GOVERNMENT REGULATION
of 26 October 2009
on the demarcation of the birds' zone Tar
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
§ 1
Subject matter
(1) The birds' area of tar (hereinafter referred to as the bird's area) is defined.
(2) The protection of the birds' area is the stock of fish fish (Sterna hirundo) and geese (Anser anser) and their biotopes.
(3) The conservation of the species referred to in paragraph 2 is intended to preserve and restore ecosystems relevant to the species of those birds in their natural area of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
§ 2
Definition of bird area
(1) The bird region is situated in the territory of the South Bohemia Region in the cadastral territories of Čakov near České Budějovice, Tětář near České Budějovice, Radošovice near České Budějovice, Záborí near České Budějovice and Žabovřisky near České Budějovice.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 10 000 scale map documents, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the South Bohemia Region and the municipal authorities of the municipalities with extended scope in whose administrative district the bird area is located.
§ 3
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) can the birds' area
(a) establish new hunting and recreational facilities;
(b) in the period of the first year of the two-year marketing cycle from 1 April to 31 July, in the period of the second year of the two-year marketing cycle, in the period of the second year of the two-year marketing cycle from 1 April to 31 July, in the period of the water level above the point of the 406,40 m;
(c) in the period from 1 April to 31 July, change the water level by more than 20 cm at a level above the 40 5,45 m bar in less than 14 days;
(d) in the period from 1 August to 31 March, change the level of the water level above the point 406,40 nm for more than 30 days; or
(e) enter the colony of the bluefin tuna between 15 April and 31 July.
(2) The prior consent of the nature conservation authority to the activities referred to in paragraph 1 (b) to (d) shall not be required in the event of a flood, emergency or exceptional climate situation.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the birds' area of tar
The border of the birds' area leads south from the exit on the dam of the Těhták pond to the border of the pond parcel (plot No 781 k.ú. Tětáty near České Budějovice), where it is connected to the border of K. Ú. Tětář near České Budějovice, on which it continues in the southern and further west direction around the Holubov Bast. Near the northern tip of Poštoch pond, 300 m west of the road leading to the peninsula of the Těhták pond, the border of the birds' area passes from the K. Ú. Tar near České Budějovice to the water tower and intersects to the watercourse of the k.ú. Chakov near České Budějovice in the length of 100 m It also leads in the western, then north and finally east direction around the Těhták pond, along the fields at about 200 metres from the borders of the Czech Budejovice. 150 m northwest of the border at České Budějovice, where the tar at České Budějovice is separated from the border of the pond parcel, the border of the bird area around the southern edge of the small forest passes and leads directly east to booth 410. From this cubicle it leads directly south to the northernmost edge of the pond parcel and continues south to the edge of the pond parcel to its discharge.
