THE LAW
of 25 October 2000
amending Act No. 140 / 1961 Coll., Criminal Act, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 140 / 1961 Coll., as amended by Act No. 120 / 1962 Coll., Act No. 53 / 1963 Coll., Act No. 56 / 1965 Coll., Act No. 81 / 1966 Coll., Act No. 148 / 1969 Coll., Act No. 45 / 1973 Coll., Act No. 104 / 1980 Coll., Act No. 175 / 1990 Coll., Act No. 457 / 1990 Coll., Act No. 93 / 1993 Coll., Act No. 39 / 1994 Coll., Act No. 490 / 1991 Coll., Act No. 557 / 1991 Coll., Act No. 105.
1. the heading of Paragraph 198a reads: "Incentive to hatred against a group of persons or to restrict their rights and freedoms."
2. Paragraph 198a (1) reads as follows:
"(1) Those who publicly incite hatred for a nation, race, religion, class or other group of persons or restrictions on the rights and freedoms of their members shall be punished for up to two years by deprivation of liberty."
3. The heading above Section 260 reads: "Supporting and promoting a movement to suppress human rights and freedoms'.
4. Paragraph 260 (1) reads as follows:
"(1) Those who support or promote a movement that is demonstrably aimed at suppressing the rights and freedoms of a person or who declares a national, racial, religious or class grudge or hatred against another group of persons shall be punished by deprivation of liberty for up to five years."
Section 261 reads:
Those who publicly show sympathy for the movement referred to in § 260 will be punished by deprivation of liberty for six months to three years. "
6. The following Section 261a is inserted after Section 261:
Those who publicly deny, question, approve or seek to justify Nazi or communist genocide or other crimes of Nazis or communists against humanity will be punished by deprivation of liberty for six months to three years. "
This Law shall take effect on the first day of the month following that of its publication.
