DECLARATION
of 22 September 2005
amending Decree No. 196 / 2001 of the Ministry of Justice Coll., on the remuneration and compensation of notaries and heirs, as amended by Decree No. 42 / 2002 Coll.
The Ministry of Justice sets out, pursuant to § 480c (1) of the Civil Code, § 35b (9) of Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), as amended by Act No. 317 / 2001 Coll., and § 107 of the notarial order:
Čl. I
Decree No. 196 / 2001 Coll., on the remuneration and compensation of notaries and heirs, as amended by Decree No. 42 / 2002 Coll., is amended as follows:
1. Paragraph 15, including footnote 15, reads:
„§ 15
(1) The fee of the notary for determining whether or not a testament is registered in the Central Account of the wills, the instrument of succession, the instrument of revocation of the testament or the instrument of revocation of the testament (hereinafter referred to as the "testament") or the instrument of reservation of the testament, the instrument of revocation of the testament or the instrument of revocation of the testament (hereinafter referred to as the "testament"), and for determining the status and content of the testament or of the testament is included in the notary fee as a judicial commissioner.
(2) If he makes a finding of the condition and content of the will or deed of the management of the inheritance (15) other than the court commissioner, he shall receive a reward of CZK 250.
15) Article 175d (2), part of the sentence behind the semicolon of the Civil Code. "
2. Part six, including the title, reads:

HLAVA I

_
§ 22
The basis of the inheritance administrator's remuneration is the usual price of the deceased's estate (13), which the estate manager was appointed to manage. Paragraph 12 (2) shall apply mutatis mutandis.
§ 23
If the estate manager manages the deceased's assets or parts thereof for a period of four months, he shall be remunerated at the amount calculated in accordance with Paragraph 13. The remuneration shall be reduced or increased in proportion to the duration of the administration for a shorter or longer period.
§ 23a
The remuneration calculated in accordance with Paragraph 23 may be increased by a maximum of 100% by the court if the actions of the inheritance administrator in the management of the inheritance have been exceptionally difficult or time consuming.

§ 24
(1) The inheritance administrator shall be entitled to reimbursement of expenditure incurred effectively in the management of the inheritance.
(2) The amount of reimbursement of travel expenses is governed by special legislation16. "
3. Part seven, including the title, reads:

„ČÁST SEDMÁ

REMUNERATION AND REFUND OF HOTEL EXPENDITURE BY THE CZECH REPUBLIC'S NOTIFICATION COMMISSION IN CONNECTION WITH THE REGISTER OF STAFF
§ 24a
(1) The notarial chamber of the Czech Republic (hereinafter referred to as "the Chamber") is remunerated for the recording of the lien in the register of collateral on the basis of one court or administrative office decision of CZK 600. The remuneration shall be paid by the authority which, pursuant to Article 35b (3) of the notarial order, sent the Chamber a decision establishing a lien for the execution of an alert in the register of collateral.
(2) The Chamber is responsible for the reimbursement of final expenses in connection with the registration, amendment and deletion of the lien in the Register of Preventions and in connection with the issue of a copy or extract from the Register of Preventions or confirmation that a security is not registered as a security in the Register.
(3) Reimbursement of the final expenses referred to in paragraph 2 shall be paid by the notary who has made the registration, change of the data or deletion in the Register of Preventions or issued a copy or extract from the Register of Preventions or a certificate that a security is not registered as a security in the Register.
(4) The Chamber shall not be responsible for the reimbursement of final expenses in connection with the recording, modification or deletion of the lien referred to in paragraph 1 in the Register of Deposits. "
4. In the Annex - A notary's remuneration for acts of notarial activity shall be added at the end of item C, "If the notary accepts money for safekeeping in connection with the contract he has written, one tenth of the remuneration calculated according to the first and second sentences."
5. In the Annex - The scale of the notary's remuneration for notarial activities shall be the following:

Za sepsání listiny o ustanovení správce dědictví, listiny o odvolání listiny o ustanovení správce dědictví a listiny o odvolání souhlasu s ustanovením do funkce správce dědictví 900 Kč.
Item R
Za zápis do Centrální evidence závětí nebo za provedení změny v zápisu100 Kč.
Item S
Za vyhotovení opisu zápisu nebo potvrzení z Centrální evidence závětí 150 Kč.
Item T
Za sepsání veřejné listiny o identifikaci 1 000 Kč.
Item U
Za sepsání osvědčení při přemístění zapsaného sídla evropské společnosti 10 000 Kč.
Item V
Za sepsání osvědčení při založení evropské společnosti fúzí 40 000 Kč.“.
Čl. II
Efficacy
This decree shall take effect on the day of its publication.
