GOVERNMENT REGULATION
of 21 September 2005
amending Government Regulation No 622 / 2004 Coll., on the provision of a supplement to pensions to mitigate certain injustices caused by the Communist regime in the social field
The Government orders pursuant to § 8 of Act No. 198 / 1993 Coll., on the illegality and resistance of the Communist regime:
Government Decree No. 622 / 2004 Coll., on the provision of a supplement to the pension to mitigate certain injustices caused by the Communist regime in the social field, is amended as follows:
1. In Article 1 (a), the words "or have been unlawfully deprived of their liberty and have been rehabilitated pursuant to Article 33 (2) of Act No 119 / 1990 Coll.," shall be inserted after the words "him."
2. In Section 1, at the end of the text in point (b), the words "or such a pension is not paid to them only because another pension paid exceeded the limit of the highest pension total under the rules applicable before 1 January 1996 '.
3. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) In addition, national citizens of the Czech Republic whose parent died at the time of the imprisonment or custody of the offence referred to in paragraph 1 (a) at the time of death if the parents did not reach the age of 18 and receive a pension from the Czech pension insurance scheme (1). In the event of the death of both parents under the conditions laid down in the first sentence, entitlement to the supplement shall be assessed separately from each parent. ';
4. In Article 2, at the end of paragraph 2, the sentence "If a widow's or widower's pension is not paid for the reason referred to in Article 1 (1) (b), the amount of the supplement shall be determined in accordance with the first sentence and the supplement shall be granted for the pension to be paid. ';
5. In Article 2, the following paragraph 3 is inserted after paragraph 2:
"(3) The supplement to the pension due under Paragraph 1 (2) shall be set at two fifths of the amount referred to in paragraph 1. ';
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
6. Paragraph 2 (5) reads as follows:
"(5) In the event of a confluence of the entitlements referred to in paragraphs 1 to 3, only a higher premium shall be paid; This shall also apply in the case of the coexistence of two additional claims pursuant to the second sentence of Paragraph 1 (2). '
7. In the second sentence of Article 3 (1), "paragraph 1 or 2 'is replaced by" paragraph 1, 2 or 3' and "paragraph 5 'is replaced by" paragraph 6'.
The supplement to the pension to mitigate certain injustices caused by the communist social regime, for which entitlement under Government Regulation No. 622 / 2004 Coll., as amended by this Regulation, is due on written request from the payment of the pension to which this supplement belongs in the calendar month in which this Regulation takes effect.
Efficacy
This Regulation shall enter into force on the first day of the calendar month following its publication.
