DECLARATION
of 23 June 2004
on the extent of data in the records of surface and groundwater status and on the way in which such data are processed, stored and transmitted to public administration information systems
The Ministry of Agriculture, in cooperation with the Ministry of the Environment, provides pursuant to § 21 paragraph 2 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
Subject matter
This decree provides
(a) the scope of the data, including statistical and cartographic data, included in the register;
1. watercourses and their basins, hydrogeological zones and water tanks;
2. water bodies including strongly affected water bodies and artificial water bodies;
3. the quantity and quality of surface and groundwater, the condition of water bodies and the ecological potential of strongly affected and artificial water bodies;
4. sampling of surface water and groundwater, discharges of waste and mining water and accumulation of surface water in water tanks;
5. the water catchment area;
6. protected areas of natural water accumulation,
7. water source protection zones,
8. surface and groundwater water sources that are used or are expected to be used as drinking water sources;
9. sensitive areas;
10. vulnerable areas,
11. surface water areas used for bathing,
12. surface waters which are or are to become permanently suitable for the life and reproduction of native fish species and other aquatic animals,
13. water works to water-management melodies of land,
14. Flood areas,
(b) the processing, storage and transmission of data referred to in point (a) to information systems of public administration pursuant to the provisions of § 22 (3) and (4) of the Water Act.
Definition of terms
For the purposes of this decree:
(a) territorial identification - a spatial indication of the location, shape and topological relationship between the geographical phenomena directly or indirectly associated with the site on the ground surface, enabling visual interpretation;
(b) natural water flow rate - measured water flow rate corrected by the amount of sampling, discharges and other available data on its effect to match the natural hydrological water flow regime.
Watercourses and their water catchment areas, hydrogeological zones and water tanks
Water courses and their basins
(1) Water flows shall be recorded in the scope of their name, numeric identifier, length, administrator and territorial identification. The hydrological water catchment area of the watercourses shall be recorded to the extent of their numeric identifier, area size and territorial identification of the distribution centre.
(2) The river basin managers, the agricultural water management, the state enterprise Forests of the Czech Republic, the local authorities and the management of national parks process the name, number identifier, length, managers and territorial identification of the water flow they manage and store the processed data in the public administration information system.
(3) The agricultural water management, in cooperation with river basin management authorities, shall process the name, number identifier, length, manager and territorial identification of the water flow, with the exception of the water flows referred to in paragraph 2, and store the processed data in the public administration information system.
(4) The Czech Hydrometeorological Institute, in cooperation with river basin managers, Agricultural Water Management, Forests of the Czech Republic State Company, Ústí offices and administrations of national parks, processes data on the number identifier, area size and territorial identification of the hydrological water distribution plant and stores the processed data into the public administration information system.
(5) The Research Institute of Water Management T. G. Masaryk (hereinafter referred to as "the Institute") shall transmit the basic base of the geographical data of the Czech Republic to the extent specified by the specific legislationsm2 and shall use the data referred to in paragraphs 2 to 4 for this purpose.
Hydrogeological grates
(1) Hydrogeological rajony3) shall be recorded in the scope of their name, number identifier, water management and territorial identification.
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Water tanks
(1) Water tanks for which the permitted volume of air or accumulated water exceeds 1 000 000 m3, water tanks on significant water together4), to which the river basin managers exercise the right to farm, and water tanks shall be recorded in the scope of their territorial identification data and those laid down by special legislation5), with the exception of waterworks management data. Water tanks on major watercourses to which the river basin managers do not exercise the right to farm shall be recorded within the scope of the data referred to in paragraph 2.
(2) The water tanks, with the exception of the water tanks referred to in paragraph 1, shall be recorded in the scope of their territorial identification, name, name and code number of the cadastral territory and waterworks identification number.
(3) The river basin managers process and store the data referred to in paragraph 1 in the public administration information system.
(4) Agricultural water management shall process and store the data referred to in paragraph 2 in the information system of the public administration.
Registration of water bodies including strongly affected water bodies and artificial water bodies
(1) The water bodies of surface water shall be recorded in the scope of their territorial identification, name, number identifier, category and type, number identifier of the hydrological water catchment area, name of the river basin area and name of the main catchment area of the Czech Republic.
(2) The groundwater bodies shall be recorded in the scope of data on their territorial identification, name, number identifier, name and number identifier of the hydrogeological area, name and number identifier of the hydrological water catchment area, collector identifier (§ 2 paragraph 7 of the Water Act), name of the river basin area and name of the main water catchment area of the Czech Republic.
(3) The data referred to in paragraphs 1 and 2 are processed and stored in the public administration information system by the Institute.
Registration of the quantity and quality of surface and groundwater, status of water bodies and ecological potential of strongly affected and artificial water bodies
Amount of surface water
(1) The amount of surface water shall be recorded in the range of the measured water flow and natural water flow data in water flows in selected horizontal stations and in embedded water flow profiles according to the hydrological balance output of the water6) and data on territorial identification of surface water monitoring profiles.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by the Czech Hydrometeorological Institute.
Surface water quality
(1) The quality of surface water shall be recorded in the range of data of characteristic values of surface water quality indicators calculated from the measured values in the national surface water monitoring network operated by the Czech hydrometeorological institutes (7), from measured values from surface water status and quality profiles operated by the Agricultural Water Management and to the extent of the characteristic values of surface water quality indicators calculated from measured values of river basin managers in embedded profiles in watertoces8), and data on the territorial identification of surface water quality monitoring profiles.
(2) The data referred to in paragraph 1 from the national surface water monitoring network is processed and stored by the Czech Hydrometeorological Institute in the public administration information system.
(3) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers from embedded profiles in watercourses.
(4) The data referred to in paragraph 1, calculated from measured values from surface water monitoring profiles operated by the Agricultural Water Administration, are processed and stored by the Agricultural Water Administration in the public administration information system.
Amount of groundwater
(1) The quantity of groundwater is recorded in the scope of the basic outflow data for individual hydrogeological areas within the basins of the basins and main basins of the Czech Republic according to the hydrological balance output of the water8) and data on the territorial identification of the objects of the state monitoring network of groundwater monitoring.
(2) The data referred to in paragraph 1 shall be processed and stored by the Czech Hydrometeorological Institute in the information system of the public administration by the national monitoring network.
Groundwater quality
(1) The quality of groundwater is recorded in the range of data of characteristic values of groundwater quality indicators calculated from measured values in the buildings of the national groundwater monitoring network operated by the Czech hydrometeorological institutes (7) and data on the territorial identification of the objects of the national groundwater monitoring network.
(2) The data referred to in paragraph 1 from the objects of the national groundwater monitoring network is processed and stored in the public administration information system by the Czech Hydrometeorological Institute.
Status of water bodies
(1) The status of surface water bodies is recorded within the scope of data on their numeric identifier and the classification of their chemical and ecological status. The status of groundwater bodies shall be recorded within the scope of data on their numeric identifier and the classification of their chemical and quantitative status.
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Environmental potential of heavily affected and artificial aquatic bodies
(1) The ecological potential of heavily affected and artificial aquatic bodies is recorded in the scope of their numeric identifier and classification.
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Registration of surface and groundwater sampling, discharge of waste and mining water and accumulation of surface water in water tanks
Surface water samples
(1) The sampling of surface waters covered by the reporting obligation for the water balance (9) shall be recorded in the scope of the groundwater sampling data provided for by the specific legislation10) and their territorial identification data.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Groundwater sampling
(1) The groundwater sampling covered by the reporting obligation for the water balance (9) shall be recorded in the scope of the groundwater sampling data provided for by the specific legislation10) and their territorial identification data.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Waste water discharge
(1) Data on waste water discharges covered by the reporting obligation for the water balance (9) shall be recorded in the scope of the waste water discharges data provided for by the specific legislation10) and their territorial identification data.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Discharge of mining water
(1) The data on the discharge of mining waters covered by the reporting obligation for the water balance (9) shall be recorded in the scope of the data for the discharge of mining waters provided for by the special legislation10) and the data on their territorial identification.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Accumulation of surface water in water tanks
(1) The data on the accumulation of surface water in water tanks subject to the reporting obligation for water balance (9) shall be recorded in the scope of the data for the accumulation of surface water in water tanks provided for by specific legislation10).
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Recording of river basin areas
(1) The river basin areas shall be recorded in the scope of their territorial identification data and those laid down by specific legislationm3).
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Registration of protected areas of natural water accumulation
(1) Protected areas of natural water accumulation are recorded in the scope of their territorial identification data and those laid down in specific legislation11).
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Registration of water source protection zones
(1) The protection zones of aquatic resources are to be recorded in the scope of their territorial identification data and those laid down in specific legislation12), with the exception of names, surnames, permanent residence and natural person's birth number.
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Records of surface and groundwater water sources used or expected to be used as drinking water sources
Surface water sources used or expected to be used as drinking water sources
(1) Surface water sources used as drinking water sources shall be recorded in the scope of their territorial identification, name of the watercourse or water tank, name and code number of the cadastral territory, raw watercategory 13) and collection identification number.
(2) The sources of surface water which are expected to be used as a source of drinking water shall be recorded in the scope of their territorial identification, name of the watercourse or water tank and name and code number of the cadastral territory.
(3) The data referred to in paragraph 1 shall be processed and stored by the Ministry of Agriculture in the public administration information system.
(4) The data referred to in paragraph 2 shall be processed and stored in the public administration information system by the river basin managers on the basis of approved plans for river basin management areas.
Groundwater sources that are used or are expected to be used as drinking water sources
(1) The sources of groundwater used as drinking water are recorded in the scope of their territorial identification, name and code number of the cadastral territory, raw watercategory 13) and collection identification number.
(2) The sources of groundwater which are expected to be used as sources of drinking water shall be recorded in the scope of their territorial identification and name and code number of the cadastral territory.
(3) The data referred to in paragraph 1 shall be processed and stored by the Ministry of Agriculture in the public administration information system.
(4) The data referred to in paragraph 2 shall be processed and stored in the public administration information system by the river basin managers on the basis of approved plans for river basin management areas.
Records of sensitive areas
(1) Sensitive areas are recorded in the scope of their territorial identification data and those laid down by special legislation14).
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Records of vulnerable areas
(1) Vulnerable areas are recorded in the scope of their territorial identification data and those laid down by special legislation15).
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Registration of bathing surface water areas
(1) The areas of surface water used for bathing are recorded to the extent of their territorial identification data and those laid down in specific legislation16).
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Records of surface water which are or are to become permanently suitable for the life and reproduction of native fish and other aquatic animals
(1) Surface waters which are or are to become permanently suitable for the life and reproduction of native species of fish and other aquatic animals shall be recorded in the scope of their territorial identification data and those laid down in specific legislation17).
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Registration of water works for land waterworks
(1) Water works for land watermanagement shall be recorded in the scope of their territorial identification data and those laid down by special legislation12), with the exception of names, surnames, permanent residence and natural person's birth number.
(2) The data referred to in paragraph 1 shall be processed and stored in the information system of the public administration by the Agricultural Water Administration.
Registration of flood areas
(1) The designated flood areas shall be recorded in the scope of the data on territorial identification, water flow name, water flow manager, hydrological river basin identification number, kilometer of the beginning and end of the water flow section of the established flood area, the name of the municipality in whose territory the flood area is established, the code of the water authority which established the flood area and the date and number of the negotiating determination of the flood area by the water authority.
(2) The data referred to in paragraph 1 shall be processed and stored by the Institute in the public administration information system.
Common, final and repeal provisions
Method of processing, storage and transmission of data to public administration information systems
(1) Data registered under this decree are processed, transmitted and stored in the public administration information system administered by the Ministry of Agriculture or the Ministry of the Environment in such a structure as to enable data to be shared through a defined reference, shared and secure interface (18), including in a way that allows remote access.
(2) The data referred to in Sections 3 to 6, 11, 12 and 18 to 28 are stored in the public administration information system on an ongoing basis, the data referred to in Sections 7 to 10 and 13 to 17 are stored for the previous calendar year no later than 30 June of the calendar year.
(3) The registration according to this decree is carried out uniformly in public administration information systems for the Czech Republic.
(4) The basis for the registration carried out under this Order is in particular:
(a) basic base of geographical data of the Czech Republic,
b) basic water map of the Czech Republic 1: 50 000,
(c) data maintained in information systems of river basin managers, Agricultural water management, state enterprise Forests of the Czech Republic, retreat offices, national park administrations, Institute and Czech hydrometeorological institute.
Repeal
Decree No. 139 / 2003 Coll., on the registration of the state of surface and groundwater and how data are stored in the public administration information system, is hereby repealed.
Efficacy
This decree shall take effect on 1 July 2004, with the exception of the provisions of Paragraph 3 (5), which shall take effect on 1 January 2005, and the provisions of Sections 11 and 12, which shall take effect on 1 January 2010.
