DECLARATION
of 6 November 2008
amending Decree No. 488 / 2006 Coll., determining the types of duplicating apparatus, the types of unrecorded means of recording and the amount of standard remuneration
The Ministry of Culture provides pursuant to § 25 (7) of Act No. 121 / 2000 Coll., on Copyright Law, on Rights Related to Copyright Law and on the Amendment of Certain Laws (Copyright Act), as amended by Act No. 216 / 2006 Coll.:
Decree No. 488 / 2006 Coll., determining the types of multiplication apparatus, the types of unrecorded record carriers and the amount of standard remuneration, shall be amended as follows:
1. In Article 5 (1) (c), the words "and other non-rewriting optical media 'shall be inserted after the words" rewriting'.
2. in Article 5 (1) (d), the words "and other transportable optical media" shall be inserted after the words "rewriting."
3. In Section 5, paragraph 2, the words "6 CZK for every 512 MB of capacity started 'are replaced by the words" 1.50 CZK for every 1 GB of capacity started, but not more than 90 CZK'.
4. In Article 5 (3), the words "CZK 10 for each 40 GB of capacity started 'are replaced by the words" CZK 0,15 for each 1 GB of capacity started, if the capacity of the hard disk does not exceed the capacity not built into the 1 TB personal computer', and at the end of paragraph 3, the sentence "beyond the capacity of the hard disk not built into the 1 TB personal computer is added, the reward of CZK 150 is payable and CZK 0,10 for each 1 GB of capacity exceeding the capacity of 1 TB of this hard disk. '.
5. in Article 6 (1), the word "analogue" shall be inserted at the beginning of point (a).
6. in Article 6 (1) (c) and (d), the words "and memory cards" shall be inserted after the words "media."
7. in Paragraph 6 (1) (e), the words "or memory card" are replaced by the words "memory card or optical carrier."
8. In Paragraph 6 (2), the word "mobile 'is replaced by the words" digital cameras, digital cameras, mobile phones and wireless devices' and the sentence "If these devices are supplied with a storage medium, the remuneration shall be paid only from the capacity of the enclosed medium in accordance with Section 5 (2). ';
This Decree shall take effect on 1 January 2009.
