DECLARATION
of 6 October 2025
amending Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended
The Ministry of Health provides, pursuant to Section 120 of Act No. 372 / 2011 Coll., on Health Services and Conditions of Provision (Health Services Act), as amended by Act No. 65 / 2017 Coll. and Act No. 290 / 2025 Coll., for the implementation of Section 11 (4) of the Health Services Act:
Decree No. 99 / 2012 Coll., on minimum staff security requirements for health services, as amended by Decree No. 287 / 2013 Coll., Decree No. 285 / 2017 Coll., Decree No. 304 / 2019 Coll., Decree No. 357 / 2020 Coll., Decree No. 340 / 2022 Coll., Decree No. 393 / 2023 Coll. and Decree No. 116 / 2025 Coll., are amended as follows:
1. In Annex 3, Part I, the following sentence is added at the end of point 11 to the new line: "Where subsequent bed care is provided exclusively to children who are classified according to the complexity of the nursing care provided to them in the category of patient 1, 2 or 3 under another legislation18), the availability of a physician with specialised competence with a common primary paediatric strain is ensured; the requirement under (a) or (b) shall not apply. ';
2. In Annex 3, Part I, point 12, the words "on hospice beds and at the centre of comprehensive childcare 'shall be inserted after the words" social-health care'.
3. In Annex 3, Part II, point 4.4, of the Introductory Part of the provision, the words "anaesthesiologist, intensifier, surgeon, intern or neurologist 0,05," shall be replaced by a colon.
4. In Annex 3, Part II, point 4.4, the following point (a) is inserted:
"(a) anesthesiologist, intensifier, surgeon, intern or neurologist, 0.05,"
Points (a) to (e) shall be renumbered (b) to (f).
5. In Annex 3, Part II, the following points 4.4.1 and 4.4.2 are inserted after point 4.4:
"4.4.1. If it is about providing long-term intensive nursing care for basic life functions to children, the staff security is as follows:
(a) a pediatrician or a pediatrician of 1,0 time for work and 0,05 time for bed;
(b) a doctor with a competence of 0,05 per bed, of which 50% per day a doctor with competence with a certificate of completion of the primary paediatric strain;
(c) a child nurse for intensive care of 1.0 working time and also 0.25 bed time,
(d) a nurse of the child, a nurse of the general or a nurse of the practitioner of 0,75,
(e) a physiotherapist without supervision of 0,12 bed rest;
(f) a clinical psychologist, 0,2 working time,
(g) an orderly or a nurse, 1,5 days per bed,
h) clinical logged - availability,
(i) surgeon or pediatric surgeon - availability,
(j) paediatric neurologist - availability.
The availability of a health-care worker or another professional - social worker is ensured.
Health care provided on working days from 15.30 to 7.00 on the following day and on Saturdays, Sundays and holidays is provided by a pediatrician or pediatrician for a maximum of 15 beds.
4.4.2. If it is about providing long-term intensive nursing care to children whose medical condition requires artificial pulmonary ventilation, staff security is as follows:
(a) an intensive person with specialised competence in the field of pediatrics, pediatric medicine or pediatric surgery or an anesthesiologist of 1,0 time for work and 0,1 time for bed,
(b) a doctor with a professional competence with a certificate of completion of the basic paediatric strain of 0.1 bed rest;
c) a child nurse for intensive care of 1.0 working time and 0.4 bed time,
(d) a nurse of the child, a nurse of the general or a nurse of the practitioner of 1.2 bed rest;
(e) a physiotherapist without supervision of 0,12 bed rest;
(f) a clinical psychologist, 0,2 working time,
(g) an orderly or a nurse of 1,0 bed rest;
h) clinical logged - availability,
(i) surgeon or pediatric surgeon - availability,
(j) paediatric neurologist - availability.
The availability of a health-care worker or another professional - social worker is ensured.
Health care provided on working days from 15.30 to 7.00 on the following day and on Saturdays, Sundays and holidays is provided by an intensive person with specialised fitness in the field of pediatric medicine, pediatric medicine or pediatric surgery, or by an anesthesiologist for a maximum of 15 beds. '
6. In Annex 3, Part II, point 4.5 (a), the words "otorinolaryngological, ophthalmological," are deleted.
7. In Annex 3, Part II, point 4.5 (a):
"(a) a doctor with special specialised competence in palliative medicine, a doctor with special competence or a specialist competence in the field of long-term care medicine or an algeziologist of 0,2 time,"
8. In Annex 3, Part II, point 4.5 (d), the words "without supervision and general nurse or medical assistant 'are replaced by the words" or practical nurse'.
9. In Annex 3, Part II, point 4.5 (e), "4,0 'is replaced by" 5,0' and "a 'is replaced by a comma.
10. In Annex 3, Part II, point 4.5, at the end of point (f), the dot is replaced by a comma and the following point (g) is inserted:
'(g) a health-care worker or another professional - a social worker of 0,5 commitment.';
11. In Annex 3, Part II, point 4.5, the sentence "No care of a social worker or other professional worker shall be required 'is deleted.
12. In Annex 3, Part II, the following point 4.5.1 is inserted after point 4.5:
"4.5.1. If palliative care is provided to children, personnel security is as follows:
(a) a physician with specialised competence with a basic paediatric strain of 0,5,
(b) a doctor with a competence of 1,2 hours;
(c) a nurse with a specialised competence of 1,0 time;
(d) a nurse of a child or a nurse of a general nurse of 6,0 time;
(e) an orderly or a nurse of 5,0 time;
(f) a paediatric clinical psychologist or a clinical psychologist of 0,2 time;
(g) health-care worker or other professional worker - social worker 0,5 allowance,
h) physical therapist without supervision - availability,
i) ergotherapy without supervision - availability,
(j) clinical logoped - availability. '
13. In Annex 3, Part II, the following point 6 is inserted after point 5:
"6. HOSPIC
Part II, points 4.5 and 4.5.1 of this Annex shall apply mutatis mutandis to the requirements for staff security of health services in the hospice. ';
14. In Annex 10, point 1, at the end of point (a), the comma is replaced by "a 'and points (b) and (c) are deleted.
Point (d) shall be renumbered (b).
15. In Annex 10, point 1 (b), the words "for urgent medicine 'are deleted.
16. In Annex 11, point 1, in the final part of the provision, "0,5 'is replaced by" 0,2'.
17. In Annex 11, point 2, in the final part of the provision, "0,3 'is replaced by" 0,2'.
18. The following Annex 12 is added:
"Annex No 12
Requirements for the staffing of a comprehensive childcare centre
The staff requirements for health services in the centre of comprehensive childcare are as follows:
(a) a pediatrician, a pediatrician or a physician for children and a child of 0,2 years;
(b) a doctor with a professional competence with a certificate of completion of the basic paediatric strain 0,3 time;
(c) a nurse of a child or general nurse of 9.0, of which a nurse of at least 2.0,
(d) an orderly or a nurse of 5,0 time;
(e) a physiotherapist without supervision of 1,0 time;
(f) a paediatric clinical psychologist or a clinical psychologist of 0,2 time;
(g) clinical logoped - availability
(h) a health-care worker or another professional - a social worker - 0,5 allowance.
The requirements shall be laid down for a workplace with a maximum of 15 beds, including personnel security of provision of stationary care and health care in the patient's own social environment. ';
Efficacy
This Decree shall take effect on 1 January 2026, with the exception of Article I (7), which shall take effect on 1 January 2031.
