DECLARATION
of 1 October 2020
amending Decree No. 425 / 2012 Coll., on the submission of information by the pension company České národní banka, as amended by Decree No. 476 / 2017 Coll.
The Czech National Bank provides pursuant to § 170 (1) of Act No. 427 / 2011 Coll., on Supplementary Pension Savings, as amended by Act No. 119 / 2020 Coll., for implementation of § 119 (4), and under § 41 (3) of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 227 / 2013 Coll.:
Decree No. 425 / 2012 Coll., on the submission of information by the pension company Česká národní banka, as amended by Decree No. 476 / 2017 Coll., is amended as follows:
1. In Article 2, at the end of point (b), the comma is replaced by a dot and point (c) is deleted.
2. In Paragraph 3 (1) (b), at the end of point 2, the word "a 'is replaced by a comma.
3. In Paragraph 3 (1), at the end of point (b), the dot is replaced by "a 'and the following point 4 is added:
"4. PSP (ČNB) 34-12" Report on the portfolio composition of the pension company / fund, "'.
4. In Article 3, the following point (c) is added at the end of paragraph 1:
"(c) on the last day of the calendar year and submit, within 30 days of the end of the calendar year to which it relates, the PSP (CNB) report 40-01" Additional information for the assessment of the risk profile of the pension company. "'
5. In Paragraph 3 (2) (c), the words "managed fund 'are replaced by the words" pension companies / funds'.
6. In the first sentence of Article 5 (1), the words "laid down by the legislation on the digitisation of the commercial register (3) ', including footnote 3, are deleted.
7. footnote 4 is deleted, including the footnote reference.

Method and form of reporting
(1) The pension company submits the reports to the Czech National Bank pursuant to Section 3 in electronic form as data reports in the format and structure of the data files.
(2) The data messages referred to in paragraph 1 are transmitted by means enabling remote access via the Internet application or user interface of the Czech National Bank collection system.
(3) The data report referred to in paragraph 1 shall be signed by the pension company by a recognised electronic signature of the contact person.
(4) The pension company will inform the Czech National Bank of the name, address of the workplace, telephone number and e-mail address of the contact person. The pension company informs the Czech National Bank of changes to these data without undue delay. "
9. Article 8 shall be deleted, including the title.
10. In the Annex to the first and second paragraphs, the second sentence is deleted.
11. In the fourth paragraph of the Annex, the words "managed fund 'are replaced by the words" pension company / fund', the words "pension company 'and' after the words" investment limits' are inserted.
12. The following paragraph shall be added at the end of the Annex:
"PSP (ČNB) 40-01" Additional information for the assessment of the risk of the pension company "
The statement shall contain additional information on the risk profile of the pension company and the funds managed by it, information on the dividend paid or planned and the funds received and paid by the pension company, broken down by year of birth of the supplementary pension insurance participants and supplementary pension savings with intervals of 5 years. ';
Efficacy
This Decision shall enter into force on 1 January 2021.
