DECLARATION
of 20 December 2019
on energy specialists
The Ministry of Industry and Trade ("the Ministry ') provides, pursuant to Article 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 177 / 2006 Coll., Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll., Act No. 103 / 2015 Coll., Act No. 131 / 2015 Coll. and Act No. 3 / 2020 Coll., (" the Act') for implementation of Sections 10 (6), (7) (d), paragraphs 8 and 10 and § 10a (3) and (5) of the Act:
Subject matter
(1) This decree sets out the content and scope of the professional examination for the approval of an energy specialist, the content and scope of the continuous training of energy specialists, the rules for the appointment and conduct of the examination committee and the expert committee for the selection of educational actions included in the ongoing training, the rules for the selection of training actions and the number of credits needed to successfully complete continuous training. At the same time, a form shall be drawn up for the application for authorisation to carry out the activity of an energy specialist listed for the natural person in Annex 1 to this Order and for the legal person in Annex 2 to this Order.
(2) The Decree sets out the scope of the data transmitted by the energy specialist to the Ministry's register on the activities carried out by energy specialists.
Expert test
(Paragraph 10a (3) of the Act)
(1) The technical examination shall be carried out in the Czech language.
(2) The state energy inspection shall inform the applicant in writing of the date, place and time of the professional examination, at least 30 days before it takes place.
(3) The expert examination is carried out separately for each of the activities of an energy specialist under Section 10 (1) of the Act and has a written and oral part. The written part is carried out in the form of a test and its successful composition is a condition for the oral part of the examination. The oral part shall be conducted in the form of a debate on the basis of 3 applicants of winning thematic test circuits. Both parts of the vocational examination shall be composed in one day.
(4) The written part of the professional examination shall last a maximum of 90 minutes and the oral part of the professional examination shall last a maximum of 60 minutes.
(1) The written part of the professional examination examines the knowledge of legislation, technical standards and technical documents in the fields related to the various activities of an energy specialist under Section 10 (1) of the Act. The written part of the professional examination shall consist of:
(a) 80 questions for the activity of an energy specialist under Section 10 (1) (a) of the Act;
(b) 50 questions for the activities of an energy specialist under § 10 (1) (b) to (d) of the Act.
(2) The written part shall be evaluated by the Examination Committee, either by "passed" or "failed" on the basis of the correct responses obtained, expressed as a percentage, by the applicant for an authorisation who has complied with:
(a) less than 80%, failed;
(b) 80% or more, granted.
(3) The result of the oral part of the professional examination shall be assessed by the phrase "passed 'or" failed' on the basis of the same statement by the majority of the members of the examination committee present. In the event of a tie, the vote of the President or Vice-President shall be taken.
(4) The thematic test circuits for the oral part of the professional examination for the individual activities of an energy specialist under Section 10 (1) of the Act are listed in Annex 3 to this Decree.
(5) A report on the result of the expert examination shall be obtained from the expert examination. The report shall include an evaluation of both the written and oral part of the professional examination, a record of the vote of the examination panel on the oral part of the examination and an indication of whether or not the applicant has passed the examination. The model of the report on the outcome of the expert examination is set out in Annex 4 to this Decree.
(6) The applicant for authorisation is also assessed by the phrase "failed" if:
(a) shall not appear for testing no later than 5 calendar days after the date of the test without a proper apology from the State Energy Inspectorate's notification;
(b) withdraw from the examination in the course of the examination without having any serious reason; or
(c) apologize repeatedly from the test, more than three times.
Test Panel
(Paragraph 10a (3) of the Act)
(1) The Examination Board shall have at least 11 members, one of whom shall be appointed chairman, and at least 2 other members shall be appointed Vice-Presidents. The examination committee shall be composed of representatives of the Ministry, universities and professional organisations. The members of the Examination Board, including the President and Vice-Presidents, shall be appointed and removed by the Central Director of the State Energy Inspection.
(2) The Board of Appeal shall be chaired by the President of the Commission, and, if he is not present or has appointed a Vice-President, the Vice-President of the Commission. In the event that the President of the Commission does not approve the Vice-President of the Commission, the Vice-President of the Commission shall be appointed by the Secretary of the Commission on the day of the technical examination.
(3) The Secretary shall convene the Examination Board at least once every 2 months or at the request of the Ministry.
(4) The examination committee shall be quorum in the presence of at least 7 members, one of whom shall be chairman or vice-chairman, and provided that the absolute majority of the members of the examination panel are representatives of the Ministry and experts from universities. The panel shall act by a majority of the members present. In the event of a tie, the vote of the President or Vice-President shall be taken.
(5) The President or Vice-Chair of the Examination Board shall notify the applicant of the outcome of the expert examination on the day of the examination.
(6) The report on the outcome of the expert examination shall be signed by all members of the examination committee present.
(7) Minutes shall be taken of the examination committee's deliberations. This entry also includes individual protocols on the result of professional examinations of applicants. The minutes shall be drawn up by the Secretary and signed by the President or the Vice-President. The model of registration is set out in Annex 5 to this Decree.
Continuous education
(K § 10 (8) and § 10a (3) of the Act)
(1) Continuous education according to Section 10 (8) of the Act consists of individual educational events. The energy specialist will attend the educational event personally.
(2) The energy specialist will successfully complete continuous education if he has completed training events of at least 18 credits within 3 years.
(3) The training event included in continuous training shall be selected by the energy specialist from the list available in the register of activities carried out. It shall be applied to the person holding the training event (hereinafter referred to as the organiser). After completion of the training event, the energy specialist shall enter this fact in the register of the activities carried out by the energy specialist without undue delay.
(4) The organizer shall, within 14 calendar days of the day of the ongoing training event, forward to the State Energy Inspection a list of participating energy specialists for his organised training event in the form of a presentation form signed by the participating energy specialists. The State Energy Inspection will then enter this data in the Ministry's records of the activities carried out by the Energy Specialist without undue delay.
(5) The organiser shall inform the participants of the ongoing education and the State Energy Inspection of changes to the organisation of the training event, which took place between the time of the inclusion of the educational event in the continuous training and its implementation, without undue delay.
Rules on the selection of training actions
(K § 10a (5) of the Act)
(1) An applicant for the organisation of an educational event shall submit an application for the inclusion of an educational event in continuous training electronically by the State Energy Inspection using the form set out in Annex 6 to this Decree. The applicant may withdraw the application but may not be amended or supplemented during the evaluation by the expert committee.
(2) The mandatory items of the application are on the application form. In the event that the forms are not filled in correctly or completely, the application shall be considered invalid and the State Energy Inspection shall be designed to withdraw from the next evaluation.
(3) An application for the inclusion of an educational event in continuous training shall be submitted within the deadline set by the State Energy Inspection. The national energy inspection shall set deadlines for the submission of applications for educational actions for continuous training and shall publish them on the official record at least twice per calendar year.
(4) Before assessing the applications, the State Energy Inspection shall draw up a protocol containing a list of the applications received, details of the proposals for training actions and their completeness.
(5) The national energy inspection shall inform the applicant of the organisation of the training action of the inclusion or non-inclusion of the training action in continuous training no later than 7 calendar days after the meeting of the expert committee. At the same time, it shall inform the applicant of the number of credits allocated to the training action by the expert committee and communicate the action number allocated by the system through the Ministry's records of the activities carried out by the energy specialist.
(6) The thresholds for the allocation of credits for the educational action are set out in Annex 7 to this Decree.
(7) The criteria for evaluating educational actions are:
(a) the thematic scope of the training action;
(b) the content of the lectures and the professional focus of the organiser;
(c) the duration of the training action; the minimum duration of the training event is at least 6 hours; and
(d) the hourly financial cost of organising the educational event.
Expert Commission
(Paragraph 10a (3) and (5) of the Act)
(1) The selection of educational actions for continuous education and the allocation of the number of credits on the basis of the criteria referred to in Article 6 (7) shall be entrusted to the expert committee.
(2) The Panel of Experts must have at least 7 members, of which 1 shall be appointed chairman and at least 2 other members shall be appointed Vice-Presidents. The Central Director of the State Energy Inspection shall appoint members on the basis of professional qualifications and professional experience linked to the activities of energy specialists and shall at the same time withdraw them.
(3) The Panel of Experts is capable of quorum in the presence of at least 7 members, of which 1 is the President, and if the Vice-President is not present or is authorised to do so, the Vice-President of the Commission.
(4) The deliberations of the Panel of Experts shall be managed by the chairman of the Panel, if not present, by an authorised Vice-President.
(5) The Secretary shall convene the expert committee at least twice a year.
(6) The Committee of Experts shall act by a majority of the members present to take part in the training. In the event of a tie, the vote of the President or Vice-President shall be taken.
(7) Minutes shall be taken from the meetings of the expert committee. The minutes shall be drawn up by the Secretary and signed by all members of the Panel. The model of registration is set out in Annex 8 to this Order.
Scope of data transmitted to the Ministry's register on the activities carried out by the energy specialist

The data transmitted by the energy specialist to the Ministry's records on the activities carried out by the energy specialist are set out in Annex 9 to this decree.
Repeal
They shall be deleted:
1. Decree No. 118 / 2013 Coll., on Energy Specialists.
2. Decree No. 234 / 2015 Coll., amending Decree No. 118 / 2013 Coll., on Energy Specialists.
Efficacy
This decree shall take effect on the 15th day following its publication.
