of 28 April 1953
on civil labour assistance.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 paragraph 1 of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
(1) National committees may issue a call for civil labour assistance to combat impact or emergency work which cannot be delayed by other means, in particular through voluntary workers, for an urgent general interest. The invitation may cover only the performance of work appropriate to the working capacity of persons required to provide civil labour assistance at the call.
(2) In order to issue this call, the agreement of the directly superior national committee and, if the call of the regional national committee, the agreement of the relevant central office issued in agreement with the Ministry of Interior shall be required. Consent may be granted only in unavoidable cases and to the extent necessary, in particular with time and local restrictions and under the conditions laid down in Article 4.
(3) The call, if not addressed to individual persons, shall be issued by the Regional and Regional National Committees by decree, the Local National Committees in a manner customary.
(1) At the call for civil work assistance, everyone is obliged to provide, according to their forces, the necessary work assistance. This obligation shall be exempt from:
1. children subject to compulsory education;
2. women over 50 and men over 60;
3. persons who prove that they are ill or otherwise incapacitated;
4. Women from the beginning of the third month of pregnancy until the end of the sixth month after childbirth or women who care for at least one child under the age of 6, unless they have the possibility to provide otherwise (e.g. in a nursery);
5. persons enjoying the rights of exteritoriality and subject to reciprocity of a person who is a member of a foreign State;
6. persons for whom the local national committee authorises an exemption for reasons of particular concern;
7th Armed Forces.
(2) Persons who are in employment may not be called upon to provide civil labour assistance at the time of their employment or who would otherwise be detrimental to the proper performance of their employment. This applies mutatis mutandis to persons preparing to work.
(1) Persons participating in civil labour assistance shall be remunerated by the undertaking (body) for which the work is carried out, equal to the wage paid for such work, in accordance with the applicable wage rules. In the event of sickness or accident, these persons are insured under the national insurance rules for temporary staff.
(2) The undertaking (body) has the same obligations and rights with regard to persons working for it in civil work assistance, in terms of safety and protection at work as with respect to their employees.
The Ministry of the Interior shall, in agreement with the central office responsible for the matter, issue more detailed provisions for the implementation of this Regulation; it may also provide for further exceptions or derogations from the obligation to provide civil labour assistance in the same way.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for the Interior and other members of the Government.
