determining the types of agricultural goods on which agricultural stock lists may be issued and the conditions for the operation of agricultural public warehouses
According to Section 34 of Act No. 307 / 2000 Coll., on Agricultural Storage Forms and Agricultural Public Stocks and on the amendment of certain related acts (hereinafter referred to as "the Act"), the Ministry of Agriculture provides for the implementation of Sections 2 (8), 7 (2), 15 (1) (b) and 15 (2) (d) of the Act:

§ 1
Type of goods
Agricultural storage lists may be drawn up for the types of goods listed in Annex 1.
§ 2
Quality conditions
(1) The quality of each of the types of goods stored listed in Annex 1 is defined by the values of the quality characteristics laid down in:
(a) for the safekeeping of individual values of actually established quality characteristics; the value of the quality character determined shall not exceed the limit values for the type of goods referred to in Annex 2;
(b) in the case of storage by mass limits listed in Annex 2, the value of any quality character shall be relevant for the classification of the goods in each species.
(2) The definition of additives and impurities for each type of goods, except malting barley, is set out in Annex 3 and the definition of harmful impurities for all types of goods, including malting barley, stored in agricultural public storage is set out in Annex 4.
(3) The definition of grains damaged, grains with brownish tips, grains grown and total waste of malting barley stored in agricultural public storage are set out in Annex 5.
(4) The procedure and method of sampling for the quality assessment of the characteristics, the presentation of the samples, their frequency, their use and their handling shall be carried out in accordance with the procedure set out in Annex 6.
(5) The procedure for adjusting the laboratory sample to the analytical sample and its methods of analysis shall be carried out in accordance with the procedure set out in Annex 7.
§ 3
Minimum quantity
(K § 7 (2) of the Act)
The minimum quantity of agricultural goods on which an agricultural storage certificate may be issued shall be 30 tonnes.
Conditions for the operation of agricultural public warehouses
§ 4
Object of warehouse, its specifications and necessary equipment
[Paragraph 15 (1) (b) of the Law]
(1) A warehouse object means a comprehensive storage area and its related service functions, provided that it complies with the general technical requirements laid down in the specific legislation1) and ensures the manner and conditions of storage and the necessary equipment of the agricultural public warehouse listed in Annex 8.
(2) The purpose of the construction for the storage of goods is demonstrated by the approval decision under the special legislature.2)
(3) If the approval decision is not maintained or doubts are raised as to the purpose of the use of the warehouse premises, the procedure shall be followed in accordance with the special legislation.3)
(4) The storage facility shall allow the storage of the goods in such a way that the reduction in the weight of the goods stored as a result of the handling necessary for the proper treatment and storage of the goods does not exceed the values set out in Annex 9.
§ 5
Other requirements
The condition for the operation of the warehouse is also that security is adequate to the capacity of the warehouse
(a) drying and cleaning of goods;
(b) laboratory analyses of samples of goods.
§ 6
Storage capacity
[Paragraph 15 (2) (d) of the Act]
(1) Storage capacity is given
(a) the number and volume of silo cells allocated to an agricultural public warehouse; or
(b) the volume of hall warehouses with regard to the handling area, access and maximum filling height.
(2) The minimum storage capacity of an agricultural public warehouse shall be 1 000 tonnes for all types of goods stored in total.
§ 7
Efficacy
This decree shall take effect on the day of its publication.

Definition of additives for each type of goods, excluding malting barley, stored in agricultural public storage
1. Food and non-food wheat:
Additives:
(a) grain fractions: mechanically damaged grains, irrespective of their size; partially naked endosperm grains; germ-free grains;
(b) grain admixture:
1. shrivelled grains, i.e. grains of wheat which, after removal of fractions of grains, grains damaged by frost, green grains, grains of other cereals, grains damaged by pests, grains of germ colour, heat-damaged grains, damaged grains and impurities, pass through a sieve with lengthwise rounded openings of 2,0 mm, and grains damaged by frost and green grains (including unripened grains in wax and milk maturation);
2. grains of other cereals, i.e. all grains of cereals, including fractions thereof, which are not grains of common wheat;
3. grains damaged by pests, i.e. grains eaten by pests; grains containing pests at any stage of development (mussels); grains damaged by a pteromorca (Contarinia tritici or Sithodiplosis mosellana), if not more than half of the surface of the grain is coloured brown to black as a result of intake of larvae on milk grains;
4. grains with changed germ colour, i.e. grains with coloured brown to brown cover and their own germ is normal, uncoated, in total quantity above 8% by weight;
5. heat-damaged grains (e.g. drying, self-heating, etc.) i.e. grains with apparent change in colour of packaging (insemination) but with intact endosperm;
(c) covered grains: grains in which the naked eye has visible root or plumula and grains with broken root or plumula with characteristic signs of growth.
2. Rye
Additives:
(a) grain fractions: mechanically damaged grains, irrespective of their size; partially naked endosperm grains; germ-free grains;
(b) grain admixture:
1. shrivelled grains, i.e. rye grains which, after removal of fractions of grains, grains damaged by frost, unripened grains, grains of other cereals, grains damaged by pests, heat-damaged grains, cultivated grains and impurities, pass through a sieve with lengthwise rounded openings of 1,8 mm, and grains damaged by frost and unripened grains (grains in wax and milk ripeness);
2. grains of other cereals, i.e. all grains of cereals, including fractions thereof, which are not grains of rye;
3. grains damaged by pests, i.e. grains eaten by pests; grains containing pests at any stage of development (mussels); grains damaged by the sucking of plaques (Eurygaster spp. or Aelia spp.), i.e. grains with a lighter fallen spot on its packaging; grains damaged by a pteromorca (Contarinia tritici or Sithodiplosis mosellana), if not more than half of the surface of the grain is coloured brown to black as a result of intake of larvae on milk grains;
4. heat-damaged grains (e.g. drying, self-heating, etc.), i.e. grains with apparent change in colour of packaging (insemination) but with intact endosperm;
(c) covered grains: grains in which the naked eye has visible root or plumula and grains with broken root or plumula with characteristic signs of growth.
3. Food-producing oats:
Additives:
(a) broken grains: mechanically damaged grains, regardless of their size and without germ;
(b) grain admixture:
1. shrivelled grains (sown grains), i.e. oats, which, after removal of fractions of grains, green grains, grains of other cereals, broken grains, double grains, covered grains and impurities, fall in total in the case of oats with flat sieves with longitudinal rounded openings of 1,8 mm wide, and in the case of oats naked with long rounded openings of 1,5 mm wide, as well as in the case of unripened grains in wax and milk ripeness (green grains);
2. grains of other cereals, i.e. all grains of cereals, including fractions thereof, which are not oats (Avena sativa L.);
3. damaged grains (unless they are concurrently double grains), i.e. grains with a colour other than white to slightly yellowish on the endosperm surface, which have a white colour of endosperm at the same time on the cut; small endosperm grains; grains damaged by pests; grains containing pests at any stage of development (mussels);
4. Double grains, i.e. oat grains with poached cereals in which one or both endosperm is not developed (without endosperm) or which have one or both endosperm healthy or damaged regardless of the degree of damage;
(c) grained grains: grains in which the naked eye has visible root or plumula and grains with broken root or plumula with characteristic signs of growth unless they are at the same time double grains.
4. Rye (triticale):
Additives:
(a) grain fractions: mechanically damaged grains, irrespective of their size; partially naked endosperm grains; germ-free grains;
(b) grain admixture:
1. shrivelled grains, i.e. rye grains (triticale), which, after removal of fractions of grains, grains damaged by frost, unripened grains, grains of other cereals, grains damaged by pests, heat-damaged grains, damaged grains and impurities, pass through a sieve with lengthwise rounded openings of 2,0 mm, and grains damaged by frost and unripened grains (grains in wax and milk ripeness);
2. grains of other cereals, i.e. all grains of cereals, including fractions thereof, which are not rye grains (triticale);

1. shrivelled grains (oat):
- in the case of barley with a moisture content of more than 12,5%, grains of barley shall be considered as shrivelled grains which, after removal of fractions of grains, green grains, grains of other cereals, grains of damaged pests, heat-damaged grains, damaged grains and impurities, shall pass through a sieve with long rounded openings of 2,2 mm wide and green grains (including unripened grains in wax and milk ripeness);
- in the case of barley with a moisture content of 12,5% and below, grains of barley shall be considered as shrivelled grains which, after removal of fractions of grains, green grains, grains of other cereals, grains damaged by pests, heat-damaged grains, cultivated grains and impurities, shall pass through a sieve with lengthy rounded openings of 2,0 mm and green grains (including unripened grains in wax and milk ripeness);
2. grains of other cereals, i.e. all grains of cereals, including fractions thereof, which are not grains of barley;
3. grains damaged by pests, i.e. grains eaten by pests; grains containing pests at any stage of development (mussels); grains damaged by the sucking of plaques (Eurygaster spp. or Aelia spp.), i.e. grains with a lighter fallen spot on its packaging; grains damaged by a pteromorca (Contarinia tritici or Sithodiplosis mosellana), if not more than half of the surface of the grain is coloured brown to black as a result of intake of larvae on milk grains;

3. Broken grains (unless they are concurrently duplicated), i.e. grains with crumbling endosperm; grains damaged by pests; grains containing pests at any stage of development (mussels);
4. Double grains, i.e. oat grains with poached cereals in which one or both endosperm is not developed (without endosperm) or which have one or both endosperm healthy or damaged regardless of the degree of damage;
(c) grained grains: grains in which the naked eye has visible root or plumula and grains with broken root or plumula with characteristic signs of growth unless they are at the same time double grains.
7. Non-food maize:
Additives:
(a) fractions of grains: fractions of maize grains or whole grains of maize which, after removal of grains of other cereals, grains damaged by pests, heat-damaged grains, grains damaged by frost, immature grains in wax or milk ripeness, grown grains and impurities, pass through a sieve with circular holes of 4,5 mm in diameter;
(b) grain admixture:
1. grains of other cereals, i.e. all grains of cereals, including fractions thereof, which are not grains of maize;
2. grains damaged by pests, i.e. grains eaten by pests; grains containing pests at any stage of development (mussels);
3. heat-damaged grains (e.g. drying, self-heating, etc.), i.e. grains with apparent change in colour of packaging (insemination) but with intact endosperm;
4. grains damaged by frost;
5. unripe grains in wax or milk maturity;
(c) covered grains: grains in which the naked eye has visible root or plumula and grains with broken root or plumula with characteristic signs of growth.
8. Non-food peas:
Additives:
(a) grains and parts thereof, possibly altered in the colour of the skin and partially damaged by one or both uterus, i.e. grains burnt, steamed, contaminated by anthracnosis, etc.;
(b) grains covered with apparent signs of germination, i.e. grains with skin ruptured and a key visible;
(c) grains of cereals and fractions thereof, if they do not belong to impurities, depending on the degree of deterioration;
(d) peas and parts thereof;
(e) grains contaminated on the surface with soil in excess of 10% by weight, including half.
