amending Decree No. 376 / 2016 Coll., on dual-use items in the nuclear field
The State Authority on Nuclear Safety sets out, pursuant to § 236 of Act No. 263 / 2016 Coll., Atomic Act, as amended by Act No. 83 / 2025 Coll., for implementation of § 24 (7), § 25 (2) (d), § 166 (7) (d), § 169 (4), § 170 (4) and § 171 (5):
Decree No. 376 / 2016 Coll., on dual-use items in the nuclear field, is amended as follows:
1. In Section 1, the word "Terms' is replaced by the words" Requirements for the content of documentation for authorised activity, which is the import or export of a dual use item in the nuclear field and the elements'.
2. In Section 1 of the introductory part of the provision, the word "transfer 'is replaced by" import or export'.
3. in Article 1 (b), the words "the method 'are replaced by the words" method and place';
4. In Paragraph 1 (c), the word "anticipated 'is added at the beginning and the word" transfer' is replaced by "import or export '.
5. In Section 1 (d) of the introductory part of the provision, the word "notifier 'is replaced by the word" applicant'.
6. In Article 1 (d) (1), the word "surname 'and the word" surname' are replaced by "date of birth '.
7. In Article 1 (d) (2), the words "and, if assigned, the identification number 'shall be inserted after the word" name'.
8. In Article 1 (f) (2), the words "for military purposes and 'are replaced by the words" in conjunction with the development, manufacture, handling, operation, maintenance, storage, detection, identification or dissemination of chemical, biological or nuclear weapons or other nuclear explosive devices, or with the development, manufacture, maintenance or storage of missile systems capable of carrying such weapons.';
9. in Article 1 (f), point 3 is deleted;
10. in Paragraph 1, point (g) is deleted;
11. Article 2 is deleted.
12. in Paragraph 3 (1) of the introductory part of the provision, the word "export" is replaced by "import" and the word "import" is replaced by "export."
13. in Paragraph 3 (1) (b), the words ", identification number, if assigned," and "shall be deleted," shall be inserted after the word "surname," the words "date of birth" and the word "seat" shall be inserted after the word "address."
14. in Article 3 (1) (c), the words "and other commercial" shall be replaced by "or otherwise."
15. in Paragraph 3 (2) of the introductory part of the provision, the word "export" is replaced by "import" and the word "import" is replaced by "export."
16. in Article 3 (2) (a), the words "if the time limit is not extended," shall be replaced by the words "import" and the word "import" shall be replaced by "export."
17. Annex No 1 reads as follows:

Common provision
1. This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This decree shall take effect on 1 April 2026.
