DECLARATION
of 11 November 2003
determining the general import licence on the basis of which imports of controlled goods into the Czech Republic can be effected (General Import Licence Order)
The Ministry of Industry and Trade (hereinafter referred to as the Ministry) provides, pursuant to Article 16 (2) of Act No. 21 / 1997 Coll., on the control of exports and imports of goods and technology subject to international control regimes, as amended by Act No. 204 / 2002 Coll., (hereinafter referred to as the Act):
Subject matter
§ 1
On the basis of this general import licence, it is possible to import to the Czech Republic controlled goods, which mean dual-use items, including software and technology subject to the control regime under the law, (1) listed in the list of controlled goods provided for in the specific legislation, (2) with the exception of controlled goods listed in Annex 1 ("List of controlled goods which cannot be imported under the general import licence ').
Conditions under which imports of controlled goods may be made
§ 2
Imports of controlled goods into the Czech Republic pursuant to § 1 may be made only under the conditions that:
(a) not used in conjunction with the development, manufacture, loading, operation, maintenance, storage, accumulation, detection, identification or distribution of chemical or biological weapons, nuclear weapons or other nuclear explosive devices, or the development, manufacture, maintenance or storage of missiles capable of carrying such weapons, for military or terrorist purposes;
(b) when handling it, the provisions of the Act on the General Obligations of Importers and Users, including the fulfilment of the obligation to notify the customs authorities, at the latest at the time of the initiation of the customs procedure, that they are controlled goods and to indicate in the prescribed manner this fact in the customs documents;
(c) where such goods are transferred to another user, the importer shall indicate in the commercial documents that they are controlled goods subject to the legal regime of the law and have been imported under this general import licence and the conditions laid down therein; this condition also applies to other user changes,
(d) in the case of re-export of imported controlled goods on the basis of this general import licence, it shall be carried out in accordance with the statutory conditions for export of controlled goods;
(e) if the subject of imports of a chemical identified in the list of controlled goods provided for in the specific legislationm2) by code 1C350 with order numbers 1 to 3.5 to 9, 11 to 13, 17 to 19, 21, 22, 26 to 28, 30 to 36, 38, 46, 51, 52 and 53 and by code 1C450, the importer shall submit to the Ministry by 15 January at any time.
1. the report on the implementation of imports of these goods for the previous calendar year, in accordance with the model set out in Annex 2;
2. summary data on changes in users of these goods in the Czech Republic for the previous calendar year, in accordance with the model set out in Annex 3,
(f) the written registration of the importer is valid and the particulars contained therein correspond to the actual legal situation.
§ 3
Order No 44 / 1997 Coll., issuing the general import licence for controlled goods, is hereby repealed.
§ 4
This decree shall take effect on the day of its publication.
