on the publication of judgments
According to Section 118a (2) of Act No. 6 / 2002 Coll., on Courts, Judges, Addresses and Government Administration of the Courts and amending certain other laws (Law on Courts and Judges), as amended by Act No. 218 / 2021 Coll.:
INTRODUCTORY PROVISIONS
Subject matter
This decree regulates the categories of final decisions published by the District, Regional and Supreme Courts, the extent to which those decisions are published and the procedure for their publication.
Article 2
Categories of final decisions published by courts
(1) The District, Regional and Supreme Courts shall publish final decisions on the substance of the matter in the agendas referred to therein.
(a) Annex 1 to this Order; and
(b) Annex 2 to this Decree.
(2) The decisions referred to in paragraph 1 shall be published, including the amending orders relating to those decisions, unless the correction concerns only data pseudonymised pursuant to paragraphs 3 and 4 of this Order.
(3) Payment orders, electronic payment orders, European payment orders, exchange and cheque payment orders, decisions not containing, in accordance with the relevant procedural rules, justifications except for criminal orders, recognition orders, judgment for failure, decision for approval of a settlement, decision for divorce of a marriage without determining the causes of the divorce and decisions pursuant to Article 157 (4) of the Civil Code shall not be published.
The extent to which final judgments of the courts are published
Pseudonymisation
(1) The authentic judgments of the courts shall be made public in full except for information subject to pseudonymisation.
(2) Pseudonymisation should be carried out in such a way that it is not possible to identify a specific natural or legal person and public authority from the text of the decision published.
(3) Pseudonymisation shall be carried out by means of a designated information system which will automatically propose to replace the general concept of default data subject to pseudonymisation. Subsequently, the person responsible pursuant to Article 6 shall carry out a review of the decision in such a way as to remove the full information provided for in Article 4 of this Decree from the decision.
Scope of data subject to pseudonymisation
(1) Pseudonymisation of data on a natural person is subject to the following data:
(a) the name and, where appropriate, the names and surnames of the natural person;
(b) the address of the place of residence and the address of the place of residence of the natural person;
(c) the date of birth of the natural person;
(d) the natural person's birth number;
(e) academic degrees and scientific degrees of a natural person;
(f) a commercial firm;
(g) the identification number of the natural person;
(h) the tax identification number of the natural person;
(i) the account number of the natural person;
(j) the payment code under the Czech National Bank Act in accordance with the rules of international standardisation and the bank's client number;
(k) variable symbol,
(l) the number of the document proving the identity of the natural person;
(m) data box identifier,
(n) telephone number,
(o) the identifier used for Internet protocols for unambiguous identification of the end point and unique at the time of communication;
(p) e-mail address of the natural person,
(q) the file number of insolvency proceedings and related incident disputes, except for documents published in the insolvency register under another law;
(r) geographical indications with the exception of national names;
(s) the designation of the cadastral territory and the number of the property certificate, the partition number, the descriptive and indicative numbers, the designation of the cadastral offices and the cadastral offices, the file marks of the cadastral proceedings;
(t) the file marks of the court executors where they act as a party or party to the proceedings;
(u) data subject to commercial secrecy and classified information under other legislation1);
(v) other information that would enable the natural person to be identified; and
(w) in cases of special consideration, additional information to identify the natural person, as instructed by the person who issued the decision.
(2) Pseudonymisation of data on a legal person and public authority is subject to the following information:
(a) the name of the legal person or public authority;
(b) an indication of the territorial competence of the public authority;
(c) the registered office of a legal person or public authority;
(d) the identification number of the legal person or public authority;
(e) the tax identification number of the legal person or public authority;
(f) the account number of the legal person or public authority;
(g) the payment code maintained under the Czech National Bank Act in accordance with the rules of international standardisation and the bank's client number;
(h) variable symbol,
(i) data box identifier;
(j) telephone number,
(k) an identifier that is used for Internet protocols for unambiguous identification of the end point and is unique at the time of communication;
(l) the e-mail address of the legal person or public authority; and
(m) the particulars referred to in paragraph 1 (q) to (u); paragraph 1 (v) and (w) shall apply mutatis mutandis.
(3) Pseudonymisation is generally not subject to the following:
(a) the name and address of the court or prosecutor;
(b) file marks other than those referred to in paragraph 1 (q), (s) and (t);
(c) cash amounts;
(d) the personal names and surnames of the Judges and their alternates, provided that they are given in connection with their decision-making activities; and
(e) the names and surnames of persons mentioned in the quotations of decisions of international courts and the names and surnames of authors of quoted professional texts and publications.
(4) An amendment to the scope of the pseudonymised data of the published decision may be made on the basis of a right reasonably applied by the personal data subject under the rules governing the processing and protection of the processing of personal data (2), on the basis of the notification of the authority designated to monitor the compliance of the judicial procedure with the law on the protection of personal data in the processing of personal data (3), on the basis of a reasoned initiative by a legal person or public authority or on the basis of an initiative of the Ministry of Justice.
Procedure for the publication of final judgments by courts
Report for publication of the decision
The report for publication of the decision shall be issued by the person who issued the decision or, where appropriate, by a senior judicial officer, an assistant judge or a judicial candidate who acts under another legislature4), without undue delay after the legal power of the decision. Where a decision becomes final before it is served on the beneficiaries, the report shall be issued in accordance with the first sentence after service of the decision to all entities to whom the decision is served under the relevant procedural rules. This report includes the data referred to in § 9 (d) to (f).
Responsible persons
The President of the Court shall, in the schedule of work, designate the person or persons responsible for carrying out the pseudonymisation of the decision and entering it in the Database of Decisions of District, Regional and Supreme Courts ("the Database ').
Procedure for pseudonymisation and publication of decisions
(1) Decisions pursuant to Article 2 pseudonymised pursuant to Articles 3 and 4 will be published by the court in the Database.
(2) Pseudonymisation and publication of the decision shall be carried out by the responsible person without undue delay after the publication of the report referred to in Article 5, as a general rule at the same time as the production of the statistical sheet, in the case of the agenda in which the statistical sheet is drawn up. If this is not technically possible, the person responsible shall make the pseudonymisation and publication of the decision immediately after the removal of the technical problem which prevented the activity.
(3) The competent court shall only pseudonymise those decisions it has given.
Procedure for the pseudonymisation and publication of decisions on appeals
(1) Where the obligation of pseudonymisation and publication of a decision under this Order applies to an appeal decision, the pseudonymisation of its decision shall be carried out by a second-degree court and the pseudonymised decision shall be entered in the Database without undue delay, but no later than 15 days after the date of the return of the file to the Court of First Instance.
(2) The publication of the decision entered into the database pursuant to paragraph 1 shall be carried out by the Court of First Instance at the time when it publishes the decision to which the appeal decision relates.
Compulsory data to be included in the Database
(1) Decisions published in the Database should be provided with the following information:
(a) the date of the decision;
(b) an indication of whether the order is a judgment or a criminal order;
(c) the file number of the decision;
(d) a description of the provisions of the rules to which the decision relates;
(e) an indication of whether the decision concerns or refers to the Convention on the Protection of Human Rights and Fundamental Freedoms, as amended by its Protocols;
(f) an indication of whether the decision concerns or refers to one of the sources of European Union law;
(g) the section of the court which issued the decision; and
(h) the name and surname of the Judge or, where appropriate, the President of the Chamber.
(2) Where any of the particulars referred to in the preceding paragraph are filled in automatically, the person responsible for the publication of the decision shall check that data or, where appropriate, correct or supplement the missing data.

Efficacy
This Decree shall enter into force on 1 January 2023, with the exception of Article 2 (1) (b), which shall take effect on 1 July 2024.
