex 1 to this Regulation.
(3) The licence holder who does not keep full accounts under the Accounting Act does not submit the regulatory statements referred to in paragraph 1, except for the licence holder number 31 or 32.
Repeal
Decree No 404 / 2005 Coll., on the formalities and breakdown of regulatory reports, including their models and rules for drawing up regulatory reports, is repealed.
Efficacy
This Decree shall take effect on 1 December 2009.

Where the licence holder sends the regulatory statements electronically signed by the guaranteed electronic signature, the regulatory reports need no longer be sent in writing by the licence holder or by the person authorised to act as the licence holder. This option does not apply to the sending of regulatory reports ERÚ 1-12, ERÚ 2-01, MZ 1-12 and the statement Supporting the development of EC networks.

1. Statement 12A: Statement of assets and changes in assets
The statement shall show the values of:
► assets (acquisition and outstanding amounts), actual assets activated, depreciation and disposal,
► Activated property plans, depreciation plans and discarded property.
1.1. Characteristics of the report columns
■ Cost of assets - these are the values recorded in the accounts of the licence holder.
■ Balance sheet value of assets - these are the values recorded in the accounts of the licence holder.
■ Activated property is the aggregate value of assets activated for both renewal and development.
■ Deductions - recognised both from current and newly activated assets.
■ Excluded assets - outstanding amounts of assets disposed of because of sale, donation, mank and damage. Decommissioned property plans shall be completed by the holder of the licence, who shall count on the disposal of the assets in his plans.
1.2. Characteristics of the statement lines

It is a 110 kV power distribution device operated by an outside management owned by the licence holder.
The border is defined from the anchor insulator chain on the portal of the station 110 kV to the anchor insulator curtain of the opposite station 110 kV, or after the anchor curtain of the border mast.
The main items include in particular:
► pylons with accessories - insulator fittings, carrier, anchor and protective fittings,
► Basis of mast,
► Grounding of mast,
► ropes - phase conductors and ground ropes including combined ground ropes.
Cable lines - Sv8
It is a 110 kV power distribution device operated by a cable line owned by the licence holder.
The border is defined by the starting point of the cable terminal 110 kV and the end point of the cable terminal 110 kV.
The main items include in particular:
► 110 kV cables including terminals, couplings, supporting structures, ground lines and connections in the ground,
► Cable tunnels and cable beds,
► Auxiliary holdings.
