DECLARATION
of 25 November 2013
on fitness for physical education and sport
According to Section 95 (1) of Act No. 373 / 2011 Coll., on Specific Health Services (hereinafter referred to as "the Act '), the Ministry of Health provides for the implementation of Section 52 (a) and (c) of the Act and under Section 95 (2) of the Act in agreement with the Ministry of Education, Youth and Sports for the implementation of Section 52 (b) of the Act:
Preliminary provisions
(1) This decree sets out the types, frequency and content of medical examinations necessary for the identification of health status, including the scope of the professional examinations, and the procedures for providing them, the list of diseases, conditions and defects excluding medical fitness and the particulars of the medical assessment, when it comes to the assessment of medical fitness for sport, education or training in schools with a focus on sport and physical education or on the release of lessons in the subject of physical education, unless otherwise provided for in other legislation governing the assessment of medical fitness.
(2) For the purposes of this decree:
(a) a performance athlete who:
1. carry out or prepare for performance sport in organised sports competitions; and
2. it is registered in an organisation which provides for the preparation of performance athletes, or organises sporting competitions,
(b) a top athlete, a person who performs peak sports at the level of the national sports representation, or a person who prepares for representation as a member of the resort sports centre, youth sports centre or similar facilities for the preparation of athletes;
(c) a school focusing on sport and physical education (hereinafter referred to as "sports school") a school in which a pupil or student (hereinafter referred to as "pupil") is educated in the field of education with a focus on sport and physical education;
(d) an organised sport which an athlete carries out in organisations other than those referred to in (a) or (b);
(e) non-organised sport of sport and leisure for the broad population;
(d) a medically demanding sport discipline in which there is an increased risk of injury or its operation is associated with increased health requirements for an athlete who carries out such a sport.
(1) Health is assessed on the health performance of performance sport, peak sport, organised sport, disorganised sport or sport and physical education in sports schools or on the subject of physical education in order to release a pupil from teaching this subject (the subject of physical education).
(2) Diseases, conditions or defects which exclude or restrict medical fitness for sport, sport and physical education in sports schools or subject matter of physical education are listed in Annex 2 to this Decree. This is without prejudice to the provisions of other legislation governing medical fitness for education2).
Medical examinations necessary for medical assessment and professional examinations
(1) The types of medical examinations are for medical purposes
(a) performance sport, peak sport or sport and physical education in sports schools
1. entry medical examination,
2. regular medical examination; and
3. emergency medical examination; or
(b) to organised sport, non-organised sport or subject of physical education, a single medical examination.
(2) The content of each medical examination referred to in paragraph 1 shall be:
(a) a family history of sudden death;
(b) a sports history focusing on the exercise of the person under consideration and a description of the type, time and physical complexity of the sport for which it is assessed;
(c) an analysis of the data on the state of health of the person under assessment and of the diseases and medicinal products used so far, with a particular focus on the occurrence of diseases which may restrict or exclude the medical fitness of the person under assessment for the sport or physical education for which it is assessed;
(d) a comprehensive physical examination with an emphasis on assessing the state and function of the organs and systems of the person under consideration which will be burdened by the sport or physical education for which it is assessed; and
(e) analysis of data on sport or physical education carried out;
("basic examination ').
(1) The initial medical examination shall be carried out to identify diseases, conditions or defects that would result in the performance of sport, peak sport or sport and physical education in sports schools to deteriorate the health of the person under assessment or to harm the health of other persons in relation to their health.
(2) Entry medical examination is carried out
(a) prior to registration of the person under consideration in the organisation referred to in Article 1 (a);
(b) prior to the inclusion of the person under consideration in the national sports representation, the resort sports centre, the youth sports centre or similar facilities for the preparation of top athletes; or
(c) prior to filing an application for education at a sports school.
(3) The initial medical examination in addition to the basic examination contains,
(a) if it is a performance athlete or a candidate for training at a sports school,
1. findings of basic anthropology,
2. standard resting electrocardiographic examination; and
3. laboratory and other professional examinations, if required by the medical condition identified by the basic examination or if necessary taking into account the age of the person under consideration or the health performance of the sport and the expected load intensity and training volume;
(b) if it is a top athlete or performer performing a medically demanding sport discipline,
1. the examination referred to in point (a); and
2. stress test including monitoring of electrocardiographic curve and blood pressure,
unless otherwise provided for in other legislation governing medical assessment. Health-intensive sports disciplines are listed in Annex 1 to this Decree.
(1) Regular medical examination shall be carried out to detect changes in the state of health of the person under consideration which could lead, when continuing to operate performance sport, peak sport or sports and physical education in sports schools, to harm the health of that person or to harm the health of other persons, or to establish whether the sports burden does not exceed the adaptability of the body under consideration.
(2) The periodic medical examination shall include, in addition to the basic examination of the laboratory and other professional examinations, where required by the medical condition of the person under assessment, determined by the basic examination or the medical performance of the sport or physical education for which it is assessed, or the expected intensity of the load and training volume.
(3) If a top athlete is involved, the regular medical examination also includes:
(a) the detection of essential anthropology;
(b) a standard resting electrocardiographic examination; and
(c) stress tests including monitoring of the electrocardiographic curve and blood pressure.
(4) Regular medical examinations shall be carried out every 12 months, unless otherwise provided for in other legislation governing medical fitness.
(1) Emergency medical examination shall be carried out if:
(a) a change in the state of health of the person under assessment is detected during the periodic medical examination, which envisages a change in medical fitness in a period shorter than the interval for the next periodic examination;
(b) there has been a serious change in the state of health of a top athlete, a performance athlete or a student of a sports school; or
(c) there has been a failure of consciousness or, where appropriate, the unconsciousness of a top athlete, a performance athlete or a student of a sports school.
(2) Extraordinary medical examination is further carried out
(a) in the case of performance or peak athletes under 18 years of age before being classified in a higher age category of performance or peak sport than that of their age; or
(b) at the request of a performer or a student of a sports school or its legal representative, if he / she is convinced that his / her health difficulties have arisen or are worsening in the continuous exercise of sport or physical education.
(3) In addition to the basic examination, the emergency medical examination shall include additional technical examinations where the health status of the person under assessment is required, as determined by the basic examination or by the health performance of the sport or physical education for which it is assessed, or the expected intensity of the load and the amount of training.
(1) A one-off medical examination shall be carried out to detect diseases, defects or conditions which would lead, in the exercise of organised sport, non-organised sport or subject matter of physical education, to deterioration of the health of the person under assessment or to harm the health of other persons in relation to his or her health.
(2) A one-off medical examination shall be carried out prior to a sporting competition or sporting event where the organizer of the competition or sporting event determines the conduct of a medical examination as a condition of participation in the competition or at a sporting event.
(3) A one-off medical examination shall include, in addition to the basic examination, laboratory and other technical examinations, where required by the medical condition established by the basic examination, the age of the person under consideration or the medical performance of the sport or subject matter of physical education, or if it relates to a medically demanding sport discipline as referred to in Annex 1 to this Decree.
Medical evaluation
The medical report shall contain the particulars provided for by other legislation governing the content and the particulars of the medical documents3). If this is a medical assessment
(a) the conclusion on medical fitness, medical incompetence or medical fitness, subject to sports or physical education, shall be given to the particular sport or subject of physical education; if it is a medically demanding sport discipline, the sport referred to in Annex 1 to this Decree shall be indicated; or
(b) for organised sport, or for non-organised sport or subject of physical education, the duration of the assessment shall always be indicated.
Repeal
The following shall be deleted:
1. Directive No 3 / 1981 of the Ministry of Health of the Czech Republic. MZ ČSR, health care in physical education, sport and industry (registered in the amount of No. 15 / 1981 Coll.).
2. MZ ČSR Directive No. 5 / 1985 MZ ČSR, about providing specially specialized preventive care to selected top athletes (registered in the amount of No. 24 / 1984 Coll.).
3. The proceeds of the MZ ČSR No OP-062-10.10.89 supplementing Directive No 3 / 1981 of the European Parliament and of the Council. MZ CR (registered in the amount No. 28 / 1989 Coll.).
Efficacy
This Decree shall take effect on 31 December 2013.

Health-intensive sports disciplines
Health-intensive sports disciplines regardless of the level of competition are
1. sports disciplines with a high risk of injury to the athlete's health or surrounding injury, such as rugby, boxing, kickbox, match, judo, karate, other fighting and field sports with full contact or motorism,
2. sports disciplines with a high risk of failure of essential life functions due to congestion of motion, thermoregulation, metabolic, circulatory, endocrine, nervous or other systems of the body, such as sports events in the otoplastic swimming or competition with endurance performance lasting more than 2 hours, in particular cross-country, ski or cycling marathons and ultra-marathons, long-distance swimming, triathlon, other multistruggles of endurance character and hiking marathons of at least 50 km;
3. sports disciplines with difficult availability of assistance, such as diving, paragliding, climbing expeditions over 4000 m above sea level and distance competitions in sea sailing,
4. sports activities carried out under extreme external conditions such as extremely low or high temperature, hyper and hypobaria and high overload;
5. aviation and parachuting, for example, flights in gliders, hang gliders and balloons.

Diseases, defects and conditions which exclude or restrict medical fitness for sport or physical education
Diseases, defects, or conditions which exclude or restrict medical fitness for sport or physical education are diseases, defects and conditions which cause such health complications or derogations which may lead to deterioration of the health of the person under consideration or to damage the health of other persons in connection with the exercise of a particular sport or physical education. They're:
I. Diseases, defects or states of the muscle and skeletal system and connective tissue

4. aseptic bone necrosis
5. organic disorders of the spine (scoliosis, rotation, florid stage of the morbus Scheuermann)
