GOVERNMENT REGULATION
of 26 October 2009
on the definition of the Birds' Area of the Bohemian Budějovice Pond
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' area of the Bohemian Budejovice ponds (hereinafter referred to as the "bird area") is defined.
(2) The birds' areas are protected by the populations of the night-time yeast (Nycticorax nycticorax), the fisherman (Sterna hirundo), the nightingale (Luscinia svecica), the geese (Anser anser) and the hives (Anas strepera) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The bird region is situated in the territory of the South Bohemian Region in the cadastral territories of Bavaria, Břehov, Čejkovice u Hluký nad Vltavou, České Budějovice 2, České Vržné, České Vrůšné, Česnovice, Děšné, Děšné, Děšné, Děšné, Děžné, Děžné, Dívčice, Haklová Dvory, Hlukladá nad nad Vltavva, Jaronice, Křenovice u Dělovice u Dubné, Píšice, Pishlášín, Šestovice, Sedlec u České Buděovice, Tupsy, Vých and Zhu u České Budělovice.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 25 000 map documents, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the South Bohemian Region and the municipal authorities of the municipalities with extended scope in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior consent of the competent authority of nature protection (2) may the birds' area, outside the concurrently built-up territory of the municipalities and the stalled areas of the community3),
(a) to change the water level between 1 April and 31 July by more than 20 cm in the period of less than 14 days on the Bezdrev, Dasenský, Domin, Vyšatov and Zzbudský ponds;
(b) enter the night-time yeast colonies during the period 1 April to 31 August and the fish colonies between 15 April and 31 July;
(c) to interfere with the crops of trees on islands with nest colonies of the night-time yeast,
(d) enter the lithoral crops of ponds between 1 March and 31 July, except for landowners and landowners for the purpose of proper fishing and hunting users for the purpose of the care of released ducks;
(e) to change the use of the territories (4);
(f) remove lithoral crops; or
(g) to conduct fishing for aquatic feathered game, which can be managed by hunt5), on the ponds of Volesky, Zlivský and Vlhlavský. In the case of the Zlivský pond, the condition applies only to water levels and litoral crops.
(2) The prior consent of the nature authority is not required
(a) the activities referred to in paragraph 1 (a) in the event of a flood, emergency or exceptional climate situation;
(b) in the implementation of road operations6);
(c) the activities referred to in paragraph 1 (d) and (f) in the circumference of the runway and in the protection zone of the runway under another legislation (7);
(d) the activities referred to in paragraph 1 (e), where such activities are subject to a decision under another legislation (8) and have been given an opinion by the competent nature conservation authority; or
(e) in accordance with paragraph 1 (f), where such activities have been notified at least 20 days in advance to the competent nature conservation authority.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Birds' Region of České Budějovice ponds
From the railway station in Dívčice, the border leads to the border of the railway line towards the Antivine. Approximately 130 m in front of the village of Duenec at the crossing point of the groove body with a small watercourse flowing into the Black pond to this water tower passes and leads along it towards the pond. It goes to the bank of the pond and leads north to the White River, flowing into the Black pond from the north. It goes to this stream and follows it north against the stream of the stream along the ponds of Svolutínek and Blatec. On the north edge of the Blatec pond, where the white stream crosses with a nameless stream flowing from the east, the border leads against the current of this stream east. At the end of this stream west of the Mala Skří pond, the border turns south at the right angle and leads along the field road *) to a small draw with a booth 401 west of the village of Nákří, where it passes to the water flow flowing from the north of the Mala Skří pond. The border continues south after this flow to the point where the left-hand tributary flows into it near the road * *) No II / 122. From there, the border leads southeast along the influx, passes under road No II / 122 and continues further towards the Great Fur pond. Here it goes to the water stream Olesík north of the pond and turns at the right angle east. The border leads against the flow to the point where the flow crosses the field path. Here the border turns north at the right angle and leads along the field road until its conclusion on the Road of Tákří - Olesník. From there it leads the border along the road towards Olesnice. In the place where the roads cross with the watercourse flowing from the north-east of the village of Míla, it crosses and continues in the south-south-west direction, after about 500 metres turns west and then along the south-east bank of the Great Načí pond still reaches the watercourse on the road Dívčice - Myslovary. From there it leads the border along this road towards Mydlovary and after about 200 meters it reaches the road leading to the village of Zvědědí. On this road the border crosses the railway train and after 200 metres at the intersection it leaves the road and continues in a straight south direction along the field road towards the railway stop of the Zvěstí. From there the border continues along the border of the railway line towards České Budějovice until crossing with road No II / 105 near Bavaria. Here it passes to this road and goes directly south, surpasses crossing with the road E49 and then the torrent stream. After 120 metres, the road No II / 105 leaves and the short road link reaches the local communication * * *) close to the Old Vrbenský front pond. Following this communication, it leads southeast to the point where the shoreline of the Nova Vrbenský pond is diverted from it. Up the shore line leads to the dam between the ponds Nové Vrbenský and Domin. It's going to this dam and it's going southeast. After about 100 metres, it passes to a small waterjet that crosses it, and along this watercourse it continues in the southwest direction along the southeast bank of the Domin pond. Near the dividing dam between Domin and Cherniš ponds, it passes to the water-tower coming from the southeast and the water-stream leads southeast. After about 350 metres, it passes to a field road that crosses it and leads in a parallel southeast direction. Following this route it reaches the communication bordering north-south from the west side of the Vltava settlement in České Budějovice. After this communication, the border is heading south. After about 550 metres they pass the playground on the eastern side of the communication. At the end of the field at booth 387, the border leads by a line to the southwest via the former military training ground on the crossing of the field path leading from the eastern side to the Mladohaklovský and the Grand Vávrovský ponds and the street E. Rošický, bordering from the north side of the Máj settlement in České Budějovice. From there, the border leads west on the street E. Rošický, which passes in local communication, and further between the ponds Novohaklovský and Starohaklovský and along the south side of the pond Motovidlo to the pond Vyšatov. In the middle of the pond dam, the border leaves communication at a sharp angle and leads the way to the dam in the southwest direction. At the end of the dam, the field path continues in the southern direction, where it reaches the edge of the forest north of the Kořenský pond. On the edge of the forest the border leads southwest to the watercourse flowing from the pond Kořenský. Following this watercourse, it leads northeast to about 150 metres, when it reaches the watercourse coming from the south to this water tower and leads upstream to the point where it flows with the watercourse between Vitín and Granišovský. From there it leads to the current of this watercourse about 80 meters to the crossing point with the field route east of the Vitín pond. Here it goes on this journey and leads first northwest and later west around the ponds of Vitín and Nuzov until the village of Køenovice. It passes through the village and reaches the road Køenovice - Čejkovice, which is followed to the intersection with the road Jaronice - České Budějovice. Following this road it leads to Jaronice until the watercourse on the right about 400 meters in front of the village. From there, the border passes to this water tower and leads directly north, where it later flows with the water stream Jaronic waste to which it passes. After about 200 metres, along the confluence of Jaronic waste with the Dehtářský creek, it passes downstream to the places where the built-up areas of the village of Čejkovice begin, here it turns south on the eastern edge of the plot no. 1559 / 58 k.Ú. Čejkovice near Hluký nad Vltavou to the bank of the Mlyn pond, further along the bank of the Mlyn pond to the east. In the northeast corner of the Mlyn pond, the border reaches the road Køenovice - Čejkovice, which leads towards Čejkovice. After about 200 metres of road crosses the Tar River, to which the border crosses and continues east after the flow. At the southwest corner of the Čejkovický Pond, the border of the tar creek crosses, leads the western bank of the pond to the north and later the north bank of the pond to the east. It also goes to the open water tower of the plot no. 1465 k.ú. Čejkovice near Hlubová nad Vltavá north in the direction of the road from Čejkovice to the dam of Čejkovice pond, it continues along this road west and further along the open watercourse at the western edge of the lot no. 1410 / 5 and 1409 / 2 k.Ú. Čejkovice near Hlubovka nad Vltavou to the north to the road Čejkovice - Zasný. It continues along this road to the west until the place where Čejkovice leaves the road leading directly north, which later connects to the road E49. The border leads along this road and at the intersection with the road E49 holds this road west. At the eastern edge of the village Česnovice it turns north on the eastern edge of the plots No 672 / 6, 615 / 4 and 635 / 5 (all k. Ú. Česšovice) to the Bohemian creek. It also leads west against the Břehov creek stream about 200 metres. Once again, it turns north on the eastern edge of lots No 603 / 3 and No 603 / 4 to the open watercourse No 525 / 8 (all the k.ú. Česhovice), on which it continues in the western direction until the road Česnovice - Zliv. It follows this road to the intersection with the road Pistín - Zliv. At the intersection it turns left (southwest direction) on the road towards Pistín and crosses the tiny water-tower which flows into the Zlivský pond. Immediately behind this watercourse it passes at the right angle to the right (northwest) on local communication. After this communication it leads to Pashic. It passes along Pashic in the northern direction, along the northern edge of the gardens of parc. no 1955 / 3 and 1954 / 2, along the southern and western edge of the parcel no 1829 / 6 (all the k. Ú. Pashice) to the road from Pashic to the dam of the Voleska pond. The border crosses this path and continues to the west shortly on the southern edge of the parcel No 695 / 5 and then south on the open watercourse of the lot No 695 / 65 and on the western edge of the plot No 695 / 76 and 2786 / 5 (all k. Ú. Pashice). Then it turns to the east and along the south edge of the parcel No. 2786 / 8 (K. Ú. Pashice) reaches the road Pashice - Pishín. On this road the border leads to the south to the cross at cubicle 394, here it breaks at the right angle and continues to the west along the cadastral border to the E49 road, to which it crosses and continues in the southeast direction. After about 100 metres the border passes to the field road coming from the south, on which it leads to the dam of the Prince's Pond. At the end of the dam, at the right angle, it turns onto a field road leading west along the southern bank of the Prince's Pond. The border continues along this road south of the Pond of Pond of Pond of Pond of Pond of Pond of Pond. From there it passes on the road coming to the Little Temple from the south. The road leads to the edge of the Nemèický forest on the west side of the road, where it passes to the edge of the forest, which copies in the west direction. On the west edge of the forest, it passes on the field road, which results in the Germans near the church, walking along the road through the centre of the village on the road towards Mahouš. Following this road leads to the village of Mahouš up to the place where, just outside the village from the right (from the west) at a sharp angle, the field road to which it crosses joins. It leads along this path, surpasses the tiny water father, which flows from the village of Mahouš to the Vlhlín Pond, and continues north to the Pistín stream on which it passes. From there, it follows the stream of Pistín in an eastern direction to the boundary of the pond on the left (northern) side. It crosses this border and copies it north and then southeast to the village of Vlhlavu. Further the border leads along the road Vlhluv - the raincoat up to the crossing of this road with the road E49 on which it passes. The road E49 leads northwest through the village Sedlec to the intersection of the road Přeřiště - Novosedly near Nové Hospoda. Here the border bends to the right (northwest) and leads along road No II / 122 towards Girlfriend. At the point where road No II / 122 is diverted from the Lower Pond, it continues along an unpaved road north of the pond in an eastern direction to the north edge of the dam. Here it leaves the road and continues eastward after fencing the agricultural area which passes from the south, east and partly north side. On the north side, it rotates about 100 m away and along the field road straight north to road No II / 122. In Dívčice, in the place where the roads cross the railway line České Budějovice - Antivine, it crosses to this line and leads to the left (north-east) point of origin along the border of the circuit.
