GOVERNMENT REGULATION
of 14 December 2015
amending Government Regulation No. 77 / 2008 Coll., on the establishment of thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion into Czech currency of the amounts laid down in the Act on Public Procurement in Euro, as amended, and Government Regulation No. 78 / 2008 Coll., establishing financial limits for the purposes of the Concession Act, as amended
The Government hereby orders pursuant to § 159 (1) to implement § 12 (1) and § 154 of Act No. 137 / 2006 Coll., on Public Contracts, as amended, and § 34 (3) to implement § 14 (1) and § 15 (1) (b) of Act No. 139 / 2006 Coll., on Concession Contracts and Concession Procedure (Concession Act), as amended:
Amendment of Decree No 77 / 2008 Coll.
Government Decree No. 77 / 2008 Coll., on the establishment of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of the amounts laid down in the Act on Public Procurement in Euro into Czech currency, as amended by Government Decree No. 474 / 2009 Coll., Government Decree No. 276 / 2011 Coll., Government Decree No. 447 / 2011 Coll., Government Decree No. 386 / 2012 Coll., and Government Decree No. 456 / 2013 Coll., is amended as follows:
1. In footnote 1, the fourth sentence is replaced by the following: "Commission communication corresponding to the thresholds under Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC (2015 / C 418 / 1) '.
2. footnote 2 shall read:
"(2) Commission Regulation (EU) 2015 / 2341 of 15 December 2015 amending Directive 2004 / 17 / EC of the European Parliament and of the Council as regards the thresholds used in public procurement procedures. Commission Regulation (EU) 2015 / 2342 of 15 December 2015 amending Directive 2004 / 18 / EC of the European Parliament and of the Council as regards the thresholds used in public procurement procedures. Commission Regulation (EU) 2015 / 2340 of 15 December 2015 amending Directive 2009 / 81 / EC of the European Parliament and of the Council as regards the thresholds for use in public procurement procedures. ';
3. In § 2 (1) (a) and § 2 (2) (a), the amount "3 395 000 CZK" is replaced by "3 686 000 CZK."
4. In § 2 (1) (b) and § 2 (2) (b), the amount "5 244,000 CZK" is replaced by "5 706 000 CZK."
5. In § 2 (1) (c), § 2 (2) (c) and § 2 (4) (a), "10 489 000 CZK" is replaced by "11 413 000 CZK."
6. In § 2 (3) and § 2 (4) (b), the amount "CZK 131 402 000" is replaced by "CZK 142 668 000."
7. In § 3 (a), the amount "19 003 000 CZK" is replaced by "20 478 000 CZK."
8. In § 3 (b), the amount "2 027 000 CZK" is replaced by "2 184 000 CZK."
9. In § 3 (c) the amount "25 338 000 CZK 'is replaced by" 27 305 000 CZK'.
Amendment of Decree No. 78 / 2008 Coll.
Government Decree No. 78 / 2008 Coll., setting financial limits for the purposes of the concession law, as amended by Government Decree No. 474 / 2009 Coll., Government Decree No. 447 / 2011 Coll. and Government Decree No. 456 / 2013 Coll., is amended as follows:
1. In footnote 1, the second sentence is replaced by the following: "Commission communication corresponding to the thresholds under Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC (2015 / C 418 / 1). '.
2. footnote 2 shall read:
"(2) Commission Regulation (EU) 2015 / 2342 of 15 December 2015 amending Directive 2004 / 18 / EC of the European Parliament and of the Council as regards the thresholds used in public procurement procedures.";
3. In § 2 paragraphs 1 and 2, the amount "CZK 131 402 000 'is replaced by" CZK 142 668 000'.
EFFECTIVE
This Regulation shall take effect on 1 January 2016.
