of 14 December 2010
amending Act No. 180 / 2005 Coll., on the promotion of the production of electricity from renewable energy sources and amending certain laws (Act on the Promotion of the Use of Renewable Resources), as amended, and certain other laws
Parliament has decided on this law of the Czech Republic:
Amendment to the Act on the Protection of the Agricultural Soil Fund
Act No. 334 / 1992 Coll., on the Protection of the Agricultural Soil Fund, as amended by Act No. 10 / 1993 Coll., Act No. 98 / 1999 Coll., Act No. 132 / 2000 Coll., Act No. 76 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 444 / 2005 Coll., Act No. 186 / 2006 Coll., Act No. 222 / 2006 Coll., Act No. 167 / 2008 Coll., Act No. 9 / 2009 Coll., Act No. 227 / 2009 Coll. and Act No. 281 / 2009 Coll., is amended as follows:
1. In Article 11 (2), the second sentence is replaced by the following: "The amount of the levy is dependent on the classes of protection of the agricultural land fund (the" conservation class'). Protection classes are a criterion of soil quality and are set by the Ministry of the Environment by decree. Part of the contributions of 75% is the income of the state budget, 15% is the income of the budget of the State Environmental Fund of the Czech Republic (3), and 10% is the income of the budget of the municipality in whose district the withdrawn land is located. "
2. In Paragraph 22, the present text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The Ministry of the Environment shall determine the protection class decree (Section 11 (2))."
3. Part A of the Annex to the Act, including footnote 27, reads: "The basic value indicators of agricultural land are based on the basic price of agricultural parcels according to the granulated soil ecological units established by the valuation decree 27).

4. In the Annex to Part D, point 1 reads as follows:
"1. It shall determine the classification of the land or parts thereof in the protected soil-ecological units and its basic price according to the valuation decree (27). ';
5. In the Annex to Part D, point 3 reads:
'3. The basic price of agricultural land affected by withdrawal from the agricultural land fund (point 1) shall be multiplied by the environmental weight affecting the relevant environmental factor or the sum of these weights (point 2). This establishes the standard rate of withdrawal contributions. '
6. In the Annex to Part D, point 4, the words "1 ha 'are deleted.
7. In the Annex to Part D, point 5, the words "1 ha 'are deleted.
8. In the Annex to Act D, point 6 reads as follows:
'6. The resulting rate of levies shall be determined by multiplying the standard rate of income for the withdrawal of land from the agricultural land fund determined in accordance with points 2 to 5 by the coefficient of protection.

The total resulting amount of the income for the removal of land from the agricultural land fund shall be the sum of the resulting rates, according to the size of the individual chartered soil units and their classification in the classes of protection represented on the withdrawn land. ';
Transitional provisions
1. The procedure under Article 9 (6) of Act No. 334 / 1992 Coll. initiated before the date of entry into force of this Act shall be completed in accordance with the existing legislation.
2. When deciding on the contributions pursuant to Article 11 (2) of Act No. 334 / 1992 Coll. the authority for the protection of the agricultural land fund is based on the legal status at the date of the acquisition of the legal power of the first decision issued under the special legislation.
EFFECTIVE
This Law shall enter into force on 1 January 2011, with the exception of the provisions of Part One, I (1) and Article II (1), which take effect on the date of publication of this Law.
