DECLARATION
of 6 October 2025
amending Decree No 77 / 1996 Coll., on the formalities for the application for withdrawal or restriction and details of the protection of land intended for the performance of forest functions
According to § 16 (6) of Act No. 289 / 1995 Coll., on Forests and on the amendment and addition of certain laws (Forest Act):
Decree No 77 / 1996 Coll., on the particulars of the application for withdrawal or restriction and details of the protection of land intended for the performance of forest functions, is amended as follows:
1. In Article 1 (b), the words "beginning and end 'are replaced by the words" necessary duration and expected period of implementation'.
2. in Paragraph 1 (e):
"(e) data on the classification of the parcels concerned in forest categories and their presence in the protected areas of natural water accumulation and in the territorial systems of ecological stability,"
3. in Article 1, points (f) and (g), including footnotes 1 to 3, are deleted;
Points (h) to (k) shall be renumbered as points (f) to (i).
4. in Article 1 (g) and (h):
"(g) the statement by the owner of the parcels concerned intended to fulfil the forest functions if another person requests withdrawal;
(h) the statement of the lessee or, where appropriate, the smuggler, of the parcels concerned intended to fulfil the forest functions, if another person so requests, ';
footnotes 4 and 5 are deleted.
5. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) For the purposes of construction for which the purpose of expropriation is determined by law, the expression referred to in paragraph 1 (g) to (i) shall not be required. '.
Efficacy
This Decree shall take effect on 1 January 2026.
