DECLARATION
of 2 February 2006
amending Decree No. 582 / 2004 Coll., implementing certain provisions of the Act on Insurance Intermediaries and Insurance Liquidators
The Ministry of Finance provides, pursuant to § 12 (1), § 16 (2), § 18 (3) and (10) and § 22 (2) of Act No. 38 / 2004 Coll., on insurance intermediaries and individual claims liquidators and on the amendment of the Trade Act (Act on Insurance Intermediaries and Insurance claims liquidators):
Decree No 582 / 2004 Coll., implementing certain provisions of the Insurance Intermediaries and Insurance Liquidators Act, is amended as follows:
1. in Article 2 (2) (b) (1), the words "under Article 5 of the Law" shall be deleted;
2. in Article 2 (2) (b) (2), the words "under Article 6 of the Act" shall be deleted;
3. in Article 2 (2) (b) (3):
"3." VPA, "which expresses the registration of the sole insurance agent,"
4. In Article 2 (2) (b) (4), the words "under Article 7 of the Act, with the exception of the exclusive insurance agent 'are deleted.
5. in Article 2 (2) (b) (5), the words "under Article 8 of the Act" shall be deleted;
6. In Article 2 (2) (b) (6), the words "under Article 9 of the Law 'are deleted.
7. In Article 2 (2) (b) (7), the words "pursuant to Article 10 of the Act 'are deleted.
8. In the first sentence of Article 7 (2), "30 'is replaced by" 40'.
9. In § 7 (2), the fourth sentence is: "The place of conduct of the proper professional examination and the place and date of the extraordinary professional examination shall be published by the Ministry no later than 25 days before the examination date on its website."
10. In the third sentence of Article 7 (9), the words "when they received proof of 'are deleted.
11. in Paragraph 9 (7):
"(7) The insurance intermediary's activity statement shall be dated and signed by the authorised person, and the insurance intermediary's electronic form of the activity statement shall also be indicated by the verification code assigned to it by the Ministry. If it is a legal person, the activity report shall also be signed by its responsible representative. The Ministry shall communicate the verification code to the insurance agent or insurance broker within 30 days of the date of its registration. If the insurance intermediary is registered simultaneously as an insurance agent and as an insurance broker, the Ministry shall communicate the verification code separately for each such registration. ';

13. Annex 7 shall read as follows:
"Annex No 7 to Decree No 582 / 2004 Coll.
Transitional provision
The Ministry shall notify the insurance agent or insurance broker registered before the date of entry into force of this Order of the verification code within 60 days of the date of entry into force of point 11 of this Order.
Efficacy
This Decree shall take effect on 1 April 2006, with the exception of Article I (11) and (12) and Article II, which shall take effect on the date of its publication.
