DECLARATION
of 24 June 2004
adjusting the details of the performance test, the tests to be issued for the medical profession without professional supervision, the final examinations of the accredited qualification courses, and the probation tests and the test schedule for those examinations
According to § 90 (2) (a) and (b) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical health professions and for carrying out activities related to the provision of health care and amending certain related laws (Law on non-medical health professions):
INTRODUCTORY PROVISIONS
Subject matter
This decree, in accordance with the law of the European Community1) regulates the content, course and evaluation of the
1. testing tests to obtain specialised competence for the performance of the non-medical medical profession (2),
2. tests for the verification of competence for the non-medical medical profession without specialised supervision (3);
3. the final examination of the accredited qualification course to obtain competence for the performance of the non-medical medical profession (4); and
4. and probation examinations to obtain eligibility for the non-medical medical profession in the territory of the Czech republity5) health professionals who have acquired professional competence outside the Member States of the European Union.
ATESTATION TEST
Division Attestation Commission
(1) The test shall be carried out before the Ministry of Health, hereinafter referred to as "the Ministry." The Trade Commission (hereinafter referred to as the "Association Committee ') has an odd number of members, but at least three members. The members of the Committee shall elect a chairman from among its members who shall direct and be responsible for the work of the Committee. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
(2) The test is only publicly accessible to health practitioners (6), except for advice on the outcome of the test or part thereof, which is not public.
(3) At the meeting on the result of the test or part of the test committee, it shall decide by public vote.
Application to the test
(1) Applications for testing shall be submitted to the Ministry. The correctness of the data provided in the application is confirmed by the trainer and statutory representative of the accredited establishment (7) in which the training programme is carried out.
(2) If a candidate has acquired professional or specialised competence to pursue a medical profession abroad or in the Czech Republic in accredited medical study programmes with a language other than the Czech language (8), he shall add to the application a copy of the decision on the recognition of a medical profession in the Czech Republic (9).
(3) If candidates have been counted by the Ministry, part of the previously completed study or technical praxe10), they shall add a copy of the Ministry's decision to the application for the test test.
(4) Where there is doubt as to the authenticity of the signature or stamp, an officially certified copy of the documents referred to in paragraphs 2 and 3 may be required.
Presumption for carrying out the test
All requirements laid down by the relevant training programme, including successful completion of the test, shall be fulfilled if the training programme so provides.
Date and place of the test
(1) The test shall take place at least twice a year within the time limits set by the Ministry. Those candidates whose applications have been delivered to the Ministry at least 50 days before the examination date are included in the deadline.
(2) The applicant must be placed on the date of the test run no later than eight months after the date of receipt of the application to the Ministry. The date and place of the test shall be determined by the Ministry and notified at least 40 days before the date of the test, to all tenderers who submitted an application for the test referred to in Article 3 and who fulfilled the conditions set out in Article 4.
Content, course and evaluation of the test
(1) The test shall consist of a theoretical and practical part; the practical part does not take place in the field of specialist education of organisation and management in health care. The practical part of the testing test, which consists in the verification of professional practical skills, is preceded by theoretical parts of the test test. The content of the test test is determined by the appropriate training programme.
(2) Before the start of each part of the test, the tenderer shall demonstrate his identity.
(3) The test shall normally be carried out on one day. The practical part of the test may be carried out within another period prior to the date of the theoretical part of the test. If the practical part of the test test is evaluated "failed ', the theoretical part of the test test is not continued and the overall evaluation of the test test is" failed'.
(4) The theoretical part of the test is composed of three questions. Questions from the theoretical part shall be drawn and recorded in the test report. Once the questions have been drawn, the testing committee shall give the candidate a reasonable time to prepare the answers, but at least 15 minutes.
(5) The result of each part of the test test referred to in paragraph 1 and the overall evaluation of the test test shall be evaluated by the word "benefit 'or" benefit'.
(6) If a partial question of the theoretical part of the test test is classified as "failed ', the overall assessment of the test test is" failed'.
(7) The evaluation of individual parts of the test and the overall evaluation of the test shall be recorded in the test report. Only a successfully completed test shall be recorded in the proficiency certificate. The total result of the evaluation of the test test shall be announced by the test committee after consultation of the result of the test test.
Non-participation in the test, withdrawal and repetition of the test
(1) If the candidate cannot attend the test test by the date for which he was invited, he must excuse his absence to the Ministry. An apology shall be deemed to be a written apology received by the Ministry before the date of the test and, in the case of a serious reason, a written apology received by the Ministry after the date of the test if it was carried out immediately as soon as the serious reason for the failure to participate has ceased. Withdrawal from the practical or theoretical part of the test shall also be considered an apology before the test is started. In the event of an apology, the applicant may apply for the test test within the next deadline, including the dates already announced, if possible for organisational reasons.
(2) Withdrawal from the test run after the question has been drawn or in the course of which "failed 'is assessed.
(3) If the candidate does not show up for the test without an apology, he shall be deemed not to have benefited from the test.
(4) If the candidate is "not successful ', he may pass the test at least 12 months after the date of the invitation.
(5) Candidates who have successfully carried out only a practical part of the test are recognised in the repeat of the test if it is repeated within 24 months of the day of the practical part of the test.
TEST FOR VERIFICATION OF ELIGIBILITY FOR THE PERFORMANCE OF NON-MEDICAL HEALTH PERFORMANCE WITHOUT COMPETENT SUPERVISORY
Test Panel
(1) The examination for the verification of competence for the non-medical medical profession, without professional supervision (hereinafter referred to as the "certification test"), shall take place before the Examination Committee of the Ministry. At least 4 permanent members of the examination committee (11), at least 1 representative of the Ministry, at least 1 representative of the accredited equipment7), at least 1 representative of the employers' organisation and at least 1 representative of the health profession covered by the examination, and, in the case of the assessment of specialised competence, also a healthcare professional with specialised competence in the relevant specialisation field. Other members of the examination committee (11) shall also be entitled to participate in the examination for the issue of a certificate with a vote of decision. The activities of the Examination Board shall be managed by a representative of the Ministry and shall be responsible for it.
(2) The certification test is only publicly accessible to healthcare professionals (6), except for advice on the outcome of the examination or part thereof, which is not public.
(3) The panel shall decide on the outcome of the examination for the issue of the certificate or part thereof by public vote. In the event of a tie, the vote of the representative of the health profession to which the test relates shall be decided.
Application for certification test
Applications for certification tests shall be submitted to the Ministry.
Date and place of test for certification
The applicant shall be included at the date of the examination to issue the certificate no later than four months after the date of receipt of the application to the Ministry. The date and place of the examination for certification shall be determined by the Ministry and notified at least 40 days before the date of the examination to those tenderers who have applied for the test referred to in Article 9 at least 50 days before the date of the examination.
Content, course and assessment of the certification test
(1) The certification test shall consist of a theoretical and practical part and shall take place on one day. The examination committee shall verify the fitness to perform the non-medical medical profession without professional supervision in accordance with the latest knowledge in the field.
(2) Before the start of each part of the certificate examination, the tenderer shall demonstrate his identity.
(3) If the applicant demonstrates a sufficient period of time for the medical profession provided for by special legislation12), he shall only take the theoretical part of the examination. If the tenderer demonstrates a sufficient number of lifelong learning credits provided for by special legislation12), he shall only take a practical part of the examination.
(4) The theoretical part of the test consists of two questions. Questions from the theoretical part of the test shall be drawn and recorded in the test report. If a candidate requests a certificate of specialised competence, he also draws a question from the relevant specialisation field. The list of questions shall be received by the applicant no later than 20 days before the date of the examination. Once the questions have been drawn, the examination committee shall give the candidate a reasonable time to prepare, but not less than 15 minutes.
(5) In the practical part of the examination of the test panel, the Commission will examine in the accredited equipment7), which it will determine, the practical skills of the candidate.
(6) The result of each part of the test referred to in paragraph 1 and the overall assessment of the test shall be evaluated by the word "benefit 'or" benefit'.
(7) If a partial question of the theoretical part of the test or the practical part of the test is classified "failed ', the overall assessment of the test is" failed'.
(8) The evaluation of the individual parts of the test and the overall assessment of the test shall be recorded in the test report. Only successfully completed testing shall be recorded in the proficiency certificate. The overall test evaluation result shall be announced by the examination panel after consultation of the test result for certification.
Repeating the certification test
A candidate who has successfully performed only a practical or theoretical part of the test shall be recognised at the time of the repeat of the test if it is repeated within 24 months of the date of completion of the part of the test.
FINAL TEST OF ACREDITATED QUALIFICATION CURSE
(1) The final examination of the accredited qualification course shall take place before the examination committee of the Ministry.
(2) Paragraphs 2 to 6 and 7 (1) to (3) and (5) apply mutatis mutandis for the final examination of the accredited qualification course.
(3) If the candidate is rated "failed ', he may apply for a repeat of the final examination of the accredited qualification course no later than 2 months after the date of the invitation.
ANALYSIS TEST
Test Panel
(1) Aprobation examination13) shall be held before the Ministerial Examination Board. The panel shall have an odd number of members but at least three members. The members of the Examination Board shall elect a chairman from among themselves who shall direct and be responsible for the activities of the Examination Board. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
(2) The approval test is only publicly accessible to healthcare professionals (6), except for advice on the outcome of the examination or part thereof, which is not public.
(3) It shall decide on the result of the examination or part of the examination committee by public vote.
Application for a probation test
(1) The application for the completion and probation examination shall be submitted to the Ministry within 30 days of the date of the examination.
(2) The applicant shall attach a certified copy of the educational document, accompanied by a translation into the Czech language, which must be carried out by an interpreter on the list of experts and interpreters 14) and a certified copy of the certificate of recognition of higher education or notation of the certificate issued by a foreign school.
Deadline and venue of the probation examination
(1) The approval test shall take place at regular intervals at least three times a year.
(2) The date and place of the examination shall be determined by the Ministry and notified at least 20 days before the date of the examination to all tenderers whose application fulfils all the requirements set out in Section 15.
Content, course and evaluation of the probation test
(1) The Examination Panel verifies the aprobation test of professional theoretical knowledge, professional practical skills, knowledge of the health system in the Czech Republic and the ability to express itself in the Czech language to the extent necessary for the exercise of the medical profession.
(2) The approval test is divided into 4 consecutive parts, namely the test of expertise, the oral examination, the practical exercise of the relevant medical profession under professional supervision (hereinafter referred to as professional practice) and the part verifying the knowledge of the health system in the Czech Republic. The part verifying knowledge of the health system in the Czech Republic is not required for applicants for recognition of professional competence in the profession of disinfectant, driver of a vehicle of medical emergency services, nurse, masseur and blind and weak-sighted masseur, laboratory worker, dental practitioner, transport driver of sick and injured, autoptic laboratory and sanitor.
(3) All parts of the probation test referred to in paragraph 2 are in the Czech language. This verifies the ability of the candidate to speak in the Czech language to the extent necessary for the performance of the health profession.
(4) Before starting each part of the probation test, the tenderer shall demonstrate his identity.
(5) The content and scope of the individual parts of the probation examination correspond to the content and extent of the knowledge and skills set out in the fields of study to be eligible for the medical profession of secondary schools and higher vocational schools and to the accredited medical study programmes to be eligible for the profession of higher education in the Czech Republic, or, where appropriate, in the training programmes of specialisation education or accredited qualification courses. The content of the probation examination shall be communicated by the Ministry to the applicant at least 20 days before the first part of the examination.
(6) Successful completion of the knowledge test with a specified time limit and prescribed success rate is a prerequisite for carrying out an oral professional examination which follows within 15 days of the test. The test result shall be recorded in the report on the Aprobation Test.
(7) The oral examination shall consist of three questions. Questions from the theoretical section shall be drawn and recorded in the report on the probation test. Once the questions have been drawn, the examination committee shall provide the candidate with a reasonable time to prepare the answer, but at least 15 minutes. Successful performance of the oral professional examination is a prerequisite for professional practice.
(8) The professional experience of the candidate shall be carried out by his successful completion of the duration referred to in the Annex to this Order under the professional supervision of a healthcare professional with no professional supervision in the relevant field, who shall evaluate in writing whether the professional experience has been successfully carried out. Successful performance of professional practice is a prerequisite for performing part of the probation exam, which verifies knowledge of the health system in the Czech Republic.
(9) The part of the probation exam, which verifies the knowledge of the health system in the Czech Republic, is the verification of the knowledge of the legislation of the Czech Republic relating to the exercise of the medical profession, for which the applicant requests recognition.
(10) Individual parts of the probation test, except for professional practice, and its overall result are assessed by the word "passed 'or" failed'.
(11) The successfully completed part and the probation test shall be valid for 24 months from the date of its completion.
Non-participation in and repetition of the Aprobation Test, withdrawal from the Aprobation Test
(1) If the candidate cannot attend the probation test by the date for which he was invited, he must excuse his absence to the Ministry. An apology shall be deemed to be a written apology received by the Ministry before the term of the probation examination and, in the case of a serious reason, a written apology received by the Ministry after the term of the probation examination, provided that it has been carried out without delay as soon as the serious reason for the non-participation has passed. Withdrawal from any part of the probation test before commencing shall also be considered an apology. In the event of an apology, the applicant may apply for the approval test within the next deadline, including the dates already written, if possible for organisational reasons.
(2) Withdrawal from any part of the probation test after the question has been drawn or in the course of which the "failure 'is assessed.
(3) If the candidate does not show up for the probation test without an apology, he shall be deemed to have failed the probation test.
(4) If the candidate is assessed "failed ', he may pass the probation test within the next deadline to be published by the Ministry.
TRANSITIONAL AND FINAL PROVISIONS
Candidates applying for an attestation test or for a probation test before the date of entry into force of this decree shall complete it in accordance with the existing rules, but no later than 24 months after the date of entry into force of this decree. If the candidate does not pass the examination by the date specified in the first sentence, this order shall be followed.
Efficacy
This Decree shall take effect on 1 July 2004.
