DECLARATION
of 11 December 2024
amending Decree No. 44 / 1992 of the Ministry of Justice of the Czech Republic Coll., on compensation for the performance of the post of associate, as amended by Decree No. 313 / 1995 Coll.
The Ministry of Justice, pursuant to § 93 (2) to (4) of Act No. 6 / 2002 Coll., on Courts, Judges, Addresses and Government Administration of the Courts and amending certain other laws (Law on Courts and Judges), as amended by Act No. 218 / 2021 Coll.:
Decree No. 44 / 1992 Coll., on Reimbursements for the performance of the function of associate, as amended by Decree No. 313 / 1995 Coll., is amended as follows:
1. The opening sentence of the Decree reads as follows: "The Ministry of Justice provides, pursuant to § 93 paragraphs 2 to 4 of Act No. 6 / 2002 Coll., on Courts, Judges, Addresses and Government Administration of the Courts and on the amendment of certain other laws (Law on Courts and Judges), as amended by Act No. 218 / 2021 Coll.: '.
2. In Section 1, the words "80 CZK per hour or 680 CZK 'are replaced by the words" equivalent to three times the hourly minimum wage or twenty-four times the hourly minimum wage'.
3. In Paragraph 2 (1), the words "I will receive the population.1) 'are replaced by the words" the income of natural persons'.
footnote 1 is deleted.
4. In Paragraph 2 (2), the words "Special Regulation (2) 'are replaced by the words" Labour Code', the words "fixed 'are inserted after the words" scope' and the words "employment relationship workers' are replaced by the words" workers working under one-shift working arrangements'.
footnote 2 is deleted.
5. Paragraph 2 (3) reads as follows:
"(3) For the calculation of the compensation for the loss of earnings referred to in paragraph 1, the amount of the tax base according to which the last known tax of the associate is determined for the last tax period ending before the date of entitlement to the loss of earnings and for which the tax has already been established shall be used. ';
6. In § 3, the words "28 CZK per hour, up to a maximum of 238 CZK 'are replaced by the words" equivalent to the hourly minimum wage, but not more than eight times the hourly minimum wage'.
7. In Article 4, the words "special regulation.3 'are replaced by the words" under the legislation governing travel refunds.';
footnote 3 is deleted.
8. In Section 5, "CZK 150 'is replaced by" CZK 500'.
Efficacy
This Decree shall take effect on 1 January 2025.
