DECLARATION
of 19 December 2023
establishing protection zones for the natural health source of the lake pelloid and defining specific protective measures
According to Article 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Points and on the amendment of certain related laws (Spa Act), as amended, for the implementation of Sections 21 (1) and (3), § 22 (5), § 23 (3) and § 24 (2) and (3) of the Act:
Establishment of protection zones
(1) In order to protect the natural medical source of the lake peloid (hereinafter referred to as "the source"), the district of Písek, the cadastral territory of Dědovice, shall be established protection zones I and II.
(2) The definition of the Class I protection zone is graphically indicated in a copy of the cadastral map, as set out in Annex 1 to this Decree. The definition of protection zones I. and II. is graphically marked in the base map of the Czech Republic, which is listed in Annex 2 to this decree. The list of coordinates (S-JTSK) defining protection zones I and II is given in Annex 3 to this Decree.
Definition of specific safeguard measures
(1) Only activities necessary for the protection and use of the source may be carried out in Level I protection zone. No unauthorised entry shall be allowed in the territory of the Class I protection zone.
(2) Level II protection zone is prohibited
(a) to carry out drainage works which could jeopardise the natural groundwater regime, including treatment of surface-flow rigs;
(b) to build and operate objects for agricultural production, industrial production objects and other objects in which it is a significant component of the technological processes of handling substances that threaten the quality or health of water, in particular those affecting organoleptic properties of water, persistent compounds, non-organic compounds of phosphorus and elemental phosphorus, fluorides, ammonia and nitrite, biocidal substances and plant and forest protection substances, and handling of substances of oil origin,
(c) establish and operate waste landfills and store waste;
(d) to carry out land-based work in violation of ground cover with the exception of work related to peloid extraction;
(e) carry out activities which disturb the soil layer and reduce the power of the covering layers;
(f) mine minerals, including the extraction of bacon, which is not declared a source;
(g) to carry out agricultural activities except maintenance of permanent grassland;
(h) grazing livestock;
(i) to produce, use and transport toxic substances;
(j) pollute the rock environment, including quaternary sediments and soil layers, by discharge of waste water into groundwater water, by application of liquid ammonia fertilisers, slurry of bovine and porcine animals, or by application of industrial fertilisers and plant protection products, by balancing cesspools, by discharge, discharge or drip into soil or surface water of liquids from silage or other liquids that could adversely affect the quality or health of water;
(k) to discharge water contaminated with substances that threaten the quality or the health of the water to the buildings for the water treatment of the land;
(l) make changes in the water flow mode by the source and its surroundings which would result in negative effects;
(m) to collect surface water except for existing authorised sampling; This does not apply when the general treatment of surface waters is concerned under a special legislation (1),
n) carry out the tearing work;
(o) carry out mining and mining activities, with the exception of research and research work for the use of resources;
(p) to camp outside the reserved places;
(q) use chemical sprinkler materials on the road which could cause contamination of surface waters and rock environments, including quaternary layers;
(r) to place stable construction and other machinery and drilling sets where liquid operating materials are used unless they are equipped with a device to prevent leakage of liquid fuels, oils, lubricants, cooling fluids and other operating materials into the rock environment; or
s) park motor vehicles outside the reserved parking lot.
Transitional provision
The procedure for the authorisation for the treatment of surface waters initiated before the date of entry into force of this Decree shall be completed in accordance with existing legislation.
Efficacy
This Decree shall take effect on 1 January 2024.
