DECLARATION
of 23 November 2017
amending Decree No 641 / 2004 Coll., on the scope and manner of keeping the packaging records and reporting the data from that register
The Ministry of the Environment provides pursuant to § 50 (2) of Act No. 477 / 2001 Coll., on Packaging and on the amendment of certain laws (Act on Packaging), as amended by Act No. 94 / 2004 Coll. and Act No. 149 / 2017 Coll., ("the Act ') for the implementation of Sections 15 (3) and 23 (5) of the Act:
Decree No 641 / 2004 Coll., on the scope and manner of keeping the packaging records and reporting of data from this register, is amended as follows:
1. In Article 1, the number "3 'is replaced by" 2 (1) to (3)' and the words "including documents enabling the accuracy of such data to be demonstrated 'are deleted.
2. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The authorised company shall keep records of the quantities of packaging and the quantities of packaging waste and the manner in which they are used at least to the extent that it is required to report pursuant to Article 2 (4)."
3. In Article 2, the following paragraph 4 is added:
"(4) The Authorised Society shall report to the Ministry the records in the form of the completed statement set out in Annex 5."
4. Article 3 is deleted.
5. Annex 1 shall read as follows:
"Annex No 1 to Decree No 641 / 2004 Coll.
Annual reports on packaging and packaging waste per year...
6. In Annex 2, column 11a is added to the table:
"11a Burning in waste incineration plants with energy recovery '.
7. In Annex 2, in the title of the table, the words "packaging 'are deleted.
8. In Annex No 2, in the Explanatory Notes, the paragraph "Column 4 'is replaced by the following:
"Column 4
Columns (1 + 2-3) '.
9. In Annex No 2, in the Explanatory Notes, the title of the paragraph "Columns 9,10,11 'is replaced by" Columns 9, 10 and 11'.
10. In Annex 2, in the Explanatory Notes, in the paragraphs "Columns 9, 10 and 11 ', the words" packaging' are deleted.
11. In Annex 2, the following paragraph "Column 11a 'is inserted after the paragraph" Columns 9, 10 and 11':
"Column 11a
Total weight of waste from packaging burned in waste incineration plants with energy recovery '.
12. In Annexes 2 and 4, in the tables between the rows "Other 'and" Total', the following row "Sales packaging intended for consumers' is inserted.
13. Annex 3 reads as follows:
"Annex 3 to Decree No 641 / 2004 Coll.
Annual report on disposable packaging (single-way packaging) and re-use packaging which do not meet the criteria of Section 13 (2) of the Act
14. the following Annex 5 is inserted after Annex 4:
"Annex No 5 to Decree No 641 / 2004 Coll.
Statement by the company authorised to record the quantity of packaging and the amount of packaging waste and the method of recovery

Transitional provision
Persons who place on the market or put into circulation packaging or packaged products shall report the data from the register referred to in Annex 3 to Decree No 641 / 2004 Coll., as effective from the date of entry into force of this Order, for the first time for the reporting year 2018.
Efficacy
This Decision shall enter into force on 1 January 2018.
