DECLARATION

amending Decree of the Ministry of Agriculture No. 286 / 1999 Coll., implementing the provisions of Act No. 166 / 1999 Coll., on Veterinary Care and on the Amendment of Certain Related Laws (Veterinary Act), on Animal Health and Protection, on the animal health conditions of import, export and transit of veterinary goods, on veterinary rendering and on attestation studies
The Ministry of Agriculture provides pursuant to § 41 (4) of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act):
Decree No. 286 / 1999 Coll., implementing the provisions of Act No. 166 / 1999 Coll., on Veterinary Care and amending certain related acts (Veterinary Act), on animal health and protection, on animal health, on animal health conditions of import, export and transit of veterinary goods, on veterinary rendering and on attestation studies, shall be amended as follows:
1. in Article 17 (1) (b), the following point 6 is added:
"6. are dangerous with regard to the transmission of spongiform encephalopathy of bovine (BSE) or scrapie, which are skulls including the brain and eyes, neck almonds and spinal cord of bovine animals older than 12 months and intestines from the duodenum to the rectum of bovine animals of all ages, skull including the brain and eyes, neck almonds and spinal cord of ovine and caprine animals older than 12 months or having cut incisors and spleen of ovine and caprine animals of all ages (hereinafter" specified risk material "); taking into account the new knowledge of veterinary medicine and the new requirements applied in the context of cooperation with foreign veterinary services and relevant veterinary organisations, the Ministry of Agriculture may, on a proposal from the State Veterinary Administration, identify and publish in the Ministry of Agriculture Bulletin that certain other parts of the animals' bodies are considered to be very dangerous confiscates of animal origin which are considered to be specified risk material. ';
2. in Article 17 (1), point (c) shall be deleted;
3. Paragraph 17 (2) reads as follows:
"(2) The specific risk material shall be dyed after the veterinary examination at the slaughterhouse; in other cases, it shall be dyed after it has been obtained. The colour must be clear even after processing this material in the rendering plant. '
4. In Article 17, paragraphs 3 to 6 are added, including footnote 4a):
"(3) Specified risk material shall be transported and processed separately from other very dangerous confiscates of animal origin.
(4) Very dangerous confiscates of animal origin shall be processed by heat treatment at a temperature of at least 133 ° C and a pressure of 3 bar (absolute) for at least 20 minutes, the particle size prior to treatment not exceeding 50 mm. The resulting product of processing specified risk material shall be removed by burial in a burial site or by incineration in a incineration plant or co-incineration plant approved for that purpose under a specific legislation. (4a) In the burial, incineration or co-incineration of the obtained product from specified risk material, the veterinary authorities shall comply with the veterinary legislation.
(5) If, for any reason, there is doubt as to whether the very dangerous confiscates of animal origin have been sufficiently sorted, the whole quantity shall be considered as specified risk material which must be burned or buried after heat treatment.
(6) Records of the time of heat treatment, temperature and pressure of very dangerous confiscates of animal origin shall be kept for at least 2 years. Records of the time of heat treatment, temperature, pressure and method of disposal by burning or burying specified risk material shall be kept for at least 7 years.
(4a) Paragraph 11 (1) (f) of Act No. 309 / 1991 Coll., on the Protection of Air from Pollutants (Air Act), as amended. '
This decree shall take effect on the day of its publication.
