DECLARATION
of 23 December 2015
on the method of dividing the cost of the heat energy supply when measuring the quantity of heat energy collected together
The Ministry of Industry and Trade provides pursuant to § 98a (1) (g) of Act No. 458 / 2000 Coll., on the Terms of Business and the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 165 / 2012 Coll. and Act No. 131 / 2015 Coll., to implement Section 78 (5) of the Energy Act:
Subject matter
This decree provides
(a) the method of dividing the cost of the supply of heat energy in the joint measurement of the quantity of heat energy collected for more than one sampling point or, where heat energy is supplied from the sampling point, the objects or parts of the objects of different owners entering into a heat energy supply contract and no agreement has been reached on how to distribute the costs;
(b) the scope and dates of the transmission of heat energy supply data by the supplier of heat energy from specified meters under the Metrology Act or data from heating and other data necessary for the distribution of heating and hot water costs.
Definition of terms
For the purposes of this decree:
(a) the measured consumption or registration of heat energy, determined as the difference between the deducted values recorded at the end and the beginning of the accounting period on the heat energy meter in accordance with the Metrology Act or the installation for the distribution of heating costs;
(b) by comparable consumption of heat energy for heating consumption or registration of heat energy for heating by the heat energy consumer, determined by the heat energy supplier according to the last known measured consumption of individual objects or parts of objects of the heat energy consumer, taking into account the comparable climatic conditions of the period;
(c) by comparable heat energy consumption for hot water preparation, the heat energy consumption for hot water preparation for heat energy customers determined by the heat energy supplier according to the last known measured consumption of individual objects or parts of objects of the heat energy consumer determined from an average of 1 m2 of floor space in measured objects or parts of objects.
Method of dividing the heat energy supply costs
(1) The costs of heat energy for heating and heat energy consumed for the preparation of hot water and its delivery to all sampling points or to individual objects or parts of objects supplied from one sampling point are divided into essential and consumer components.
(2) The basic component of the heating heat energy costs is 40% of the total heating energy costs and the basic component of the heat energy costs consumed for hot water preparation is 30% of the total heat energy costs for hot water preparation. Those basic components shall be distributed in the case of:
(a) heating according to the countable floor area of individual objects or parts of objects under another legislation (1);
(b) hot water according to the floor area of individual objects or parts of objects according to another legislation (1).
(3) The consumption component of the heating thermal energy costs is 60% of the total heating heat energy costs and distributed
(a) in proportion to the measured consumption of the measured measures2) determining the measured value in joules, provided that these meters are installed by the heat energy customers at all individual sampling points or at all individual objects or parts of the building;
(b) in proportion to the consumption measured from the heating plant, unless the condition under (a) is met and where installations for the distribution of heating costs of the same type are installed in all individual buildings or parts of buildings, using the same registration method;
(c) according to the deductible floor area of individual objects or parts of objects under another legislation (1), if the conditions laid down in (a) or (b) are not met.
(4) The consumption component of the heat energy costs consumed for the preparation of hot water and its delivery to all sampling points or to individual objects or parts of objects supplied from one sampling point shall be 70% of the total heat energy costs consumed for the preparation of hot water and shall be distributed:
(a) in proportion to the measured consumption from water meters to hot water, if the heat energy users are installed such water meters at all individual sampling points or in all individual objects or parts of the building;
(b) in proportion to the comparable heat energy consumption for the preparation of hot water at the sampling points or in the objects or parts of the building where heat energy customers are not installed hot water water water meters and in proportion to the measured water consumption from hot water meters at the sampling points or in the objects or parts of the building where heat energy consumers are installed hot water meters.
(5) The cost of the supply of drinking water consumed for hot water preparation and its delivery to all the sampling points or to individual objects or parts of objects supplied from one sampling point, and the associated waste water removal costs, shall be divided in proportion to the measured consumption of installed hot water meters. Where hot water water meters are not installed by heat energy consumers at all individual sampling points or in all individual objects or parts of an object, the costs shall be distributed according to the sentence referred to in paragraph 4 (b).
Procedures in specific cases
(1) If the measured quantity of hot water supplied in its joint preparation is more than 15% higher than the sum of the measured consumption of all objects connected to the joint preparation of hot water, the cost of the consumption component exceeding 15% shall be broken down by floor area of the individual objects or parts of the objects according to another legal regulation (1).
(2) If the measured consumption for a particular sampling site, object or part of the objects has not been delivered to any of the heat energy customers within the time limit referred to in Section 6, the heat energy supplier shall determine this consumption as 1.3 times the comparable heat energy consumption for heating or comparable heat energy consumption for hot water preparation.
(3) Where the measured heat energy consumption for heating is not known or there has been a substantial change in the parameters of individual objects or parts of objects, the heat energy supplier shall estimate the consumption or registration of heat energy for heating taking into account comparable climatic conditions of the period.
(4) If the measured value for hot water preparation is unknown or there has been a substantial change in the parameters of individual objects or parts of objects, the heat energy supplier shall estimate the heat energy consumption consumed for hot water preparation.
Scope of data transmitted
(1) Where the heat energy supplier has installed a heat energy meter for measuring the heat energy supply for heating at one sampling point from which heat energy is supplied to objects or parts of objects of different owners, and heat energy customers install data on the countable floor area of individual objects or parts of objects according to other legislation1) and on the measured consumption from these meters or heating costs.
(2) In case the heat energy supplier installed a meter to measure the heat energy supply for hot water preparation
(a) for more than one sampling point and heat energy users have installed hot water meters at all individual sampling points; or
(b) at one sampling point from which thermal energy is supplied to the objects or parts of the objects of different owners and the heat energy customers have installed hot water meters in all individual objects or parts of the object according to another legislation4),
The heat energy buyer shall transmit to the heat energy supplier data on the floor area under another legislation (1) and on the measured consumption of these meters.
(3) In cases not covered by paragraph 1 or 2, the heat energy buyer shall transmit to the heat energy supplier data on the size of the deductible floor area and the floor area of the objects or parts of objects under another regulatory provision (1).
Data transmission dates
(1) Where the accounting period is a calendar year and the last day of the accounting period is 31 December of the calendar year, the heat energy customer shall provide the data referred to in Article 5 to the heat energy supplier no later than 31 January of the following calendar year, unless otherwise agreed.
(2) Where the accounting period is less than a calendar year, the thermal energy buyer shall provide the data referred to in Article 5 to the heat energy supplier no later than the 15th day of the month following the end of the accounting period, unless they agree otherwise.
Transitional provision
The provisions of this Decree shall apply for the first time to the division of the costs of heat energy for heating and heat energy consumed for the preparation of hot water and its delivery to all sampling points or to individual objects or parts of objects supplied from one sampling point for the accounting period beginning on 1 January 2016.
Repeal
Decree No 366 / 2010 Coll., on the method of allocating the heat energy supply costs in the joint measurement of the amount of heat energy collected for the preparation of hot water for several sampling points, is deleted.
Efficacy
This Decision shall enter into force on 1 January 2016.
