DECLARATION
of 7 November 2003
laying down detailed conditions for the composition and repayment of the bail-out and the reimbursement of the election fee in connection with the holding of elections to the Parliament of the Czech Republic
The Ministry of Finance provides pursuant to § 92 paragraph 2 of Act No. 247 / 1995 Coll., on Elections to Parliament of the Czech Republic and on the amendment and amendment of certain other laws, as amended by Act No. 204 / 2000 Coll. and Act No. 37 / 2002 Coll.:
(1) The Regional Authority and the City Council of the City of Prague (hereinafter referred to as the Regional Office) in connection with the election to the Chamber of Deputies of the Parliament of the Czech Republic (hereinafter referred to as the Chamber of Deputies) and the entrusted municipal office in the headquarters of the constituency of the capital of Prague (hereinafter referred to as the "Regional Office of the City of Prague") in connection with the election of the Parliament of the Czech Republic (hereinafter referred to as the "Senate") establish a special account with the Czech National Bank pursuant to Annexes 1 and 2 to this Decree (hereinafter referred to as "Special Account"). The notice of the establishment of a special account shall be published on the official record of the relevant regional or municipal office at the headquarters of the constituency.
(2) In the context of holding elections to the Chamber of Deputies, a political party, a political movement or a coalition shall deposit money in an established special account equivalent to a specified contribution to electoral costs. 2) At the same time as the submission of the nomination3), the Regional Office shall communicate in writing the address or account number to which the election allowance may be refunded.
(3) In the context of holding an election to the Senate, the funds shall be deposited in an established special account equivalent to the deposit provided for. (4) The independent candidate and agent of a political party, political movement or coalition with registration application (5) shall communicate in writing the address or account number to which bail can be refunded to the entrusted municipal office in the constituency.
(4) The composition of the election allowance shall be identified by a variable symbol identical to the political party identification number or political movement under the basic registry law and, in the case of a coalition, by a variable symbol identical to the political party identification number or political movement which the members of the coalition agree to identify.
(5) The composition of the deposit is marked with a variable symbol identical to the candidate's birth number.
(6) A constant symbol 558 shall be used for the cashless composition of the contribution to electoral costs and bail. A constant symbol 379 shall be used for the composition of the contribution to electoral costs and cash bail.
(1) Amounts which are not refunded in connection with the holding of the elections and interest on the compound contributions to the election costs and on the deposits, minus the amounts of the prices debited by the Czech National Bank from the special account, will be transferred to the State Budget income account (1) held with the Czech National Bank, account number 772-5921001 / 0710, indicating the year of the election in the variable symbol. At the same time as the transfer of funds to the account of the State Budget will be sent to the Ministry of Finance.
(2) The Regional Office and the entrusted municipal office at the headquarters of the constituency, which shall set up a special account in accordance with Paragraph 1 (1), shall account for the deposited funds in account 245 - Other current accounts and the current account set up by it for the current account of special funds, with a similar entry in account 378 - Other short-term liabilities. An analysis account shall be set up to account 378 for the contribution to election costs according to the identification number of each political party or political movement and, in the case of a coalition of that political party or political movement which the members of the coalition agree to, and for bail-outs broken down by the natural number of candidates.
(3) In the case of refunds, the Regional Office shall, in the case of contributions to electoral costs and the entrusted municipal office at the seat of the constituency in the case of refunded bail-outs, account shall be taken of the funds and amounts which are the revenue of the state budget and shall, within one month of the announcement of the results of the election7, transfer them to the State Budget revenue account referred to in paragraph 1 and cancel the special account with the Czech National Bank.
Decree No. 85 / 2002 Coll., laying down detailed conditions for the composition and repayment of bail and the composition and reimbursement of the election allowance in connection with the holding of elections to the Parliament of the Czech Republic, is hereby repealed.
This Decree shall take effect on 1 December 2003.
