DECLARATION
of 27 November 2013
amending Decree No. 329 / 1997 Coll., implementing § 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for starch and starch products, leguminous and oil seeds, as amended by Decree No. 418 / 2000 Coll.
The Ministry of Agriculture provides, pursuant to Article 18 (1) (a), (b), (g) and (h) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 119 / 2000 Coll., Act No. 306 / 2000 Coll., Act No. 146 / 2002 Coll., Act No. 274 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 120 / 2008 Coll.:
This decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended.
Decree of the Ministry of Agriculture No. 329 / 1997 Coll., implementing § 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for starch and starch products, leguminous and oil seeds, as amended by Decree No. 418 / 2000 Coll., is amended as follows:
1. In the title and in the introductory sentence, "§ 18 (a), (d), (h), (i), (j) and (k) 'is replaced by" § 18 (1) (a), (b), (e), (f), (g) and (h)'.
2. In Article 3 (1) of the Introductory Part of the Provisions, in Article 7 (1) of the Introductory Part of the Provisions and in Article 11 (1) of the Introductory Part of the Provisions, the words "Special Declation1) 'are replaced by the words" Order on the labelling of foodstuffs 2)'.

footnote 1 is deleted.
3. In Article 3 (3), the words "5% by weight of chocolate, the chocolate being allowed to replace with cocoa matter, cocoa, defatted cocoa with or without added cocoa butter, but the content of defatted cocoa powder must correspond to at least 5% by weight of chocolate 'are replaced by the words" 20% by weight of defatted cocoa powder'.
4. In Article 5 (j), "soya protein 'is replaced by" food'.
5. In Section 5, the words "or other leguminous vegetables, cereals or their combinations' shall be added at the end of the text in point (k).
6. In Article 5, at the end of point (k), the dot is replaced by a comma and the following points (l) to (n) are added:
"(l) natto - soy product fermented soy product,
(m) soy sauce - fermented soy bean sauce or mixture of soya beans and wheat;
(n) miso-soya-bean product fermented soya bean paste or a mixture of soya beans and other cereals. ';
7. In Article 12, the following paragraph 4 is added:
"(4) Only seed of poppy seed (Papaver somniferum L.) of the seed, oil type, originating in varieties containing a maximum of 0,8% of morphine alkaloids in dry matter capsules (poppy seed) may be used for food use and on the surface of poppy seed there is no more than 25 mg / kg. '
8. Annex 4 shall read as follows:

Transitional provision
Foodstuffs labelled according to Decree No. 329 / 1997 Coll., as effective before the date of entry into force of this Order, may be put into circulation no later than 1 July 2014. Foods put into circulation before that date may be sold until stocks are sold out.
Efficacy
This Decree shall take effect on 1 January 2014.
