GOVERNMENT REGULATION
of 21 December 2015
on the promotion of electricity and heat from supported energy sources
The Government mandates for the implementation of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 407 / 2012 Coll., Act No. 310 / 2013 Coll., Act No. 90 / 2014 Coll., and Act No. 131 / 2015 Coll., and Act No. 155 / 2009 Coll., Act No. 299 / 2000 Coll., on the Terms of Business and the Enforcement of State Administration in the Energy Sector and on the Amendment to Act No. 158 / 2009 Coll., Act No. 151 / 2002 Coll., Act No. 262 / 2006 Coll., Act No. 342 / 2006 Coll., Act No. 296 / 2007 Coll., Act No. 356 / 2003 Coll., Act No. 356 / 2003 Coll.
Provision of electricity and operating heat support
(1) Electricity and operating heat (hereinafter referred to as "aid") shall not be granted for:
(a) electricity from electricity generation from supported sources and heat from heat generation from renewable sources put into service before 1 January 2013;
(b) electricity from secondary power generation and from high efficiency cogeneration and heat generation from renewable heat generation put into service from 1 January 2013 to 31 December 2015;
where the European Commission receives a suspension order, recovery order or recovery decision (1).
(2) The aid shall not be granted for electricity from the production of electricity from supported sources and heat from the production of heat from renewable sources put into service from 1 January 2016, not covered by the directly applicable European Union Regulation declaring certain categories of aid compatible with the internal market), pending a decision by the European Commission on the compatibility of the aid declared in the Official Journal of the European Union.
Efficacy
This Regulation shall enter into force on the day of its publication.
