DECLARATION
of 15 September 2005
amending Decree No. 265 / 1999 Coll., amending Decree No. 265 / 1999 Coll., laying down the period of service of professional soldiers preparing for the performance of their duties, and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement, as amended by Decree No. 455 / 2002 Coll.
The Ministry of Defence provides, pursuant to Articles 5 (6) and 60 (6) of Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 254 / 2002 Coll.:
Decree No. 265 / 1999 Coll., which provides for the period of service of professional soldiers who are preparing for the performance of their duties by study and the amount of remuneration which a professional soldier may be required if he fails to comply with the agreement, as amended by Decree No. 455 / 2002 Coll., shall be amended as follows:
1. In Article 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (d) is added:
"(d) for preschool or daily studies in schools in the Czech Republic and in courses in the Czech Republic lasting continuously more than 5 months, associated with pilot and flight instruction, for a period of three times the duration of the study."
2. Paragraph 2 (1) reads as follows:
"(1) The amount of remuneration for the failure to comply with the agreed period of time for which the soldier undertook to remain in service after graduation (hereinafter referred to as" agreed period ") for each month of study in the Czech Republic shall be:
(a) at the present or daily study
1. command branches of the university and in language courses 3 000 CZK;
2. in the Bachelor's or Master's study programme in the field of economics, technical sciences and technology or in the field of social sciences, in the doctoral programme or in the programme of lifelong learning, carried out by a university, CZK 4,500;
3. in the study programme in the field of medicine or in the field of pharmacy, carried out by university, 6 000 CZK;
4. in the study programme in the field of technical sciences and technology, associated with the training of pilots and flight ducts, carried out by the university, CZK 20,000;
5. in other cases CZK 2,000,
(b) study in the performance of duty
1. in the study programme carried out by the university CZK 1,500;
2. in other cases 1000 CZK. "
Transitional provision
The period of residence in the service of the professional soldier after completion of the studies initiated before the date of entry into force of this Decree and the cost of failure to fulfil the obligation taken over shall be governed by the rules in force at the time of commencement of the study.
This decree shall take effect on the first day of the month following its publication.
