of 15 October 2021
amending Decree No 377 / 2013 Coll., on the storage and use of fertilisers, as amended, and Decree No 474 / 2000 Coll., on the establishment of fertiliser requirements, as amended
The Ministry of Agriculture provides pursuant to § 3 (5), § 4 (9), § 8 (6) and § 9 (10) of Act No. 156 / 1998 Coll., on fertilisers, soil improvers, plant biostimulants and substrates and on agrochemical testing of agricultural soils (Fertilisers Act), as amended by Act No. 9 / 2009 Coll., Act No. 61 / 2017 Coll. and Act No. 299 / 2021 Coll.:
Amendment of the Regulation on storage and use of fertilisers
Decree No. 377 / 2013 Coll., on the storage and use of fertilisers, as amended by Decree No. 131 / 2014 Coll. and Decree No. 229 / 2017 Coll., is amended as follows:
1. in Article 1 (a) and (b), the words "and excipients" shall be replaced by the words "soil aids, plant biostimulants and substrates."
2. In Section 1 (c), the words "excipients' are replaced by the words" soil improvers, plant biostimulants, substrates'.
3. In Section 1, at the end of point (d), the words "and the reporting of aerial application of fertilisers, soil improvers, plant biostimulants and substrates' are added.
4. In Article 1, at the end of point (d), the dot is replaced by a comma and the following points (e) and (f) are added:
"(e) keeping records of the yield of the main and by-product harvested, the average nutrient collection in the products harvested and the method and form of electronic transmission of the register; and
(f) the operation of a feeding site. ';
5. The title of Section 5 reads:
"Storage of organic and organo-mineral fertilisers and technological waters'.
6. In Article 5 (1), the words "and technological water 'shall be inserted after the words" fertilizers' and at the end of the paragraph, the words "Matches and tanks shall correspond to a capacity of at least four months of expected production of digestor or digestor fugate. In the case of biogas station plants newly put into service and their designed capacity are among the stationary sources under the Air Protection Act, low-emission systems must be used in storage. '
7. In Section 5, paragraph 5, including footnote 2, is deleted.
8. In Article 6 (1), the sentence "For livestock farms newly put into service and their proposed capacity are among the stationary sources under the Air Protection Act, low emission systems must be inserted after the first sentence 'and the last sentence shall be deleted.
9. In Article 6, at the end of paragraph 2, the sentence "In the case of livestock farms newly put into service and their proposed capacity are among the stationary sources under the Air Protection Act, low-emission systems must be used in storage."
10. in Paragraph 6 (3), "waste" is replaced by "technological."
11. in Article 6, the following paragraph 5 is added:
"(5) Feedingstuffs may be operated if:
(a) not less than 50 m from the body of surface water or on agricultural parcels with a inclination of more than 5 degrees at least 100 m from the body of surface water; and
(b) at least once a year during the period 1 February to 30 April, the removal of feces, litter and feed residues shall be carried out. "
12. In Section 7, the words "ingredients' are replaced by the words" soil aids, plant biostimulants'.
13. in Article 7, paragraph 2 is deleted;
Paragraphs 3 to 9 shall be renumbered paragraphs 2 to 8.
14. footnote 4:
"(4) Government Regulation No. 48 / 2017 Coll., on the establishment of requirements according to the acts and standards of good agricultural and environmental condition for the areas of cross compliance rules and the consequences of their infringement for the granting of certain agricultural aid, as amended."
15. Paragraph 7 (3) reads:
"(3) Liquid manure, liquid organic fertilisers or technological water shall be introduced into the soil no later than 24 hours after application to the surface of the arable land, in the case of fertilisers originating from installations under the Integrated Prevention Act no later than 12 hours. Soil treatment shall not be required after line application to the crops by hose applicators and application to grass, clover and clover crops during a period of at least 1 month prior to harvest. After applying solid manure or solid organic fertilisers to the surface of arable land, fertilisers shall be introduced into the soil within 48 hours at the latest; This shall not apply to by-products or by-products resulting from the cultivation of cultural plants. ';
16. In Article 7, the following paragraph 4 is inserted after paragraph 3:
"(4) Urea as fertiliser may only be used if the urease inhibitor is added to it in the manner and at the dose indicated on the label. This does not apply if it is immediately fixed into the soil or administered in a solution. '
Paragraphs 4 to 8 shall be renumbered paragraphs 5 to 9.
17. in Paragraph 7 (5) of the introductory part of the provision, the word "fertilisers" is replaced by the word "fertilisation."
18. in Article 7 (5), at the end of the text in point (a), the words "according to the values obtained by the analysis of the crop concerned in the past or the data on the collection of nutrients by the crops listed in Annex 6 to this Decree."
19. In Article 7, the following paragraph 10 is added:
"(10) For the use of technological waters, the provisions of paragraph 9 (a) shall apply mutatis mutandis. ';
20. In Section 9, the words "excipients' are replaced by the words" soil improvers, plant biostimulants, substrates'.
21. At the end of paragraph 1, the sentence "Agricultural entrepreneurs who are required to keep records pursuant to paragraphs 9 (7) and 9 of the Act on fertilisers in electronic form shall be added at the end of paragraph 1 to the Institute by electronic means by means of an automated data output via an electronic application accessible on the Ministry's website. The Ministry shall establish access to this application to the agricultural entrepreneur upon request. Transmission of data through this electronic application does not require signature. The detailed requirements for the method and form of electronic transmission of the register are laid down in Annex 7 to this Decree. '
22. in Article 9 (2), the words "or substrate" shall be deleted and at the end of the paragraph the sentence "Where soil improvers, plant bio-stimulants or substrates are used on agricultural land, the words" or substrate "shall be entered in the register without indication of the amount of nutrients."
23. in Article 9 (3), the last sentence is deleted;
24. in Article 9 (4), the words "the grazing period" shall be replaced by "the grazing period" and the number "3" shall be replaced by "1."
25. In Section 9a, the words "or excipients' are replaced by the words", soil aids, plant biostimulants and substrates'.
26. In Section 9a, the words "or excipients' are replaced by the words", soil improvers, plant biostimulants and substrates'.
27. in Annex No 1 (A), in the first column of the table, the text "7)" is inserted after the word "Sows."
28. in Annex 1 (A), the following explanatory note 7 is added:
"(7) The above values shall also apply to sows after they have been released."
29. in Annex No 1 (B), first column of the table, the text "4" is inserted after the word "Sows."
30. in Annex 1 (B), the following explanatory note 4 is added:

Records of the use of fertilisers, soil improvers, plant biostimulants, substrates and treated sludge
Compulsory information:
(a) identification of the farm operator
1. the name and, where applicable, the name, surname and, where applicable, the addendum distinguishing the person of the agricultural operator or the type of business, the date of birth, the identification number of the person, if any, and the address of the place of business, if any, if any, of the natural person; and
2. name or business name, identity number and address of the registered office, if any,
(b) identification of the owner of the forest parcel;
(c) identification details of the natural or legal person engaged in forest production;
(d) the number of the cadastral territories (1);
(e) land number1), forest land (for forest land, the separation, crop, grassland),
(f) area of land, forest land (in the case of forest land shall be indicated by separation, vegetation, grassland) in ha,
(g) crop name (2), species, variety, utility directive (3),
(h) date of sowing or planting (3), (4);
(i) the date of harvest or fixation3), 4),
(j) crop area in ha3),
(k) average crop yield - main product in t / ha3),
(l) the type of main product (in particular grain, green matter) 3),
(m) average crop yield - by-product in t / ha3),
(n) date of application of fertiliser, soil aid, plant biostimulant, substrate or treated sludge (date of commencement of grazing or residence of animals on agricultural land),
(o) date of fertiliser, soil aid, plant bio-stimulant, substrate or treated sludge (date of end of grazing or residence of animals on agricultural land),
(p) the area of fertilised area, grazing or residence of animals on agricultural land in ha;
(q) the type or name of fertiliser or treated sludge - in the case of grazing or residence of animals on agricultural land, faeces and urine, including animal species, shall be indicated;
(r) the total dose of fertiliser or treated sludge (t, kg, l), in the case of treated sludge, expressed as 100% dry matter,
(s) the average dose of fertiliser or treated sludge (t / ha, kg / ha or l / ha), in the case of treated sludge per 100% dry matter, in the case of grazing or housing animals on agricultural land, the number of DJ / ha5);
(t) the average nutrient intake in the fertiliser or treated sludge used in kg / ha - N, P2O5, K2O, MgO, CaO, S,
(u) the name of the soil improvers used, plant biostimulants, substrates, micro nutrient fertilisers; and
(v) the average dose of soil aid, plant biostimulants, substrates and micro-nutrient fertilisers used (t / ha, kg / ha or l / ha).
Explanatory notes:
1) If an agricultural entrepreneur is included in the Land Register under Act No. 252 / 1997 Coll., on Agriculture, as amended, he shall enter the number of the map square in the cadastral territory section and the abbreviated code of the soil block part in the Land Register.
2) For permanent grassland only the agricultural crop culture shall be indicated.
(3) Data relating to the cultivated crop, the yield of the main crop (grain, seed, tubers, eyeballs) and by-product (straw, finer, grass) may be kept in a separate register.
(4) In the case of cultivation of more than one crop on the same area within the production (marketing year) of the year, data shall also be kept on the date of sowing and the date of harvest or processing.
5) The cattle unit (DJ) corresponds to 500 kg live weight of livestock. '

Explanatory notes:
1) The supply of nutrients in manure is given for the period of application, i.e. after deduction of losses of nutrients in stables and in manure storage. For different dry matter content for liquid manure, the nutrient content shall be proportionally recalculated. Where an analysis of the nutrient content is available, the values of that analysis shall apply.
(2) In the joint storage and subsequent use of a mixture of different types of manure and organic fertilisers, the weighted average shall be used for the calculation of the nutrient supply according to the quantitative representation of the different species in the mixture. When representing one type of fertiliser above 80%, the value for this predominant type of fertiliser may be used.

Explanatory notes:
(1) The value of "total" shall be expressed by the collection of nutrients in the main product (grain, seed, tubers, eyeballs) and by-product (straw, fibre, shrub), converted into one tonne of the main product.
2) Nutrient collection, expressed in elements (N, P, K), per tonne of product at that standard dry matter content, in the case of multi-annual forage crops harvested per fodder, as converted into hay.
(3) In the case of leguminous and clover plants, including their mixtures with other crops, the nitrogen fertilisation requirement is not determined according to the overall nitrogen nitrogen requirement with respect to nitrogen intake by symbiotic fixation.

Annex No 7 to Decree No 377 / 2013 Coll.
Method and form of electronic transmission of records
1. Data shall be transmitted in electronic form in the form of an automated data output. The Ministry's electronic application allows the transmission of automated data output via a web service or by manual upload of this output. The Ministry shall publish a detailed technical description of the data transmitted via the website.
2. The structure of the XML data output contains
(a) identification of the data transmitted
I. unique entity identifier - identification number (length of 8 characters),
II. identification of the start of the period for which data are transmitted (date in DD.MM.YYYY format); and
III. Identification of end of period for which data are transmitted (date in DD.MM format. YYYY),
(b) the data phrase identifying cultivated crops and their yield containing:
I. the abbreviated code of the soil block part (according to the designation in the soil register according to Act No. 252 / 1997 Coll., on Agriculture, as amended),
II. square part of the soil block (according to the designation in the soil register according to Act No. 252 / 1997 Coll., on Agriculture, as amended),
III. Number identifier of the cultivated crop according to the crop code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
IV. the productive direction of the cultivated crop, where such a crop has several lines of production in the crop code list for the same product,
V. crop area (figure to two decimal places),
VI. Date of sowing or planting (date in DD.MM format). YYYY),
VII. harvest date of crop (date in DD.MM format. YYYY),
VIII. number identifier of the main product according to the product code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
IX. average yield of the main product per unit of area expressed as tonne per hectare (figure to three decimal places),
X. the dry matter content of the main product as a percentage of the whole number (if the dry matter content is not stated, then the value of the dry matter content referred to in Annex 6 to this Decree shall be taken over for the purposes of calculating the nutrient balance,
XI. by-product number identifier according to the product code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
XII. the average yield of the by-product per unit of area expressed as tonne per hectare (figure to three decimal places); and
XIII. the dry matter content of the by-product as a percentage of the whole number (if the dry matter content is not indicated, then the value of the dry matter content referred to in Annex 6 to this Decree shall be taken over for the purposes of calculating the nutrient balance).
(c) the data theorem identifying the individual use of fertilisers, soil improvers, plant biostimulants, substrates and treated sludge contains the following entries:
I. the abbreviated code of the soil block part (according to the designation in the soil register according to Act No. 252 / 1997 Coll., on Agriculture, as amended),
II. square part of the soil block (according to the designation in the soil register according to Act No. 252 / 1997 Coll., on Agriculture, as amended),
III. Date of use of fertiliser or start of grazing or other residence of animals on agricultural land (date in DD.MM format. YYYY),
IV. date of fertiliser or end of grazing or other residence of animals on agricultural land (date in DD.MM format. YYYY),
V. the numeric identifier of the target crop according to the crop code list published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website,
VI. crop area (figure to two decimal places),
VII. area covered by fertiliser (figure to two decimal places),
VIII. fertiliser number identifier according to the fertiliser register published by the Ministry in a way that allows remote access in an electronic application on the Ministry's website (optional),
IX. fertiliser name (text corresponding to fertiliser name),
X. quantity of fertiliser used (figure to three decimal places),
XI. unit of measurement of fertiliser used (t, kg, l)
XII. nitrogen intake (N) in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not reported (figure to three decimal places),
XIII. intake of phosphorus (P) 1 in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XIV. intake of potassium (K) 1) in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XV. magnesium intake (Mg) 1) in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XVI. Calcium (Ca) 1) supply in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not provided (figure to two decimal places),
XVII. intake of sulphur (S) 1 in kg / ha shall be reported only if the fertiliser identifier according to the fertiliser register is not reported (figure to two decimal places),
XVIII. indication whether the fertiliser has been used to promote straw decomposition (in the format referred to in point A, for YES and N for NO),
XIX. data on the use of treated sludge as 100% dry matter (items I to XVII. apply mutatis mutandis); and
XX. data on the use of soil improvers, plant biostimulants and substrates (items I. to XI. apply mutatis mutandis).
Explanatory notes:
(1) In case the nutrient content of the fertiliser in oxide or carbonate form is indicated, the nutrient intake in the form of elements shall be determined by the following conversion: P = P2O5 x 0,436, K = K2O x 0,830, Ca = CaO x 0,715, Ca = CaCO3 x 0,400, Mg = MgO x 0,603, Mg = MgCO3 x 0,288, S = SO42- x 0,333. '
Amendment of the Ordinance laying down requirements for fertilisers
Decree No. 474 / 2000 Coll., establishing requirements for fertilisers, as amended by Decree No. 401 / 2004 Coll., Decree No. 209 / 2005 Coll., Decree No. 271 / 2009 Coll., Decree No. 131 / 2014 Coll., Decree No. 237 / 2017 Coll. and Decree No. 312 / 2021 Coll., is amended as follows:

FINAL PROVISIONS
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
EFFECTIVE
This Decree shall take effect on 1 November 2021, with the exception of the provisions of:
(a) Article I (21), (32) and (36) as regards Annex 7, which shall take effect on 1 January 2022; and
(b) Article I (16), which shall take effect on 1 July 2022.
