DECLARATION
of 22 October 2008
amending Decree No. 328 / 2000 of the Ministry of Industry and Trade Coll., on the method of making certain types of pre-packaged goods, the quantity of which is expressed in units of weight or volume
The Ministry of Industry and Trade provides pursuant to § 27 of Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 119 / 2000 Coll. and Act No. 137 / 2002 Coll., ("the Act ') for the implementation of § 9a paragraphs 2 and 3 of the Act:
Decree No 328 / 2000 Coll., on the method of making certain types of prepackaged goods, the quantity of which is expressed in units of mass or volume, is amended as follows:
1. Paragraph 1 (1), including footnote 1, reads as follows:
"(1) This decree implements the relevant provisions of the European Communities (1) and lays down requirements for the manufacture of pre-packaged goods which apply when the importer or packer intends to mark the pre-packaged goods at his choice with the symbol" e '. This decree applies to the combinations of products and individual packaging in which the products are pre-packaged ("prepackages') and are intended for sale in constant unit nominal quantities which:
(a) are equal to the values determined by the pre-packing centre;
(b) are expressed in units of mass or volume; and
(c) are not less than 5 g or 5 ml and greater than 10 kg or 10 l.
1) Council Directive 76 / 211 / EEC of 20 January 1976 on the approximation of the laws of the Member States relating to the making-up by weight or volume of certain prepackaged products. Directive 2007 / 45 / EC of the European Parliament and of the Council of 5 September 2007 laying down rules for the nominal quantities of products in prepackages, repealing Council Directives 75 / 106 / EEC and 80 / 232 / EEC and amending Council Directive 76 / 211 / EEC. '
2. In Article 1 (2), the words "and pre-packages' shall be inserted after the words" and pre-packages' and the words "which satisfy 'shall be replaced by the words" which comply'.
3. In Article 3, the following paragraph 3 is inserted after paragraph 2, including footnote 2a:
"(3) In the case of aerosol dispenser 2a), the nominal total volume of the container shall be indicated, which must be such that it cannot be confused with the nominal volume of the contents. Products sold in aerosol dispensers need not be labelled with the nominal weight of their content.
(2a) Government Decree No 194 / 2001 Coll., laying down technical requirements for aerosol dispensers, as amended. '
Paragraph 3 shall become paragraph 4.
4. The following Section 3a is inserted after Section 3:
(1) Liquid products referred to in point 2 of Annex No 3 to this Regulation which are in prepackages in the ranges referred to in point 1 of Annex No 3 to this Regulation may be put into circulation only if they are in cash in the nominal quantities referred to in point 1 of Annex No 3 to this Regulation. This also applies to individual prepackages when they are marketed as group packs consisting of two or more individual prepackages.
(2) In the case of prepackages consisting of two or more individual packages, which are not intended for sale individually, the nominal quantities referred to in point 1 of Annex 3 to this Regulation shall apply to the prepackages.
(3) The provisions of paragraph 1 shall not apply to products sold in duty-free shops and intended for consumption outside the European Union. ';
5. The following Annex 3 is inserted after Annex 2, including footnotes 5 to 12:

This Annex sets out the permitted nominal content volumes for prepackages containing liquid products.

Repeal
The following shall be deleted:
1. Decree No. 329 / 2000 Coll., on the method of manufacture of prepackaged goods by volume of liquid products.
2. Decree No. 330 / 2000 Coll., determining the series of nominal masses and nominal volumes permitted for certain types of prepackaged goods.
Efficacy
This Decree takes effect on 11 April 2009.
