Law on pension arrangements for certain convicted persons

on the adjustment of the pensions of certain sentenced persons
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1
(1) Persons legally convicted of a punishment more stringent than the sentence of imprisonment of two years for a intentional offence against the Republic referred to in Title I of the Criminal Act, an economic offence referred to in Title II of that Law, a intentional offence against property in socialist property or a criminal offence under the law on the protection of peace or similar offences under the laws previously in force, may reduce the social security committee of the Council of the District National Committee (hereinafter referred to as "the Commission") and, in particularly serious cases, withdraw pension from pension insurance (provision, insurance).
(2) The Commission may also reduce or withdraw the survivor's pension from the persons referred to in paragraph 1.
§ 2
If a pension entitlement has already expired for a period of 10 years from the time of the sentence, its remission or the limitation of the pension, the pension may not be reduced or withdrawn. However, a pension may be reduced or withdrawn which has been awarded before the application of this law.
§ 3
The Commission may, in whole or in part, waive and grant the pension to persons who have been reduced or withdrawn from the pension, provided that their work for the company has shown an attempt to atone for the offence or testify to other reasons worthy of special consideration.
§ 4
Persons who are legally convicted under the former provisions, under which the pension entitlement (provision, insurance) has expired as a result of the conviction, or the survivors of such persons, may be granted a reduced pension from the pension, or a full pension.
§ 5
If the pension has been reduced or withdrawn under this Act, the provisions of Section 8 of Act No. 33 / 1957 Coll., on social measures of members of the armed forces shall not be used.
§ 6
(1) The powers of the commissions under this Act - with the exception of those under Paragraph 4 - are exercised by the authorities established by the Ministers for National Defence and Interior with regard to pension beneficiaries from social security measures of armed forces.
§ 7
This Act shall take effect on the day of its publication; it shall be carried out by all members of the Government.
