DECLARATION
of 15 December 2023
amending Decree No. 418 / 2001 of the Ministry of Justice Coll., on procedures for execution and other activities, as amended
The Ministry of Justice provides, pursuant to Articles 49 (5) and 131 (1) (g) of Act No. 120 / 2001 Coll., on judicial executors and enforcement activities (Enforcement Regulations) and amending other laws, as amended by Act No. 286 / 2021 Coll.:
Decree No. 418 / 2001 Coll., on procedures for execution and other activities, as amended by Decree No. 463 / 2009 Coll., Decree No. 491 / 2012 Coll., Decree No. 149 / 2013 Coll., Decree No. 365 / 2014 Coll., Decree No. 461 / 2017 Coll., Decree No. 264 / 2021 Coll. and Decree No. 517 / 2021 Coll., is amended as follows:
1. The heading under the heading § 4 is deleted.
2.
(1) The application form of the executor for cooperation pursuant to Article 34 (4) of the Act contains:
(a) the designation of the executor, indicating his registered office and other particulars;
(b) the designation of the person requested by the executor to cooperate;
(c) an indication of the creditor and the debtor;
(d) the designation of the enforceable title and the authority which issued it or the person who prepared it;
(e) the description of the execution procedure by the file mark under which it is kept and the indication of the mandate of the executor;
(f) the information required by Article 33 (5) of the law;
(g) data other than those referred to in point (f) necessary for the execution and justification of the need for the provision of such data;
(h) information relating to the execution procedure;
(i) date and signature.
(2) The reply form to the application by the Executive Director for synergies referred to in paragraph 1 shall contain:
(a) the designation of the person giving the executor synergies;
(b) the designation of the executor, indicating his registered office;
(c) the compulsory designation,
(d) the designation of the enforcement procedure by the file mark under which it is kept;
(e) the information required by Article 33 (5) of the Act,
(f) particulars other than those referred to in point (e) necessary for execution;
(g) date and signature.
(3) The format and structure of the data file containing the forms referred to in paragraphs 1 and 2 are set out in Annex 2 to this Regulation. The model forms referred to in paragraphs 1 and 2 shall be as set out in Annex 7 to this Order. ';
3. In Paragraph 5a (1), "the designation of the obligation to be recovered by execution 'is replaced by" the order of recovery' and "2 'is replaced by" 3'.
4. In Paragraph 5a, the following paragraph 2 is inserted after paragraph 1:
"(2) The format and structure of the data file, which is annexed to the execution order, an annex to the notification that the conditions laid down in Article 52 (3) of the Act have been met, or an annex to the resolution amending or repealing the execution order, if the execution is carried out by deductions from wages and other income paid by the payer of the salary or other income, and the data file by which the qualified payer of the salary or other income communicates to the executor of the order of recovery, are amended in Annex 2 to this decree, unless otherwise specified in paragraph 1."
Paragraph 2 shall become paragraph 3.
5. In Article 5a (3), the words "and the annex to the notice that the conditions laid down in Article 52 (3) of the Law have been met 'are replaced by the words", the Annex to the notice that the conditions laid down in Article 52 (3) of the Law have been met, or the Annex to the Resolution amending or repealing the enforcement order', the words "account numbers and the amount of funds covered by the prohibitions under Article 304 (1) and (3) of the Civil Code and the designation of the obligation to be recovered 'are replaced by the words" the order of recovery' and the words "Annex No 3 'are replaced by the words" Annex 4'.
6. In Article 5b (1) and (3), "5 'is replaced by" 6'.
7. In Article 6, the following paragraph 4 is added:
"(4) The form contains a certificate of personal, property and earnings ratios pursuant to Paragraph 55 (10) of the Act,
(a) where it is authorised by a natural person, in particular:
1. the identification of the enforcement proceedings by the file mark under which it is kept,
2. an indication of the creditor and an indication of his personal circumstances,
3. an indication of the family status of the creditor,
4. an indication of the beneficiary's income,
5. Indication of the property of the creditor,
6. the indication of the spouse, partner or partner of the creditor, the details of his or her income and property,
7. an indication of the eligible debts and expenditure,
8. Other information which might have an impact on the relief from the deposit on the costs of execution,
9. Date and signature,
(b) where the legal person is entitled, in particular:
1. the identification of the enforcement proceedings by the file mark under which it is kept,
2. the authorised designation,
3. an indication of the property ratios of the creditor;
4. Reason for lodging an application for exemption from the deposit for further execution,
date 5 and signature. '
8. Article 6a is deleted.
9. In Paragraph 10a (2), "4 'is replaced by" 5'.
10. in Article 10b (1), the words "the files referred to in Article 10c (1) and the submission report" shall be inserted after the words "submit."
11. in Article 10b (2) and (3):
"(2) The electronic file of the executor shall be submitted electronically by electronic application.
(3) If it is not technically possible to submit the electronic file in accordance with paragraph 2, the executor shall submit the electronic file
(a) through the public data network to the data box; the data message sent shall show that it is an electronic file, or
(b) on a fixed data medium. ';
12. In Paragraph 10b, the following paragraph 4 is inserted after paragraph 3, including footnote 4:
"(4) Each document shall be stored in a separate file in a permissible data format. The permissible data format is the permissible format of the data message delivered to the data box according to the regulation governing the use and operation of the data box information system nek4) or the proprietary format of documents created by office applications.
4) Decree No. 194 / 2009 Coll., establishing details of the use and operation of the data box information system, as amended. '
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
13. in Article 10b (5), "guaranteed" is replaced by "qualified."
14. in the first sentence of Paragraph 10c (1), the words "To the directory with an electronic file shall be attached" shall be replaced by the words "In the directory with an electronic file shall be presented" and in the last sentence the word "k" shall be replaced by "v."
15. At the end of the text of § 10d, the words "(hereinafter referred to as" the supervisory authority ") shall be added, unless otherwise agreed by the executive with the supervisory authority '.
16. in Article 16a (2) (b), the word "or" shall be deleted;
17. In Article 16a, at the end of paragraph 2, the dot is replaced by "or 'and the following point (d) is added:
"(d) by means of a qualified electronic identification system under the Electronic Identification Act (5).

18. At the end of the title of Annex No 1, the words "- money institution 'are added.
19. The following Annex 2 is inserted after Annex 1:

Format and structure of the data file containing the request for synergy, reply to the request for synergy, information on the execution order and on the notification of execution - wage payer or other income
This Annex sets out the definition of the data contained in the data file accompanying the request for synergies addressed to the wage payer (Section 34 (4) of the Act), the reply of the wage payer to the request for synergies (Section 34 (4) of the Act), the execution order or the resolution on the amendment or cancellation of the enforcement order (Section 49 (3) of the Act), the notification that the conditions laid down in Section 52 (3) of the Act have been met and the communication of the wage payer following the receipt of the enforcement order (Section 49 (3) of the Act) as well as the rules for the transmission of the data itself.
1. General rules for data files
a) Data file uses XML syntax (eXtensible Markup Language).
b) The file is encoded in UTF-8.
c) For element and attribute names it is necessary to distinguish large and small letters.
(d) One dataset shall correspond to one request for synergy addressed to the wage payer concerning one debtor - the payee or the salary payee, one reply from the payee concerning one payee - the payee, one execution order and one debtor - the payee or salary, or one communication from the payee following receipt of the execution order concerning one payee.
(e) The name of the data file accompanying the request for synergy addressed to the payer of the salary consists of the following:

(f) The data file shall always be sent together in a single data message with an electronic copy of the request for co-operation addressed to the payer of the salary, the reply of the payer to the request for co-operation, the execution order, the communication of the payer of the salary after receiving the execution order, the notification that the conditions laid down in Article 52 (3) of the Act have been met, or the resolution amending or repealing the execution order.
g) The data file complies with the xsd definition published by the Executive Chamber in a way that allows remote access.
2. Transmission of data
The data exchange between the court executor and the salary payer will take place through the Data Box Information System (ISDS).

20. At the end of the title of Annex 3, the words "- Czech Social Security Administration and the Labour Office of the Czech Republic" are added.
21. In Annex 3, point 1 (g), the words "of any format, containing at least information on the enforcement obligations (as specified by the consignor in accordance with point 3 (i) of this Annex) and the reference number of the instrument of acceptance which they confirm 'are replaced by the words" of the format referred to in point 7'.
22. The following point 7 is added at the end of Annex 3:

This Decree shall take effect on 1 January 2024.
