laying down work on isolated and short-term exposure to asbestos and the procedure for determining the isolated and short-term exposure to such work
The Ministry of Health provides pursuant to § 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws, as amended by Act No. 392 / 2005 Coll., ("the Act ') for the implementation of § 41 (1) of the Act:
Preliminary provisions
This decree incorporates the law of the European Communities (1) and provides for work on isolated and short-term exposure to asbestos and the procedure for determining the unique and short-term exposure to such work.
Working with isolated and short-term asbestos exposure
(1) Work with isolated and short-term exposure to asbestos under the conditions of § 3
(a) related to the maintenance of non-contiguous and short-term materials in which only non-droid materials are used;
(b) linked to the removal of undisturbed and non-hazardous materials in which asbestos is firmly embedded in the binder; or
(c) when encapsulating materials containing asbestos or covering them with asbestos release protectors.
(2) Measurement of asbestos concentrations in the air and sampling of materials to determine the presence and concentration of asbestos shall be considered as working with a unique and short-term exposure.
Procedure for determining isolated and short-term exposure to asbestos
The work referred to in Paragraph 2 (1) shall be considered to be work with an isolated and short-term exposure to asbestos, provided that the risk assessment and the determination of exposure to asbestos workers under conditions of work indicate that the permissible exposure limit (2) will not be exceeded. The results of the measurement of asbestos concentration in the working air previously carried out at other workplaces may be used for similar types and conditions of work and similar materials containing asbestos.
Efficacy
This decree shall take effect on the day of its publication.
