DECLARATION
of 24 September 2025
amending Decree No. 39 / 2005 Coll., laying down minimum requirements for study programmes to be qualified for the pursuit of an unmedical medical profession, as amended
The Ministry of Health, in an agreement with the Ministry of Education, Youth and Sports, provides, pursuant to Section 90 (2) (d) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising the eligibility for the pursuit of non-medical health professions and for the exercise of activities related to the provision of health care and on the amendment of certain related laws (Act on non-medical health professions), as amended by Act No. 105 / 2011 Coll., and under Section 38 (1) of Act No. 18 / 2004 Coll., on the recognition of professional qualifications and other competences of nationals of the Member States of the European Union and of certain members of other States, and on the amendment of certain laws (Act on the recognition of professional qualifications), as amended by Act No. 189 / 2008 Coll.
Decree No. 39 / 2005 Coll., laying down minimum requirements for study programmes to be qualified for the non-medical medical profession, as amended by Decree No. 129 / 2010 Coll., Decree No. 3 / 2016 Coll., Decree No. 470 / 2017 Coll. and Decree No. 204 / 2023 Coll., is amended as follows:
1. In footnote 1, the words "as amended by Directive 2013 / 55 / EU of the European Parliament and of the Council of 20 November 2013 amending Directive 2005 / 36 / EU on the recognition of professional qualifications and Regulation (EU) No 1024 / 2012 on administrative cooperation through the Internal Market Information System (" the IMI Regulation ')' are deleted and the sentence "Commission Delegated Directive (EU) 2024 / 782 of 4 March 2024 amending Directive 2005 / 36 / EC of the European Parliament and of the Council as regards minimum training requirements for the profession of nurses responsible for general care, dental practitioners and pharmacists' is added to the separate line.
2. in Article 3 (2) (d), the words "nosocomial diseases' are replaced by the words" diseases obtained in connection with the provision of healthcare (nosocomial diseases) ';
3. in Article 4 (3) (a) of the introductory part of the provision, the word "individualised" shall be inserted after the word "general" and the words "human-oriented" shall be inserted after the words "nursing care."
4. in Article 4 (3) (a) (1), the words "radiology and" shall be inserted after the words "clinical propedeutics," after the words "education," the words "patients, relatives and other relevant persons" shall be inserted and the words "self-care" shall be inserted after the words "lifestyle."
5. in Article 4 (3) (a) (2), the words "in technical innovation concerning methods of health care and nursing," shall be inserted after the words "child care," the words "newborn" shall be replaced by "child care," and the words "old people" shall be replaced by the words "elderly."
6. in Article 4 (3) (a) (3), the words "informatics, statistics and methodology of scientific research and practice based" shall be replaced by "information and information and telecommunications systems of electronic health, nursing practice and nursing research based."
7. In Article 4 (3) (b), the words "focused on man 'shall be inserted after the word" nurturing', the words "newborn 'shall be replaced by the words" child' and the words "community care 'shall be inserted after the words" information and information and telecommunications systems of electronic health'.
8. in Paragraph 4a (3) (a) (2), "in children's homes" shall be replaced by "provided institutionally and semi-institutionally."
9. in Paragraph 5 (4) (a), the word "a" shall be deleted at the end of the text of point 3.
Efficacy
This Decree shall take effect on 1 January 2026.
