implementing the Civil ID Act and the Travel Documents Act
The Ministry of Interior provides pursuant to § 12 paragraphs 5 and 26 of Act No. 328 / 1999 Coll., on Civil Documents, as amended by Act No. 559 / 2004 Coll., Act No. 136 / 2006 Coll., Act No. 227 / 2009 Coll. and Act No. 424 / 2010 Coll., and Section 5 (5) (a) and § 20 paragraphs 5 and 8 of Act No. 329 / 1999 Coll., Act No. 136 / 2006 Coll., Act No. 140 / 2008 Coll. and Act No. 197 / 2010 Coll.

CITIZENS
§ 1
Model of identity card with machine readable data and contact electronic chip
(1) The model of the identity card with machine-readable data and the contact electronic chip is set out in Annex 1 to this Decree.
(2) The machine-readable data are recorded in a specified zone at the bottom of the back of the identity card and in a 2D code.
(3) The title of the items on the back of the identity card shall be printed only if the item content is completed.
(4) The contact electronic chip is located on the back of the ID card.
§ 3
Model ID card without machine-readable data
(1) The model of the identity card without machine-readable data is set out in Annex 3 to this Decree.
(2) The unabridged form of the name or names, where applicable, and the surname shall be entered in the special records on the back of the identity card.
§ 4
Marked part of the ID card
(1) The marked part of the identity card, the specimen of which is given in Annex 1 to this Decree, means both its upper corners, marked in colour on the back of letters A and B.
(2) When reporting the change in residence, the part marked with A shall be separated.
(3) When changing the data entered in the identity card, except for the change in the permanent residence address referred to in paragraph 2, the part marked with the letter B shall be separated.
(4) When a change of permanent residence is announced, the right-hand corner of the front plates shall be separated for the identity card issued before 30 April 1993, the identity card issued after 30 April 1993, which does not contain machine-readable data, the right-hand corner shall be separated for the identity card issued before 31 December 2011 and the part marked with the letter A shall be separated for the identity card issued before 31 December 2011.
(5) The upper right corner of the front plates shall be separated for the identity card, except for the change in the permanent residence address, for the identity card issued before 30 April 1993, for the identity card issued after 30 April 1993, which does not contain machine readable data, the lower left corner and for the identity card issued before 31 December 2011, the part marked with the letter B shall be separated.
§ 5
Models of forms of certificates of identity card and certificates of amendment to the particulars entered on the identity card
(1) The model form for the certificate of identity card is set out in Annex 4 to this order.
(2) The model of the form of the certificate of amendment to the particulars entered on the identity card is set out in Annex 5 to this decree.
§ 6
Models for applications for a card
(1) The model of the electronically processed application for the issue of an identity card with machine-readable data and the contact electronic chip is set out in Annex 6 to this Decree.
(2) The model of the application form for the issue of an identity card without machine-readable data (hereinafter referred to as "the application") is set out in Annex 8 to this Order.
§ 7
Requirements for the technical execution of the photograph for the issue of the identity card
(1) The photograph or similar image recording (hereinafter referred to as "photographs") attached to the application has a smooth surface and is in black and white or colour. The photograph is rectangular with dimensions 35 mm x 45 mm, built on a shorter side, with straight or rounded corners with radius r = 3 mm + / - 0,5 mm, thickness from 0,13 mm to 0,27 mm. The picture dimensions are shown in Annex 9 to this Order, Figure 1.
(2) The photograph shows the head and upper part of the arms of the person displayed in the front view so that the central vertical plane of the face is an extension of the vertical plane of the lens of the sensing system and the horizontal plane of the face formed by the eyes is an extension of the horizontal plane of the lens of the sensing system. The position of the lens of the sensing system vis-à-vis the person is shown in Annex 9 to this Decree, Figure 2. The view of the person displayed is directed to the lens.
(3) The photograph must correspond to the person displayed at the time of application. A view over the shoulder, twisted or tilted head are not allowed. The depicted person shall have a neutral expression and a closed mouth, the eyes shall be open and the hair shall not be covered. The glasses of the person in the photograph must not cover the eyes and create reflections. The cover of the head for religious or health reasons must not create shadows on the face.
(4) The distance between the upper edge of the head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm. The size of the person displayed's head, including its location on the photograph, is given in Annex 9 to this Decree, Figure 3.
(5) The background behind the person displayed is white to light blue, or light grey, and the smooth transition of these colours is permitted. The photo is without glare which would hide or significantly change the characteristic identification characteristics of a person, which are in particular the shape and location of eyebrows, eyes, nose, mouth, chin and the overall shape of the face. It is not possible to retouch or otherwise modify the negative or positive photograph or digital photograph of the person or print it.
§ 8
Conditions and technical method of sending digital photography through the photographer's data box
A digital photograph of a citizen taken for the issue of a citizen's card by a photographer is sent to a specially set-up data box of the Ministry of Interior (1), which is intended for receiving digital photographs for identity cards, using an electronic form published on the public administration portal (2), attached to which is digital photography.
§ 9
Technical parameters of digital photography
In addition to the requirements of § 7 (2) to (5), digital photographs of a citizen must meet the following technical parameters:
a) the size of the data file containing the photo, maximum 90 kB, minimum 50 kB,
(b) the format of the data file containing the photograph jpg / jpeg / jfif with the extension .jpg3),
(c) photo width 2,6 cm, resolution 600 DPI,
(d) photo height 3,4 cm, resolution 600 DPI; and
e) color depth 24 bits, color model RGB.

TRAVEL DOCUMENTS
§ 10
Passport model
(1) The model passport is set out in Annex No 10 to this Order.
(2) The machine-readable data are recorded in a specified zone at the bottom of the passport data page in Annex 10 to this Decree.
(3) The data carrier with biometric data is an integral part of the passport's data page set out in Annex 10 to this Decree.
(4) The unabridged form of the name and, where applicable, the names and surnames shall be entered in the official records on page 3 of the passport set out in Annex 10 to this Order.
(5) On pages 4 and 5 of the passport referred to in Annex 10 to this Regulation, a register is given (4) with the translation of the names of the relevant information entered in this passport in the German, Italian, Spanish, Portuguese, Dutch, Swedish, Danish, Finnish, Greek, Irish, Slovak, Slovenian, Polish, Hungarian, Maltese, Lithuanian, Estonian, Latvian and Russian languages.
(6) The passport is a travel document of the type of book and contains 34 pages.
§ 14
Model of another travel document issued under an international contract
The models of another travel document issued under an international contract, unless provided for in this contract, are set out in Annex 13 to this Order.
§ 15
Models of application forms
(1) The model of the electronically processed application for the issue of a passport is set out in Annex 14 to this Decision.
(2) The model forms for applications for the issue of other travel documents issued under an international contract are set out in Annex 17 to this Order.
§ 16
Requirements for the technical execution of the photograph attached to the travel document application
Paragraph 7 shall apply mutatis mutandis to the requirements for the technical execution of the photograph attached to the travel document application.

TRANSITIONAL AND FINAL PROVISIONS
§ 17
Transitional provisions
(1) The forms of the application for the issue of a card without machine-readable data, the certificate of identity card, the application for the issue of a passport without machine-readable data and the data carrier with biometric data, the application for the issue of a card, the application for the issue of travel documents issued under an international contract, issued in accordance with Decree No 642 / 2004 Coll., as effective by the date of entry into force of this decree, may be used no later than 31 December 2016.
(2) Passports without machine-readable data and without data carrier with biometric data according to the model set out in Annex 9 to Decree No. 642 / 2004 Coll., as effective until the date of entry into force of Decree No. 417 / 2006 Coll., may be issued no later than 31 December 2012.
(3) The forms of the application for a travel licence issued in accordance with the model of this form provided for in Decree No 642 / 2004 Coll., as effective until the date of entry into force of Decree No 65 / 2008 Coll., may be used until 31 December 2012 at the latest.
§ 18
Repeal
The following shall be deleted:
1. Decree No. 642 / 2004 Coll., implementing the Civil ID Act and the Travel Document Act.
2. Part of the first Decree No. 299 / 2006 Coll., amending Decree No. 642 / 2004 Coll., implementing the Act on Civil Documents and the Act on Travel Documents, and Decree No. 296 / 2004 Coll., implementing the Act on the Registration of Citizens and amending Decree No. 177 / 2000 Coll., implementing the Act on the Registration of Citizens, the Act on Civil Documents and the Act on Travel Documents, as amended.
3. Decree No. 417 / 2006 Coll., amending Decree No. 642 / 2004 Coll., implementing the Act on Civil Documents and the Act on Travel Documents, as amended by Decree No. 299 / 2006 Coll.
4. Decree No. 65 / 2008 Coll., amending Decree No. 642 / 2004 Coll., implementing the Act on Civil Documents and the Act on Travel Documents, as amended, and Decree No. 417 / 2006 Coll., amending Decree No. 642 / 2004 Coll., implementing the Act on Civil Documents and the Act on Travel Documents, as amended by Decree No. 299 / 2006 Coll.
5. Decree No. 85 / 2011 Coll., amending Decree No. 642 / 2004 Coll., implementing the Act on Civil Documents and the Act on Travel Documents, as amended.
§ 19
Efficacy
This Decree shall take effect on 1 January 2012.
