DECLARATION
of 20 December 2010
on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Order of the Transmission System Operator, the Order of the Distribution System Operator, the Order of the Gas Storage Operator, the Order of the Data Centre, the trading conditions of the Market Operator and the Regional Distribution System Development Plan
Pursuant to Section 98a (2) (b) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll.:
Content elements Transmission System Operation Rules in electricity
The operational rules of the transmission system shall be the content elements of:
(a) details of:
1. the identification of the transmission system operator, including a list of relevant addresses and communication links with the transmission system operator and information on the transmission system operator trading portals;
2. operated transmission system,
3. the internet address through which the transmission system operator publishes information under another law in a way that allows remote access;
(b) the conditions for providing support services and providing support services, which are:
1. the definition of categories of support services;
2. method of determining the size of the individual total regulatory advances;
3. requirements for support service providers, the quality of the support services provided and the means of demonstrating them;
4. ways of providing support services and establishing principles for the selection of support service providers;
5. technical requirements for the measuring equipment of the support service provider;
6. principles for assessing the provision of support services and regulatory energy;
(c) the conditions for the provision of system and transmission services, which are:
1. definition of categories of system services;
2. the method of establishing security reserves to ensure the reliability of transmission system operation;
3. how to determine the size of the transmission capacities for cross-border electricity trade or to assess the admissibility of requirements for and allocation of cross-border electricity transactions;
4. payment conditions for system services provided,
5. payment conditions for the provision of a transmission system service, including the determination of the amount of the advances, their maturity, the maturity of the payments for the provision of a transmission system service and the method of payment of payments for the provision of a transmission system service or advances for such payments;
6. means of publication of information on the possibilities for transmission of electricity through the transmission system;
(d) the technical conditions for the connection of the electricity plant, the electricity storage facility, the distribution system or the demand facility, which are:
1. technical requirements for connection point equipment;
2. technical requirements for the connection of the power plant;
3. Technical requirements for the connection of electricity storage facilities;
(e) requirements for planning the development of the transmission system, which are:
1. the scope and timing of transmission system development planning information by system users;
2. the method of planning the development of the transmission system and the procedure for establishing the network development plan;
3. the method for establishing the N-1 criterion for planning the development of the transmission system;
4. standards for the development of transformation links between the transmission system and the distribution system and standards for the development of the transmission system configuration;
(f) the conditions of use of the transmission system, which are:
1. the technical requirements for transmission system user facilities and the establishment of the principles of communication between the transmission system operator and transmission system users;
2. the technical requirements for measurements for dispatching control of the transmission system;
3. technical requirements for the operation of power blocks;
4. the quality parameters of electricity supplied by the electricity producer or the electricity storage facility operator;
(g) essential operational requirements and standards, which are:
1. setting the conditions of synchronous operation of the Czech electricity system with interconnected electricity systems within the European network of TSOs (ENTSO-E) 1),
2. Determination of the minimum range of electrical power generation equipment from the power block;
3. laying down basic technical requirements for electrical lines and power equipment of stations in particular isolation, short-circuit resistance and radio interference;
4. the determination of basic technical requirements for secondary techniques, in particular protection systems, control systems and synchronisation devices;
(h) the safety and reliability requirements for transmission system operation and control, which are:
1. the general principles of the defence plan against the spread of transmission disturbances;
2. the scope and timing of the transmission of information on the operation of interconnected systems;
3. procedures to ensure the operation of the transmission system;
4. the general principles of the recovery plan after the breakdown of the transmission system;
5. technical requirements for the reliability and quality of transmission system-level electricity transmission;
6. requirements for the preparation of operations, including the authorisation of tests on production, distribution and storage facilities;
7. the manner and conditions of operational management of transmission system operation;
8. the rules on the restriction of electricity production in electricity production,
9. Rules restricting the supply of electricity to or from electricity storage facilities;
10. how to assess the control and outage of resources or networks,
11. the way in which transmission system failures are assessed and the manner and timing of its publication.
Content requirements Distribution system operating rules in electricity
(1) The rules on the operation of the distribution system are as follows:
(a) details of:
1. identification of the distribution system operator, including a list of important addresses and communication links with the distribution system operator;
2. operated distribution system,
3. the internet address through which the distribution system operator publishes information under another law in a way that allows remote access;
(b) the conditions for providing support services at the distribution system level and the conditions for providing support services on both the supply and electricity side, which are:
1. the definition of categories of support services;
2. requirements for support service providers, the quality of the support services provided and the means of demonstrating them;
3. ways of providing support services and establishing principles for the selection of support service providers;
4. the modalities and conditions for the provision of balancing services provided by the TSO through the distribution system,
(c) the conditions for the provision of a distribution system service, which are:
1. the method of determining the size of the distribution capacity for the operational security of the distribution system;
2. payment conditions for the provision of a distribution system service, including the setting of advance payments for the provision of a distribution system service;
(d) technical conditions for the connection of the power plant, other distribution systems, storage facilities or demand facilities, including a recharging station for electric vehicles, which are:
1. the characteristics of the connection requirement;
2. technical requirements for connection point equipment and for installation of measuring equipment;
3. technical requirements for the connection of the power plant;
4. technical requirements for the connection of electricity storage facilities;
5. technical requirements for connecting charging stations for electric vehicles;
6. technical requirements for dispatching control,
(e) requirements for the scope and timing of the transmission of the information necessary for the planning of distribution system development by distribution system users;
(f) the conditions of use of the distribution system, which are:
1. technical requirements for distribution system users, including counter-impact measures;
2. setting out the principles of communication between the distribution system operator and distribution system users;
3. technical requirements on the scope and manner of transmission and transmission of information for dispatching control of the distribution system;
4. the quality parameters of electricity supplied by the electricity producer or the electricity storage facility operator to the distribution system;
5. the limits of feedback of electrical equipment connected to the distribution system;
6. setting out the conditions under which the electricity producer is obliged to offer operational and commercially unused production capacity to the distribution system operator;
7. rules on the limitation of electricity supply and collection in emergency situations in the electricity system;
8. technical conditions for parallel operation of power generation facilities or distribution system storage facilities;
(g) the manner in which the distribution of electricity by the distribution system is made public;
(h) the essential operational requirements and standards which are:
1. the procedure for determining the estimation of demand from the distribution system;
2. methods of operational planning;
3. operating security rules for the distribution system, including how to determine the reliability of electricity supply;
4. the quality requirements for electricity distributed through the distribution system;
5. requirements for parallel operation of electricity generation or electricity storage facilities with a distribution network;
6. the scope and timing of the transmission of information on the operation of interconnected systems,
7. Requirements for the safe operation of the distribution system,
8. Technical conditions for the management of distribution system operation,
9. Conditions for putting in service, repair and maintenance requirements of distribution systems;
10. Rules on testing of distribution system equipment,
11. conditions for the operation of technical means of controlling electricity consumption;
12. Conditions of operation of the electricity connection by the distribution system operator,
13. numbering and registration of electrical equipment.
(2) The content requirements of the distribution system operating rules to which less than 90,000 customer demand points are attached are those referred to in points (a) to (d) and (f) to (h) of paragraph 1.
Content elements of the Order of the transmission system operator in gas
The content elements of the Order of the transmission system operator shall be:
(a) details of:
1. identification of the transmission system operator, including a list of important addresses and communication links with the transmission system operator;
2. an operating transmission system comprising at least a technical specification and a description of the transmission system input and output points for which the transmission system operator publishes the technical, contractual and accessible transmission capacity figures in accordance with the directly applicable European Union2 Regulation and the allocation rules applied at transmission system points; the name and range of transmission pressures used shall be indicated for the point of the transmission system;
3. the internet address through which the transmission system operator publishes information under another legislation in a way that allows remote access;
(b) particulars relating to the procedure for the conclusion of contracts for the provision of a gas transport service and the assumptions for the conclusion of a gas transport service contract, which are:
1. establishing the necessary details of the request for the conclusion of a contract for the provision of a gas transport service;
2. the form of the request for the conclusion of a contract for the provision of a gas transport service;
3. criteria for assessing the applicant's financial capacity to conclude a contract for the supply of a gas transport service;
4. the way in which the contract for the provision of a gas transport service is concluded;
(c) data relating to transport capacities, which are:
1. an indication of the internet address through which the transmission system operator publishes the amount of capacity;
2. information on the maximum amount of technical capacity following technical capacity at other interconnection points, dynamic access for each interconnection point;
3. the procedure for determining the dedicated transport capacity at each interconnection point;
4. establishing competitive capacity;
5. measures to maximise coordinated capacity by optimising technical capacity, a common method in accordance with a directly applicable European Union regulation governing capacity allocation mechanisms in gas transmission systems (3),
6. coordination of capacity calculations with neighbouring transmission system operators, procedure for non-compliance of transmission system operators,
7. the procedure for offering uncoordinated transport capacity;
8. the procedure for determining the size of the transmission capacity for the use of extractive and pulverising power offered by the gas storage tank operator;
(d) details concerning the auctions of transport capacity, which are:
1. an indication of the internet address through which the transmission system operator publishes the auction calendar;
2. the mechanism and conditions for establishing the coordinated capacity for each interconnection point and an indication of the internet address through which the transmission system operator publishes a specific level of coordinated capacity;
3. data on platforms at individual interconnection points through which the reservation of transmission capacities takes place;
(e) details concerning the procedure for the reservation of transport capacity, which are:
1. the method of demonstrating compliance with the requirements for the financial capacity of the transmission system user, including those for the auction for which no final price is known;
2. the form of the request for reservation of transport capacity,
3. Conditions for refusal of reservation of transport capacity,
4. rules on the use of interruptible transport capacities;
(f) laying down conditions for taking over or refusing gas for transport;
(g) the manner and extent of provision of information on measured gas flow, gas heat and gas quality indicators;
(h) the method of allocating the amount of gas to the settlement entities;
(i) the format of the nomination and re-nomination of gas transport by the transmission system user;
(j) the conditions for the transfer or transfer of the use of transport capacity, the dates for the transfer or transfer of the use of transport capacity, the form of the request for transfer of transport capacity and the form of notification of the transfer of transport capacity;
(k) the billing and payment conditions which are:
1. the method of determining the amount of advances and their maturity;
2. dates for invoicing the supply of gas transport services and the maturity of invoices,
3. the method of payment of advances and other payments for the supply of gas transport services;
4. the procedure for late payment of advances and other payments for the supply of gas transport services;
5. the way in which the complaint is settled to bill the supply of the gas transport service,
(l) particulars relating to the short-term market in transport capacity and the requirements for its organisation, which are:
1. definition of the short-term market for transport capacity;
2. the rights and obligations of the transmission system operator in the organisation of the short-term transmission capacity market;
3. Conditions for access by a transmission system user to the short-term transmission capacity market;
4. time limits for assessing short-term trade in transmission capacity by the transmission system operator;
(m) particulars relating to the procedure for the termination, restriction, interruption or renewal of the gas transport service:
1. conditions for withdrawal from the gas transport service contract in the event of a breach by the transmission system user;
2. particulars of the request for interruption, restriction, termination or renewal of the gas transport service;
3. the form of the request for interruption, restriction, termination or renewal of the gas transport service;
(n) technical conditions for the connection of the gas plant, gas storage tank, distribution system or demand gas installation;
(o) the mechanism for controlling gas flows at each interconnection point;
(p) rules ensuring consistency between the allocated quantities of gas on both sides of each interconnection point;
(q) the nomination reconciliation procedure for each interconnection point;
(r) the form and particulars of the application for the transport of gas in test operations;
(s) the rules on access to the transmission system operator's information system.
Content elements of the Order of the gas distribution system operator
(1) The content elements of the Order of the distribution system operator are:
(a) details of:
1. identification of the distribution system operator, including a list of important addresses and communication links with the distribution system operator;
2. the internet address through which the distribution system operator publishes information under another law in a way that allows remote access;
(b) details concerning the procedure for concluding contracts for the provision of a distribution system service and the assumptions for concluding a contract for the provision of a distribution system service, which are:
1. setting out the details of the request for the conclusion of a distribution system service contract;
2. the form of the request to conclude a distribution system service contract;
3. criteria for assessing the applicant's financial capacity for the conclusion of a distribution system service contract;
4. how the distribution system service contract is concluded,
5. the procedure for negotiating a change in the distribution system service contract in the event of a change in customer demand points agreed and a change in distribution capacity at the customer demand point;
6. the procedure for amending the Party identification data in the distribution system service contract;
(c) particulars relating to the reservation of distribution capacity, which are:
1. the method of demonstrating compliance with the requirements for the financial capacity of a network user;
2. the form of the request for reservation of distribution capacity,
3. Conditions for refusal of reservation of distribution capacity,
4. the termination and termination of the reservation of distribution capacity,
(d) laying down conditions for taking over or refusing gas for distribution;
(e) the manner and scope of the provision of information on measured gas flow, gas heat and gas quality indicators;
(f) the format of the nomination and re-nomination of the gas distribution by the system user;
(g) the billing and payment conditions which are:
1. the method of determining the amount of advances and their maturity;
2. dates for invoicing gas distribution and maturity of invoices;
3. the method of payment of advances and other payments for the provision of the distribution system service;
4. the procedure for late payment of advances and other payments for the provision of the distribution system service;
5. way of dealing with the gas distribution bill complaint,
(h) particulars relating to the termination, restriction, interruption or renewal of the distribution system service, which are:
1. conditions for withdrawal from the distribution system service contract in the event of a breach by the distribution system user;
2. details of the request for interruption, restriction, termination or renewal of the distribution system service;
3. the form of the request for interruption, restriction, termination or renewal of the distribution system service;
(i) the form and particulars of the application for the distribution of gas in test operations;
(j) the technical conditions for connection of the gas plant, gas storage tank, other distribution system or demand gas installation;
(k) the manner and extent of the provision of information on the grid operated, including the technical specification and description of the grid input points.
(2) The content elements of the Order of the distribution system operator which is not directly connected to the transmission system are those referred to in paragraph 1 (a) to (d), (g), (h), (j) and (k).
