DECLARATION
of 4 November 2021
on the submission of certain payment statements to the Czech National Bank
The Czech National Bank provides pursuant to § 41 (3) of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 227 / 2013 Coll., and pursuant to § 263 of Act No. 370 / 2017 Coll., on payment, for implementation of § 222 (3) of the Act, as amended by Act No. 5 / 2019 Coll.:
Subject matter
(1) This decree implements the relevant European Unionprovisions (1) and regulates the content, form, time and manner of drawing up and submitting the reports to the Czech National Bank by persons authorised to provide payment services.
(2) The statements referred to in paragraph 1 shall also contain information on fraud recorded by persons authorised to provide payment services in the field of payment.
Reporting agents
The statements referred to in this decree shall be drawn up and submitted by the following reporting agents:
(a) a bank and a foreign bank established in another Member State which carries on business in the Czech Republic through its branch;
(b) savings and credit cooperatives;
(c) a payment institution and a foreign payment institution established in another Member State which carries on business in the Czech Republic through its branch,
(d) electronic money institutions and foreign electronic money institutions established in another Member State which operate in the Czech Republic through their branch;
(e) the administrator of the payment account information and the foreign administrator of the payment account information located in another Member State that operates in the Czech Republic through its branch,
(f) a small-scale payment service provider;
(g) the issuer of small-scale electronic money.
Statements presented
(1) The reporting person shall draw up, on the last day of each calendar quarter, the PSS (CNB) report 22-04 on the last day of the month following the end of the calendar quarter to which it relates.
(2) The reporting person referred to in Article 2 shall draw up, on the last day of each calendar half-year and submit by the last day of the quarter following the end of the calendar half-year to which it relates, the PSS (CNB) statement 22-02 "Half-yearly payment and fraud statement '.
(3) The content of the statements referred to in paragraphs 1 and 2 is set out in the Annex hereto.
Method of compiling statements
(1) The reporting person creates from the data of his information system a data file with data values, which is transmitted as part of the data report to the Czech National Bank.
(2) The reporting agent shall not include in the compiled statements data relating to the activities of its branches abroad.
Method and form of reporting
(1) The reporting person submits to the Czech National Bank the reports according to § 3 in electronic form as data messages in the format and structure of the data files.
(2) The data set referred to in paragraph 1 means an electronic collection of message data with predefined data structures that are methodologically described, transmitted and processed as a whole by the information system.
(3) The data messages referred to in paragraph 1 are transmitted by means enabling remote access via the Internet application or user interface of the Czech National Bank collection system.
(4) The data report referred to in paragraph 1 shall be signed by the reporting person by a recognised electronic signature of the contact person.
(5) The reporting person shall communicate to the Czech National Bank the name, address of the workplace, telephone number and e-mail address of the contact person. The reporting agent shall inform the Czech National Bank without undue delay of changes to this data.
Corrections and changes in accounts
(1) If an error or change in the statement data is detected after the Czech National Bank has submitted its statements, the reporting person shall submit the corrected statement to the Czech National Bank without undue delay. Where the correction or change affects data in another statement or statements for other periods of time, the reporting agent shall also correct all such subsequent statements.
(2) The corrected statements shall be presented in accordance with Article 5 together with information on the content and the reason for the correction.
Efficacy
This Decree shall take effect on 1 January 2022.

Content of the reports submitted
1. PSS (CNB) 22-04 "Quarterly payment statement"
The quarterly statement shall include the number and volumes of total payments, direct debits, credit card transactions and electronic money and cheques in the geographical breakdown. Payment card transactions are further broken down by trader code.
2. PSS (ČNB) 22-02 "Half-yearly statement of payment and fraud"
The half-yearly statement shall contain:
(a) the number and volume of client transactions by type of payment service, including data on fraudulent transactions in geographical breakdown and on the volume of losses on fraudulent transactions;
(b) the number and volume of client transactions carried out by credit card on acceptance facilities by type in geographical breakdown;
(c) the number and volume of cash client transactions carried out at the reporting agent's counter or with the trader;
(d) the number and type of accounts held by clients;
(e) the number of payment card acceptance facilities operated by geographical breakdown;
(f) the number and type of payment cards issued,
(g) the number of clients using the payment account information service in the geographical breakdown.
